AN ORDINANC~ OF THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AMENDING THE FIRST
PARAGRAPH OF SECTION 2-33 (B) OF ~{E CODE OF
ORDINANCES OF THE CITY OF DELRAY BF~CH
RELATIVE TO APPLICATIONS FOR PERMITS TO BE
REVIEWED BY THE COMMUNITY APPEARANCE BOARD
AND ADDING ~IE REQUIRE~ENT T~AT EVERY
APPLICATION FOR A PERMIT FOR NEW CONSTRUCTION
OF PARKING AREAS OR O~{ER VEHICULAR USE AREA
WHICH iNVOKES ~E LANDSCAPING REQUIREMENTS OF
CHAPTER 15C OF THE CODE OF OPD~NANCES OF THE
· CITY OF DELRAY BEACH SHALL BE PROCESSED
THROUGH THE COMMUNITY APPEARANCE BOARD FOR
APPROVAL; PROVIDING A SAVING CLAUSE; PROVIDING
AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIS~
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the first paragraph of Section 2-33 (b) of the
Code of Ordinances be amended to read as follows:
(b) The ~ommunity Appearance Board shall review
.and mak~ a decision to approve, approve with
conditions or disapprove, every application
for a permit to erect a building, structure
or sign or to materially alter an elevation
of any existing building or structure or
sign 'in the City of Delray Beach, excluding
separate single-family dwellings, but
including group single dwellings and everv_
aDDlication for a permit for new construction
9.f parking areas or other vehicular use
areas which invoke the landscaping requirements
of Chapter 15C of the Code of Ordinances of
the City of Delray. E%each. Every application
shall be accompanied by two (2) sets of
detailed plans and if plans submitted do not
furnish sufficient information adequately
to show the scope of the planned construction
fo~ which a permit has been requested, then
there shall be furnished, in addition to the
tWo (2) sets of detailed plans, one set of
detailed specifications for such proposed
work; both. the plans and specifications
shall be prepared by a registered architect
· or registered engineer, qualified under the
laws of the Sta~e of Florida to prepare such
plans and specifications. The Community
Appearance Board shall not give a favorable
decision to the application for a permit
until the plans (and specifications %.hen
required) including landscape plans, have
been provided as herein set forth and
approved by the board.
Section 2. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence or word
be declared by a court of competent jurisdiction, to be invalid,
such decision shall not affect the validity of ~he remainder hereof
as a whole or part thereof other than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten
days after passage on second and final reading.
