Minutes of the Historic Preservation Board March 21, 2007 Motion/Findings: Motion made by Ms. Lake, seconded by Mr. Cope, and approved 6 to 0 (Ms. Peart absent) to move approval of COA-2007-133 for 305 North Swinton Avenue, Old School Square Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request is consistent with the Comprehensive Plan and meets criteria set forth in Section 4.5.1(E)(4) and (E)(8)(g) of the Land Development Regulations, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation with the following condition: 1. That the shutters visible from the public right-of-way be replaced with removable storm panels which contain tracks painted to match the exterior of the structure. B. 238 SE 7th Avenue, Marina Historic District Mr. & Mrs. Dan Dietrich, Property Owners; Eliopolous Architecture, Authorized Agent Consideration of a Certificate of Appropriateness (2007-098) associated with the new construction of a garage/guest cottage. Staff Presentation: Ms. Alvarez entered the project file into the record and presented a summary of the staff report. Ms. Alvarez advised that there is a tax exemption on the property. The State of Florida has provided a letter with respect to the subject application, and how it would affect their tax exemption (letter attached as part of the record). Applicant Presentation: Mr. Gary Eliopoulos, Eliopoulos Architecture, Inc., 205 George Bush Boulevard, Delray Beach, FL, presented a PowerPoint presentation of the project. Public Comments: Chairman Miller inquired if there were any comments from the public. Mr. Steve Harsnett, 405 SE 7th Avenue, advised this is the first time he had seen the plans. He had heard from each of the different Boards and Commission regarding their intent to be sensitive to homeowners who have had these towering structures built near their homes. Tonight would be a good opportunity to practice the sensitivity you have expressed. Ms. Ellen Key, 321 SE 7th Avenue, advised she agreed with what Mr. Harsnett said. She urged the Board to approve this item. Mr. Matt Grabham, 350 SE 7th Avenue, advised the Board he would like them to consider this request. Francisco Perez, Perez Design Inc., advised this Mr. Eliopoulos did a fantastic job for the needs of his client. 2 Minutes of the Historic Preservation Board March 21, 2007 Chairman Miller closed the public hearing. Ms. Alvarez advised in addition to what is left on the front elevation we are also preserving the streetscape. Mr. Dan Dietrich advised it enhances the streetscape. For anyone to suggest we move closer to the condominiums is disheartening. Board Discussion: Mr. Cope advised there is a huge opportunity for improvement in the front of the house and no opportunity in the back. From a site plan standpoint this is dead on. Board discussion ensued relative to the five panel doors,vegetation being moved from the front to the rear of the property, the location'of the car port, the color scheme, material choice for the railings, aluminum or wood (on the south side), material choice for the shutters. Motion/Findings: It was moved by Mr. Cope, seconded by Ms."Lake, and approved 6 to 0 (Ms. Peart absent) to move approval of COA 2007-098 for,238 SE 7th Avenue, Marina Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request is consistent with the Comprehensive Plan and meets criteria set forth in the applicable Land Development Regulations, the Delray Beach Historic Preservation Design Guidelines,and-the Secretary of the Interior'syStandards for Rehabilitation with the following conditions: 1. That the plan is revised to show a five foot (5') dedication along SE 7th Avenue; 2. That the location of the new-construction is revised to observe the front setback; 3. That the French' Door note relating to the upper window on the west elevation be corrected; 4. That the stair rails are`made of wood; 5. That shutter-dog hardware be provided; 6. Consideration of a Certificate of Appropriateness (2007-070) associated with the new construction of a single-family dwelling. Staff Presentation: Ms. Alvarez entered the project file into the record and presented a summary of the staff report. 3 Minutes of the Historic Preservation Board March 21, 2007 Applicant Presentation: Mark KraII, Esquire, authorized agent for the project introduced Mr. Francisco Perez, the project architect. Mr. Perez advised there were letters of support from neighboring property owners (attached). Mr. Perez noted that a home similar to this one was approved by the Board on December 17, 2003 (Staff Report attached). Mr. Perez advised this is a unique lot, and only visible from the waterway, despite this being a large parcel the project has only 29% coverage, it is 40' from the Intracoastal, and is consistent from what has been approved in the past under the old Guidelines. They closed on this property in the middle of the moratorium in 2006. We followed REG's guidelines as they were proposed to us. We found the lot coverage 30 - 35% as opposed to 40%. The staff report fails to mention thatzwe complied with the Guidelines. Mr. Perez advised the neighbors