ACTION ITEMS A.348 NE 15`Avenue, Old School Square COA File# (2013-224) Consideration of the COA and waiver associated with improvements to the residence home. Exparte Communication Price Patton—Drive by Lynn Van Duyne, Historic Preservation Planner, presented the item through a review of the staff report with recommendation of approval. Applicant Presentation—Omar Ghanchi, G&B Builders I concur with staff and I am here for any questions that you might have for me. In regards to the fence, it does not go all the way back. And the 3ft. setback, if you want it to have any landscaping we can put that in. Bill Bathurst — He commented that with the new LDRs we discourage loosing parking garages. But with that said it is getting done. The garage is about 700sq.ft and what are you going to doing with that. Omar Ghanchi—We are going to put a bar, sliding glass pass through windows, couch, tv. Bill Bathurst — He asked to have it confirmed that there was 220 in the area and that the area looks like an efficiency or apartment. Jill Hazelman—348 NE 15`Avenue This is a foreclosure and was an illegal safe house/sober house and our intent is to improve the house. Price Patton—He asked if on the long side of the house that a window might be put in. Omar Ghanchi—He said that it was discussed and they will put in a window. Public Comments -None Board Discussion John Miller — He asked if a landscape plan was submitted with the package and is it required. Lynn said that no, not required. Bill Bathurst — In regards to parking regulations, is 8ft. wide our standard? Lynn said that for parallel parking standard size is 8'x22'. Angela Budano —She thought that the 3ft. area near the fence there could be more than sod put there. 2 Minutes of the September 16, 2015 Historic Preservation Board Meeting Motion was made by Price Patton and seconded by Angela Budano to approve the Certificate of Appropriateness (2015-224) with one condition from staff report. Lynn responded that the applicant is working on the house and we are waiting on the attorney's office and appraisal. This is a new process so we are working through it all. The full dialog is available in audio at City Hall for anyone that would like the full it formation) 3 HISTORIC PRESERVATION BOARD MEMORANDUM STAFF REPORT Property Owner: Jill Haselman Authorized Agent: Omar Ghanchi, G&B Builders, LLC Property Address: 348 NE 1st Avenue, Old School Square Historic District HPB Meeting Date: September 16, 2015 File No: 2015-224 ITEM BEFORE THE BOARD The item before the Board is the consideration of a Certificate of Appropriateness (COA) and an associated waiver for improvements to the residence and property located at 348 NE 1st Avenue, Old School Square Historic District, pursuant to Land Development Regulations (LDR) Section 2.2.6(D). BACKGROUND & PROJECT DESCRIPTION The property contains a non-contributing two-story vernacular residence with an attached garage built in 1994. There are no other COA's on file for this property. The property is zoned Old School Square Historic Arts District (OSSHAD) and is a single family residence. The current request is for the enclosure of an existing garage creating living space, replacing all windows with impact resistant style windows to match existing, adding new sliding windows and sliding doors at the garage conversion on the west elevation, removal of all shutters, changing the exterior paint color, the addition of a swimming pool, new wood gate and fencing, and two new parallel parking spaces located adjacent to the paved alley. Vehicular access to the garage and driveway is currently located off the alley. There is no onsite parking located at the front of the house at NE 1st Avenue. Site improvements include a swimming pool, fencing, three gated entries, and two paved parallel parking spots. The swimming pool will be located in back of the residence where the existing driveway is currently located. Two new gates and fencing will be provided separating the swimming pool from the parking area. The existing siding material of the structure is hardie board plank and it will be painted an aqua color. All the trim will be painted white. The improvements proposal includes a waiver to the following section of the land Development Regulations: LDR Section, 4.6.16(H)(3)(d), which requires a landscape barrier between the common lot line and the off-street parking area or other vehicular use area in a planting strip of not less than five (5) feet in width that is free of any vehicular encroachment, including car overhang. A landscaped barrier shall be provided between the off-street parking area or other vehicular use area and abutting properties. The landscape barrier may be two (2) feet at the time of planting and achieve and be maintained at not less than three (3) nor greater than six (6) feet in height to form a continuous screen between the off-street parking area or vehicular use area and such abutting property. The subject COA and associated waiver are now before the Board for consideration. 