14-77 ORDINANCE NO. 14-77 AN ORDINANCE OF TItE CITY COUNCIL OF THE CITY OF DELRAY BEACtt, FLORIDA, AMENDING CHAPTER 3 "SIGNS AND BILLBOARDS" OF T~[E CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY AMENDING SECTION 3-7 TO PROVIDE APPROVAL BY ALL APPLICABLE CITY DEPARTMENTS AND THE COMMUNITY APPEARANCE BOARD OF Tim SIGNS'STRUCTURAL DETAILS, MATERIALS, COLORS, LOCATION AND AESTHETIC QUALITY; PEALING SECTION 3-].3 "AESTHETIC REGULATIONS OF SIGNS3' AND INSERTING IN LIEU THEREOF A NEW SECTION 3-~13; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DEL~{Y BEACH, FLORIDA, AS FOLLOWS: Section !. That Section 3-7 of Chapter 3 "Signs and Billboards" of the Code of Ordinances be amended to read as follows: Pro-~idedthe provisions of this chapter have first been complied with, and the signs or advertising structures do not violate any of the terms, con- ditions, or provisions of this chapter, or any other law or ordinance, and Provided that the signs,structural details, materials, colors, location and aesthetic ~ual~y has. been a~Qroved by all applicable City Departments and the Community Appearance Board. The building official shall issue a permit for such sign or advertising structure, retaining a copy thereof for his re- cords. Permits shall be numbered and shall disclose: (1) The type of sign as defined in this Chapter. (2) The street address of the.property upon which said sign is proposed to be located and the p~oposed location of the sign on said property. In the absence of a street address, a method of location acceptable to the building official shall be used. (3) The name of the sign contractor who shall erect the structure. (4) The amount of the fee paid for such peri,it. (5) The date of issuance. (Ord. No. 51-75, § 8, 12-8-75) ' Section 2. That Section 3-13 of Chapter 3 "Signs and Billboards" of the Code of Ordinances be repealed and a new Section 3-13 be inserted in lieu thereof to read as follows: The aesthetic quality of a building, or indeed, of an entire neighborhood is materially affected by achieving visual h~rmony of the sign on or about a structure as it relates to the architecture of the building or adjacent surroundings. In addition to the mechanical limztations on signs imposed by this sign chapter, there are certain aesthetic considerations which must be met ~nd are therefore subject to review by the Community Appearance Board: (1) The scale of the sign must be consistent with the scale of the building on which it is to be placed or painted. However, in no case shall it exceed the size pro- vided for in other sections of this ordinance. (2) The overall effect of the configuration or coloring of the sign shall not be garish. The colors shall not conflict with other signs already on the building or in the immediate vicinity. (Ord. No. 51-75, § 14, 12~8-75~ (3) Standard street, directional and real estate signs shall not require review or approval by the Community Appearance Board. Section 3~ That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence or word by declared by a court of competent jurisdiction, to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. That this ordinance shall become effective ten days after passage on second and final reading. PASSED AND ADOPTED in regular session on this the 28th day of March , 1977.