to the south are happy with the proposal. Mr. Perez advised the new Guidelines were denied at the City Commission Meeting o March 20, 2007. -sue Public Comments: Chairman Miller inquired if there were any comments from the public. Ms. Ellen Key, 321 SE 7th Avenue, advised they did a remarkable job of meeting REG's requirements. I support this project Mr. Steve Harsnett, 405 SE 7th Avenue, advised big is not bad. • Ms. Carolyn Patton, 1020 Tamarind Road, advised that this property is not visible from the street. With all due respect to Mr. ,Perez and Mr. Krall we are now seeing larger homes in the second block of the district.; Let's not bring the third into the second block if we can help it. \, Mr. Eliopoulos, advised that a large lot will support a large home. You have to look at thetdetails that a?e,being presented here tonight. My biggest issue with the guidelines is that we have five different districts. Some of these sites are unique. This property is on the Intracoastal and cannot be seen from the street. Mr. Matt Grabham, advised he likes the house, the quality of the architecture and craftsmanship. They have gone above and beyond the call of duty for this house to fit in, and I do not see how this can be construed as inappropriate. Chairman Miller closed the public hearing. Ms. Alvarez advised that the only regulations applied to this application are those that exist. Prior to the moratorium or thinking about revising the guidelines, staff placed the FAR (Floor Area Ratio) table into the staff report. This has nothing to do with any survey area that has not been supported by the City Commission. Mr. Craig Valvo, advised that our presentation is solid and clear. We did a complete analysis of the homes on the waterfront. This house can be seen from the intracoastal and as such any new structure would have to be compatible with the other waterfront properties in the district. That is not the direction the previous owner of the property was 4 Minutes of the Historic Preservation Board March 21, 2007 given. That is not the direction we were given. It clearly states we have to be compatible with the other properties in the district. Board Discussion: Board discussion ensued with positive comments relative to the floor plan, design of the house, and scale. Motion/Findings: It was moved by Ms. Lake, seconded by Mr. Cope, and approved 6 to 0 (Ms. Peart absent) to approve the Certificate of Appropriateness for 706 SE 2nd Street, Marina Historic District, based upon a failure to make positive findings with respect to LDR Sections 4.5.1(E)(4), (E)(7) and 4.5.1(E)(8)(a-k), the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation with the following conditions: 1. That the property survey is revised to show the distance to the'-centerline and crown of road; 2. That the types of windows and their finish are noted within the window schedule; 3. That the parapets contain coping; and 4. That all wall-mounted lighting specifications are submitted. D. 213 SE 7d'Avenue, Marina Historic District - Dana Parham, Property Owner; Mark Krall, Authorized Agent; Francisco Perez, Applicant. Consideration of a Certificate of Appropriateness (2007-069) and waiver request associated with the demolition of a non-contributing structure and new construction of a single-family dwelling. Staff Presentation: Ms. Alvarez entered the project file into the record and presented a summary of the staff report. Applicant Presentation: Mr. Perez advised he would like condition No. 2 under New Construction be deleted, and new windows should be compatible with the windows on houses on the street. Public Comments: Chairman Miller inquired if there were any comments from the public. Mr. Matt Grabham advised he supports the project. Chairman Miller closed the public hearing. Board Discussion: Board discussion ensued relative to positive comments relating to the project. 5 Minutes of the Historic Preservation Board March 21, 2007 Motion/Findings: By Separate Motions: Waiver Request Motion made by Mr. Cope, seconded by Ms. Del Fiandra, and approved 6 to 0 (Ms. Peart absent) to recommend to the City Commission approval of the waiver to LDR Section 4.1.4(C), which requires that properties shall not be developed except in accordance with the minimum lot area requirements of the district, based on a positive finding with respect to LDR Section 2.4.7(B)(5). Demolition Motion made by Ms. Lake, seconded by Mr./Cope, and approved 6 to 0 (Ms. Peart absent) to approve the Certificate of Appropriateness for demolition of the existing structure located at 213 SE 7th Avenue, Marina Historic District, based on positive findings with respect to LDR Sections 4.5.1(E)(6), and 4.5.1(F). New Construction Motion made by Mr. Cope, seconded by Ms. Lake and approved 6 to 0 (Ms. Peart absent) to approve the Certificate of Appropriateness (2007-069) for the new construction of a single-family dwelling located at 213 SE 7th Avenue, Marina Historic District, based on positive`findings with respect to LDR Sections 4.5.1(E)(4), 4.5.1(E)(6), 4.5.1(E)(7) and .4.51(E)(8)(a-k), the Delray Beach