348 NE 1st Avenue,2015-224 HPB Meeting September 16,2015 Page 2 of 5 SITE PLAN & DEVELOPMENT STANDARDS Supplemental District Regulations Pursuant to LDR Section 4.6.9(C)(2), Parking Requirements for Residential Uses, two spaces per dwelling unit. Tandem parking may be used provided that in the Single Family (R-1 District) or RL District, no required parking space may be located in a required front or street side setback. STAFF COMMENT: Two spaces at the rear of the property are required, which have been provided in the two parallel parking paved spaces adjacent to the alley, they are not located in a front or side street setback. Therefore, positive findings can be made. Pursuant to LDR Section 4.6.15(G)(1), Swimming Pool, Whirlpools, & Spas: Yard Encroachment, swimming pools, the tops of which are no higher than grade level, may extend into the rear, interior or street side setback areas but no closer than ten feet (10') to any property line. STAFF COMMENT: The site plan indicates that the proposed swimming pool and decking is located 10' from the south and north (side interior) and rear property lines. Therefore, positive findings can be made. DESIGN ELEMENTS ANALYSIS Pursuant to LDR Section 2.4.6(H)(5), Prior to approval, a finding must be made that any Certificate of Appropriateness which is to be approved is consistent with Historic Preservation purposes pursuant to Objective A-4 of the Land Use Element of the Comprehensive Plan and specifically with provisions of Section 4.5.1, and the Secretary of the Interior's Standards for Rehabilitation. LDR Section 4.5.1 (E) Development Standards: All new development or exterior improvements on individually designated historic properties and/or properties located within historic districts shall, comply with the goals, objectives, and policies of the Comprehensive Plan, and the Secretary of the Interior's Standards for Rehabilitation, and the Development Standards of this Section. Relief from Subsections (1) through (9) below may be granted by seeking a waiver approvable by the Historic Preservation Board, unless otherwise stated. (E)(2)(b)(1), Major and Minor Development: The subject application is considered "Minor Development", as it is new construction in a historic district. STAFF COMMENT: The proposed construction measures less than 25% of the existing floor area The proposed new construction classifies the subject request as "Minor Development." Therefore positive findings can be made. 4.5.1 (E) (3) (a) 1. c. c. Fences and walls over four feet (4') shall not be allowed in front or side street setbacks. 348 NE 1't Avenue,2015-224 HPB Meeting September 16,2015 Page 3 of 5 STAFF COMMENT: A wood, six foot high fence (including partial existing fencing) with three new gates are proposed at each (side interior) property line and at the rear of the property. Therefore, positive findings can be made. E)(3)(b)1., Buildings, Structures, Appurtenances and Parking; Parking: Parking areas shall strive to contribute to the historic nature of the properties/districts in which they are located by use of creative design and landscape elements to buffer parking areas from adjacent historic structures. At a minimum, the following criteria shall be considered: a. Locate parking adjacent to the building or in the rear. b. Screen parking that can be viewed from a public right-of-way with fencing, landscaping, or a combination of the two. c. Utilize existing alleys to provide vehicular access to sites. d. Construct new curb cuts and street side driveways only in areas where they are appropriate or existed historically. e. Use appropriate materials for driveways. f. Driveway type and design should convey the historic character of the district and the property. STAFF COMMENT: The proposal includes two parallel parking spaces covered in permeable pavers located at the rear of the property. The permeable pavers will increase drainage on the property. The parking spaces are fenced off and adjacent to the existing paved alley, therefore positive findings can be made. (E)(8) Visual Compatibility Standards All improvements to contributing buildings, structures and appurtenances thereto within a designated historic district shall be visually compatible. In addition to the Zoning District Regulations, the Historic Preservation Board shall apply the visual compatibility standards provided for in this and other criteria set forth elsewhere in Section 4.5.1. (b) Front Facade Proportion: The front facade of each building or structure shall be visually compatible with and be in direct relationship to the width of the building and to the height of the front elevation of other existing structures and buildings within the subject historic district. (c) Proportion of Openings (Windows and Doors), The openings of any building within a historic district shall be visually compatible with the openings exemplified by prevailing historic architectural styles of similar buildings within the district. The relationship of the width of windows and doors to the height of windows and doors among buildings shall be visually compatible within the subject historic district. (d) Rhythm of Solids to Voids: The relationship of solids to voids of a building or structure shall be visually compatible with existing historic buildings or structures within the subject historic district for all development, with particular attention paid to the front facades. (g) Relationship of Materials, Texture, and Color, The relationship of materials, texture, and color of the facade of a building and/or hardscaping shall be visually compatible with the predominant materials used in the historic buildings and structures within the subject historic district. (i) Walls of Continuity: Walls, fences, evergreen landscape masses, or building facades, shall form cohesive walls of enclosure along a street to ensure visual compatibility with historic buildings or structures within the subject historic district and the structure to which it is visually related. (j) Scale of a Building: The size of a building and the building mass in relation to open spaces, windows, door openings, balconies, porches, and lot size shall be visually compatible with the building size and mass of historic buildings and structures within a historic district for all development. 