Property Address: 200 Marine Way, Marina Historic District HPB Meeting Date: November 5, 2008 COA: 2009-005 ITEM BEFORE THE BOARD The item before the Board is the consideration of a Variance request to the side-street (north) setback requirement associated with the relocation of a non-contributing structure located at 200 Marine Way, Marina Historic District, pursuant to Land Development Regulations (LDR) Sections 2.2.6(D). 3 ,BACKGROUND:•& PROJECT DESCRIPTION.,_ <..: , _ , .r The subject property currently consists of the North 145.6' of Lot E, Less the West 28', The Moorings Subdivision, within the Marina Historic District. Located on the south side of SE 2nd Street and adjacent to the Intracoastal Waterway, the property is zoned R-1-AA (Single Family Residential), and currently contains a two-story, 4,167 total square foot, Ranch style single family residence. The circa 1948 structure is non-contributing to the Marina Historic District. The subject property was classified non-contributing in 1988 when the proposed historic district was originally surveyed for its historical importance. At that time, the property was not eligible for contributing classification as it was not developed within the adopted "Period of Significance" which spanned through 1943. In 1999, the structure was resurveyed and noted to have been architecturally compromised due to an addition to the west and replacement of the original windows. This is arguable as the west addition was appropriately designed and constructed, and removal of the original awning windows did not compromise the structure's integrity. The survey also.notes that "no notable historical associations have been connected with this building." This is not the case, as renowned and local architect Sam Ogren, Sr. designed the original structure (see attached 1948 plans),,giving the property not only an architectural importance, but cultural, as well. Further, the additions to the structure were appropriately designed and constructed, as they are compatible with the original structure and do not compromise its integrity. These findings were affirmed in the 2008 resurvey of the Marina Historic District which resulted in the recommendation of the adoption of an additional "Period of Significance" to span from 1944 through 1960, and included the reclassification of the subject property to contributing. It is noted that the recommendations contained in the 2008 resurvey will be acknowledged by the City Commission via resolution at the regular meeting of December 9, 2008. At the HPB meeting of September 17, 2008, a COA was approved which included the following components: • relocation of the existing structure within the existing property boundaries; • • demolition of the rear one-story portion (original to structure); • demolition of existing front wall plane spanning from bay window through to carport (added in 1953) 111 200 Marine Way:COA.2009-005 f HPB Meeting of November 5,2008 Page 2 of 3 • one and two-story additions including a two-car garage to provide a total square footage under roof of 4,572; • Demolition of existing swimming pool, installation of new swimming pool; and, • Additional site improvements and landscaping. At its October 15, 2008 meeting, the HPB reviewed an application to plat the subject property. A recommendation of approval was made to the City Commission. The plat would subdivide the existing property into two parcels, with the relocated structure to be located on the northern parcel. The relocation of the existing structure placed the bay window within the side street setback by approximately 2'. The request is now before the Board for consideration of a variance to the side street setback. < . .. The required side yard setback is fifteen feet (15') and the bay window is proposed to be located at 13'1"from the side street (north) property line. Pursuant to LDR Section 2.2.6(D), the Historic Preservation Board (HPB) shall act on all variance requests within an historic district, or on a historic site, which otherwise would be acted upon by the Board of Adjustment. In acting on such variance requests the Board may be guided by the following as an alternative to the criteria normally used by the Board of Adjustments: (1) That a variance is necessary to maintain the historic character of property through demonstrating that: (a) A variance would not be contrary to the public interest, safety, or welfare; (b) Special conditions and circumstances exist, because of the historic setting, location, nature, or character of the land, structure, appurtenances, sign, or building involved, which are not applicable to other lands, structures, appurtenances, signs, or buildings in the same zoning district, which have not been designated as historic sites or a historic district nor listed on the Local Register of Historic Places; (c) Literal interpretation of the provisions of existing ordinances would alter the historic site to such an extent that it would not be feasible to preserve the historic character, of the historic district or historic site; and, (d) The variance requested is the minimum necessary to preserve the historic character of a historic site or a historic district. The applicant has provided an explanation for the variance request which is attached. Variance Analysis The variance request is associated with the bay window only, which was part of the 1953 addition, and will be reconstructed with the redevelopment of the property. As noted in the background section above, the redevelopment includes the subdivision of the subject property to two separate lots, and the relocation of the subject structure onto the northern most lot in order to maintain it presence within the streetscape of SE 2nd Street and Marine Way. The redevelopment of the subject structure includes the reconstruction of the aforementioned bay window, which is appropriate in that it breaks up the main wall plane and provides additional interest in the elevation. However, its new location extends 2' into the required 15'side street setback, requiring a variance. The variance is supportable in that the applicant has placed the primary wall plane on the 15' setback, and provided a significant separation between the historic structure and the new construction.While the applicant could shift the entire redevelopment two feet, and reduce the living areas, this would not make the project as economically viable, ensuring the maintenance of the historic structure. An additional option, could be to place the structure back two feet (2'), not remove any square footage, I ,200 Marine Way;COA 2009-005 HPB Meeting of November 5,2008 Page 3 of 3 while requiring a greater variance request to the side interior setback, placing the structure closer to the adjacent property. Neither of these scenarios would result in the same quality product that would be accommodated by the granting of this minor variance. In accordance with the criteria noted above, the variance a) would not be contrary to public interest or safety, b) special conditions exist and circumstances exist due to the relocation of the structure in meeting setbacks and attempting to provide additional square footage while maintaining the historic character of the structure, c) literal interpretation would not provide as viable a redevelopment as provided, and d) the request is the minimum necessary to aid in the preservation of the structure's historic character, as presented. Therefore, the variance request can be supported as positive findings have been made pursuant to LDR Section 4.5.1(J)(1). _ ALTERNATIVE ACTIONS ; A. Continue with direction. B. Move approval of the Variance request (2009-005) for 200 Marine Way, Marina Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request and approval thereof is consistent with the Comprehensive Plan and meets the criteria set forth in the Land Development Regulations, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. C. Move denial of the Variance request (2009-005) for 200 Marine Way, Marina Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request is inconsistent with the Comprehensive Plan and does not meet the criteria set forth in the Land Development Regulations, the Delray Beach Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. The current proposal is to lift the existing house and relocate it towards the northern property. The existing bay window is not structurally sound and will not survive the move due to all the wood decay and neglect over the years. Although this bay window is not part of the existing historical structure,it does provide for a vertically architectural element that breaks up the one story portion of the house. We are proposing that when the new bay window is constructed,that all three exterior walls continue down to grade.The building code would allow for the bay window to extend over the side setback,so long as the walls below the window sills are returned back to the setback line at a 45 degree angle.Although this is allowed by code,it is in our professional opinion that the walls should go straight down and extend through the grade to the foundation. This proposed variance would not be contrary to the public interest,safety,or welfare. Special conditions and circumstances do exist in that the neglected historic structure is being totally renovated and being protected from future demolition. The bay window could be reconstructed in which the lower walls go back to the setback line on a 45 degree angle,which would alter the historic character of the house. The proposed variance for the bay window is the minimum that is required for this house because the rest of the structure does comply with all other setback requirements.