Historic Preservation Design Guidelines, and the`Secretary of the Interior's Standards for Rehabilitation, subject to the following conditions: 1. That the_landscape,plan is approved by the City Horticulturalist prior to certification; 2. That all site plan references to the swimming pool and spa be removed; 3./That a five foot(5') right,of way dedication to City Commission on SE 7th Avenue is made prior to plan certification; 4. That gate details are submitted and contain measurements and material notes; 5. That coping is added to the parapet features throughout; 6. That exterior lighting specifications are submitted; and 7. That all hardscape materials are noted on the landscape and/or site plan. IV. REPORTS AND COMMENTS • Public Comments Mr. Matt Grabham, advised at the last meeting he requested a letter stating that his property was not contributing. I presented it to the City Commission and Planning and Zoning Board, and I have not heard back as yet. Ms. Shannon Dawson, 527 S. Swinton Avenue, advised she was glad that this project was approved in such a timely fashion. 6 Minutes of the Historic Preservation Board March 21, 2007 Ms. Claudia Willis, 160 Marine Way, I am at a disadvantage because I know of every house we lost in the Historic District. I do not think 325 SE 7`h Avenue should be the comps that we are now using. It is very important that every decision you make for every district what it means down the road. Every decision is important. Ms. Linda Lake advised that the two story house on NE 7th, the third block off Atlantic Avenue that has been designated historic is now for sale with a different real estate company. It used to say project pending -what is happening. Ms. Alvarez advised that the plans were never certified, and it will be expiring in the next month or so. I believe it was approved in May 2005. It is individually designated Historic. MEMORANDUM .STAFF REPORT �'IIj► 1993 _,. _ : .. 1993 2001 2001 MEETING DATE: APRIL 4, 2007 AGENDA ITEM: CITY-INITIATED SMALL SCALE FUTURE LAND USE MAP AMENDMENT FROM CC (COMMERCIAL CORE) AND OMU (OTHER MIXED USE) TO OS (OPEN SPACE) AND REZONING FROM CBD (CENTRAL BUSINESS DISTRICT) AND OSSHAD (OLD SCHOOL SQUARE HISTORIC ARTS DISTRICT) TO OSR (OPEN SPACE AND RECREATION) FOR THE OLD SCHOOL SQUARE PARK SITE, LOCATED NORTH OF EAST ATLANTIC AVENUE, BETWEEN NE 1sT AVENUE AND PINEAPPLE GROVE WAY (NE 2ND AVENUE). ITEM BEFORE THE BOARD The item before the Board is that of making a recommendation to the Planning and Zoning Board regarding a City-initiated small scale Future Land Use Map amendment and rezoning for the Old School Square park as detailed in the above caption. Since a portion of the property is located in the Old School Square Historic District, the Historic Preservation Board is being asked at this time to make a recommendation to the Planning and Zoning Board. The associated site development plan for the proposed park will come before the Historic Preservation Board for approval. BACKGROUND/ANALYSIS The site is located north of East Atlantic Avenue, and extends between NE 1st Avenue and NE 2"d Avenue and is immediately south of the Old School Square Parking Garage. The north- south platted alleyway which traverses the block and separates the site is being abandoned and will be incorporated within the parking garage and park sites. The site contains approximately 1.09 acres and is owned by the City of Delray Beach. The parcels located to the west of the existing alley are located within the Old School Square Historic District and are zoned OSSHAD. The parcels to the east of the alley are zoned CBD. Therefore, the proposed park is subject to the Delray Beach Historic Preservation Guidelines and the Secretary of the Interior's Standards for Historic Preservation. The property has been utilized as a public parking lot and was part of a larger parcel, a portion of which was used in the construction of the parking garage. Phase II of the 2000 Old School Square Master Plan calls for the construction of a new parking facility with retail facing Pineapple Grove Way (now under construction), expansion of open space and new gabezo and a new site entrance from Pineapple Grove Way. Neither the current CBD nor OSSHAD zoning allow parks as either a permitted or conditional use. Thus, to accommodate the proposed park, rezoning to OSR is being processed. Additionally, the OSR zoning is not consistent with the current MX (Mixed Use) land use designation, thus the Future Land Use Map amendment on the entire property to OS is also proposed. City Initiated Future Land Use Plan Amendment and Rezoning for the Proposed Old School Square Park HPB Meeting April 4,2007 Comprehensive Plan Policies: A review of the objectives and policies of the adopted Comprehensive Plan was conducted and the following applicable objectives and policies have been identified. Future Land Use Element: Objective A-1: - Property shall be developed or redeveloped in a manner so that the future use and intensity is appropriate and complies in terms of soil, topographic, and other applicable physical considerations, is