348 NE 1st Avenue,2015-224 HPB Meeting September 16,2015 Page 4 of 5 (I) Architectural Style: All major and minor development shall consist of only one (1) architectural style per structure or property and not introduce elements definitive of another style. STAFF COMMENT: The proposed new construction strives to meet the criteria noted above. However, the following findings were made that require the following revisions: The absence of windows on the south side of the garage renovation detracts from the style of new architecture as well as the prevailing historic architectural styles within the neighborhood. The proposed south elevation proposes removal of two of its existing windows. Further examination of retaining or adding additional windows to this elevation would harmonize the house with its existing window and door locations and proportions. Based on the comments provided above, positive findings can be made, subject to the implementation of recommendations provided at the end of this report. LDR Section 4.6.9 Parking: 4.6.9 (C) (1)(g)(2) a. Two parking spaces are required for single family dwelling. No parking may be located in a required front setback or side street setback. 4.6.9 (D) (3)(c)(4) a. Parallel parking spaces shall be 8'-0"feet in width and 22'-0" in length. STAFF COMMENT: The proposal includes two parallel 8' x 22' parking spaces covered in permeable pavers located at the rear of the property. The parking spaces are fenced off and adjacent to the existing paved alley and located at the rear of the property. Therefore positive findings can be made. WAIVER ANALYSIS Pursuant to LDR Section 2.4.7(B)(5), prior to granting a waiver, the approving body shall make a finding that the granting of the waiver: (a) Shall not adversely affect the neighboring area; (b) Shall not significantly diminish the provision of public facilities; (c) Shall not create an unsafe situation; and, (d) Does not result in the grant of a special privilege in that the same waiver would be granted under similar circumstances on other property for another applicant or owner. Perimeter landscaping requirements relating to abutting properties: Per LDR Section, 4.6.16(H)(3)(d), a landscape barrier is required between the common lot line and the off-street parking area or other vehicular use area in a planting strip of not less than five (5) feet in width that is free of any vehicular encroachment, including car overhang. The applicant is proposing to reduce the required 5' planting strip area to 3' paved area. He will provide permeable pavers for drainage. The applicant has provided a letter of justification for the proposed waiver which is attached to this report. 348 NE 15t Avenue,2015-224 HPB Meeting September 16,2015 Page 5 of 5 STAFF COMMENT: The Waiver criteria noted above as a, b, c, and d is utilized in analyzing the waiver request, as follows; The waiver is requesting relief to reduce the required 5' planting strip area to a 3' paved area along the north and south side interior setbacks located adjacent to the alley. The proposal is providing the two required parking spaces for the property as parallel parking spaces. The parking, adjacent to the alley, does not diminish the provision of public utilities, as the water meter is located at the front of the property. The permeable pavement material will increase drainage at the parking and setback areas. The Engineering department has confirmed the meter and utilities locations as not be affected by the parking spaces. In 2001, identical parallel parking spaces were approved by the board through the COA process for a residence on the same street as the subject property. Based on the comments provided above, positive findings can be made. ALTERNATIVE ACTIONS A. Continue with direction. B. Move approval of the Certificate of Appropriateness and associated waiver (2015-224) for 348 NE 1st Avenue, Old School Square Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request and approval thereof meets the criteria set forth in the Land Development Regulations and the Secretary of the Interior's Standards for Rehabilitation. C. Move denial of the Certificate of Appropriateness and associated waiver(2015-224) for 348 NE 1st Avenue, Old School Square Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request does not meet the criteria set forth in the Land Development Regulations and the Secretary of the Interior's Standards for Rehabilitation. RECOMMENDATION By separate motions; COA 2015-224; Move approval of the Certificate of Appropriateness (2015-224) for 348 NE 1st Avenue, Old School Square Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request and approval thereof meets the criteria set forth in the Land Development Regulations and the Secretary of the Interior's Standards for Rehabilitation, subject to the following conditions: 1. That at least one new window (that match existing-single hung style with muntins) are added to the south (ground level) elevation of the garage living space; or that the existing windows and openings are retained or replaced with new windows. WAIVER 2015-224; Move approval of the waiver (2015-224) for 348 NE 1st Avenue, Old School Square Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request and approval thereof meets the criteria set forth in the Land Development Regulations and the Secretary of the Interior's Standards for Rehabilitation.