complimentary to adjacent land uses, and fulfills remaining land use needs. The property accommodates a public parking lot which is to be removed as a part of this development proposal per the Old School Square Master Plan. There are no special physical or environmental characteristics of the land that would be negatively impacted by the proposed park. The development will be complimentary with the surrounding commercial developments and residential uses as it will eliminate the existing surface parking lots and provide for a new urban park which will expand the Old School Square Cultural Arts Center to Pineapple Grove Way. Parks and Recreation Element Policy A-2.15: The City shall establish an Urban Park as part of the expansion of Old School Square Cultural Center. Multiple funding sources are to be pursued and the development should be accomplished by FY 2006/2007. Policy A-2.1: The City shall provide additional park, recreation, and open space facilities through enhancement of existing facilities, major capital improvements, and the provision of new services to geographic areas which do not have facilities readily available to them. Policy A-2.2: The City, through the Parks and Recreation Department, shall place its first recreation priority on the provision of facilities for activities which serve all residents of the community and which can be achieved through completing the development of existing park areas, enhancing existing facilities, and adding specialized items such as playgrounds to existing facilities. Policy A-2.3: Funds shall be allocated, on an annual basis, for the purpose of achieving Policy A-2.2. This mechanism shall only be one of the funding sources which are applied to meeting that policy. Policy A-2.14: All planning for parks and recreational facilities shall be in accordance with the adopted City of Delray Beach Parks and Recreation System Master Plan. The proposed park has been identified in the Old School Square Master Plan and the Parks and Recreation Master Plan as a vital asset to the proposed expansion of the Old School Square Cultural Arts Center. The proposed Future Land Use Map amendment and rezoning is the first step in the planning process to accomplish the above policies. 2 • City Initiated Future Land Use Plan Amendment and Rezoning for the Proposed Old School Square Park HPB Meeting April 4,2007 ASSESSMENT _ ., As stated above, parks are not allowed within the current OSSHAD or CBD zoning districts. The requested Future Land Use Map and zoning change will put in place the required zoning necessary to accommodate the proposed park envisioned in the Old School Square Master Plan and the Parks and Recreation Master Plan. At this time, the scope of the project has not been defined. At its meeting of March 20, 2007, the City Commission approved an agreement for professional consulting services for Glatting Jackson Kercher Anglin, Inc. in conjunction with the programming and site planning of proposed improvements at the Old School Square Cultural Arts Center. Through this process the consultants will conduct interviews with stakeholders and hold a charrette for interactive public participation in site programming and planning of proposed park elements and features. ALTERNATIVE ACTIONS A. Postpone with direction. B. Move a recommendation of denial to the Planning and Zoning Board for the Future Land Use Map amendment from CC (Commercial Core) and OMU (Other Mixed Use) to OS (Open Space) and rezoning from CBD (Central Business District) and OSSHAD (Old School Square Historic Arts District) to OSR (Open Space and Recreation) for Old School Square Park. ITEM:BEFORE THE-BOARDr.. The item before the Board is that of making a recommendation to the Planning and Zoning Board regarding a City-initiated small scale Future Land Use Map amendment and rezoning for the Old School Square park as detailed in the above caption. Since a portion of the property is located in the Old School Square Historic District, the Historic Preservation Board is being asked at this time to make a recommendation to the Planning and Zoning Board. The associated site development plan for the proposed park will come before the Historic Preservation Board for approval. BACKGROUNDIANALYSIS - The site is located north of East Atlantic Avenue, and extends between NE 1st Avenue and NE 2"d Avenue and is immediately south of the Old School Square Parking Garage. The north- south platted alleyway which traverses the block and separates the site is being abandoned and will be incorporated within the parking garage and park sites. The site contains approximately 1.09 acres and is owned by the City of Delray Beach. The parcels located to the west of the existing alley are located within the Old School Square Historic District and are zoned OSSHAD. The parcels to the east of the alley are zoned CBD. Therefore, the proposed park is subject to the Delray Beach Historic Preservation Guidelines and the Secretary of the Interior's Standards for Historic Preservation. The property has been utilized as a public parking lot and was part of a larger parcel, a portion of which was used in the construction of the parking garage. Phase II of the 2000 Old School Square Master Plan calls for the construction of a new parking facility with retail facing Pineapple Grove Way (now under construction), expansion of open space and new gabezo and a new site entrance from Pineapple Grove Way. Neither the current CBD nor OSSHAD zoning allow parks as either a permitted or conditional use. Thus, to accommodate the proposed park, rezoning to OSR is being processed. Additionally, the OSR zoning is not consistent with the current MX (Mixed Use) land use designation, thus the Future Land Use Map amendment on the entire property to OS is also proposed. City Initiated Future Land Use Plan Amendment and Rezoning for the Proposed Old School Square Park HPB Meeting April 4,2007 Comprehensive Plan Policies: A review of the objectives and policies of the adopted Comprehensive Plan was conducted and the following applicable objectives and policies have been identified. Future Land Use Element: Objective A-1: - Property shall be developed or redeveloped in a manner so that the future use and intensity is appropriate and complies in terms of soil, topographic, and other applicable physical considerations, is complimentary to adjacent land uses, and fulfills remaining land use needs. The property accommodates a public parking lot which is to be removed as a part of this development proposal per the Old School Square Master Plan. There are no special physical or environmental characteristics of the land that would be negatively impacted by the proposed park. The development will be complimentary with the surrounding commercial developments and residential uses as it will eliminate the existing surface parking lots and provide for a new urban park which will expand the Old School Square Cultural Arts Center to Pineapple Grove Way. Parks and Recreation Element Policy A-2.15: The City shall establish an Urban Park as part of the expansion of Old School Square Cultural Center. Multiple funding sources are to be pursued and the development should be accomplished by FY 2006/2007. Policy A-2.1: The City shall provide additional park, recreation, and open space facilities through enhancement of existing facilities, major capital improvements, and the provision of new services to geographic areas which do not have facilities readily available to them. Policy A-2.2: The City, through the Parks and Recreation Department, shall place its first recreation priority on the provision of facilities for activities which serve all residents of the community and which can be achieved through completing the development of existing park areas, enhancing existing facilities, and adding specialized items such as playgrounds to existing facilities. Policy A-2.3: Funds shall be allocated, on an annual basis, for the purpose of achieving Policy A-2.2. This mechanism shall only be one of the funding sources which are applied to meeting that policy. Policy A-2.14: All planning for parks and recreational facilities shall be in accordance with the adopted City of Delray Beach Parks and Recreation System Master Plan. The proposed park has been identified in the Old School Square Master Plan and the Parks and Recreation Master Plan as a vital asset to the proposed expansion of the Old School Square Cultural Arts Center. The proposed Future Land Use Map amendment and rezoning is the first step in the planning process to accomplish the above policies. 2 City Initiated Future Land Use Plan Amendment and Rezoning for the Proposed Old School Square Park HPB Meeting April 4,2007 ASSESSMENT As stated above, parks are not allowed within the current OSSHAD or CBD zoning districts. The requested Future Land Use Map and zoning change will put in place the required zoning necessary to accommodate the proposed park envisioned in the Old School Square Master Plan and the Parks and Recreation Master Plan. At this time, the scope of the project has not been defined. At its meeting of March 20, 2007, the City Commission approved an agreement for professional consulting services for Glatting Jackson Kercher Anglin, Inc. in conjunction with the programming and site planning of proposed improvements at the Old School Square Cultural Arts Center. Through this process the consultants will conduct interviews with stakeholders and hold a charrette for interactive public participation in site programming and planning of proposed park elements and features. ITEM BEFORE THE BOARD The item before the Board is that of making a recommendation to the Planning and Zoning Board on a Conditional Use request to establish and/or expand the residential-type inn use (associated with the Sundy House) on Lots 4-20, Block 61, Lots 15-20, Block 70, and Lots 1-3, Sundy Estates in the Old School Square Historic District pursuant to LDR Sections 2.4.5(E) and 4.4.24(D)(4). Since the property is located in the Old School Square Historic District, the Historic Preservation Board is requested to make a recommendation to the Planning and Zoning Board, which will then make a recommendation to the City Commission. If the Conditional Use is approved by the City Commission, the associated site development plan will be presented to the Historic Preservation Board for consideration of approval. BACKGROUND The proposal is to establish a residential-type inn use on Lots 4-20, Block 61, which is bound by West Atlantic Avenue to the North, South Swinton Avenue to the east, SW 1st Street to the south, and SW 1st Avenue to the west, and, located farther to the southeast, Lots 15-20, Block 70, which are bound by SE 1st Street to the north, SE 1st Avenue to the east, an east/west alley to the south, and South Swinton Avenue to the west (see attached location map). All of the aforementioned properties are located within the Old School Square Historic District and zoned OSSHAD (Old School Square Historic Arts District). Lots 4-20 within Block 61 currently contain a total of seven (7) properties containing contributing structures, and Lots 15-20, within Block 20, currently contain a total of four (4) properties containing contributing structures. The Sundy House, located on the south side of SW 1st Street, between South Swinton Avenue and S.W. 1st Avenue, was approved for the subject use in 1998. The subject application is requesting approval to expand the use through its establishment on the aforementioned properties by achieving the following: Block 61 — Sundy Lane • Relocate contributing structure across existing alley from SW 1st Avenue to South Swinton Avenue; • Remove surface parking lot located at northeast corner of SW 1st Avenue and SW 1st Street; • Construct ten (10), two-story structures containing a total of fifty-two (52) residential-type inn units; • Convert existing second-story space into four (4) residential-type inn units in structure located at southwest corner of West Atlantic Avenue and South Swinton Avenue; • Place one (1) residential-type inn unit in second-story of "Cathcart House", located on South Swinton Avenue, between West Atlantic Avenue and SW 1st Street; • Construct a subterranean parking garage below the western half of Block 61. Conditional Use Request— Sundy House and South Swinton Avenue Redevelopment HPB Meeting of April 4, 2007 Page2of2 Block 70— Sundy Harvest • Relocate three (3) existing structures to Block 61, facing South Swinton Avenue; • Remove surface parking lot located at southeast corner of South Swinton Avenue and SE 1st Street; • Construct four(4), two-story structures containing a total of sixteen (16) residential-type inn units. Sundy Estates— Sundy House • Add three (3) residential-type inn "spa" units in second-story of new two story structure. Eleven (11) units currently exist on the site. A copy of the complete site plan proposal is attached for reference. ANALYSIS The proposed development is allowed by conditional use under the Old School Square Historic Arts District (OSSHAD) zoning designation. With respect to the compatibility of the residential-type inn use and pursuant to LDR Section 2.4.5(E)(4), the Planning and Zoning Board and City Commission must make findings that establishing the conditional use will not: (a) have a significantly detrimental effect upon the stability of the neighborhood within which it will be located; nor (b) hinder development or redevelopment of nearby properties. The expansion of the residential-inn type use from the Sundy House property onto two immediately adjacent blocks is compatible and meets the aforementioned LDR. The use, as well as the existing and proposed commercial uses (to be reviewed at a later date), will bring additional activity to a significant area of South Swinton Avenue which has not yet benefited from redevelopment. Overall, the project has the potential to revitalize South Swinton Avenue which could encourage the adaptive reuse of the historic structures located on the adjacent properties. At present, many of these structures are vacant and falling into disrepair. Pursuant to LDR Section 4.4.24(D)(4), residential-type inns shall not exceed more than eighteen (18) individually leased suites or rooms per acre. The entire project proposal consists of eighty-seven (87) units within a total of 5.71 acres (Block 61-3.17 acres, Block 62-1.68 acres, Block 70-.86 acres). Therefore, the total number of units per acre is 15.24. However, it should be noted that this calculation includes the acreage within the entire site to be developed. If the properties were to be sold individually, the units per acre would exceed the maximum density allowed per the above noted LDR. REVIEW BY OTHERS The Community Redevelopment Agency (CRA) considered the subject application request at its meeting of March 22, 2007 and recommended approval. RECOMMENDED ACTION Move a recommendation of approval to the Planning and Zoning Board for the request of a Conditional Use associated with a Residential-Type Inn within the OSSHAD (Old School Square Historic Arts District) zoning district on Blocks 61 and 70, and Sundy Estates subdivision in the Old School Square Historic District pursuant to LDR Sections 2.4.5(E) and 4.4.24(D)(4).
