WHEREAS, the City Commission of the City of Delray Beach, Florida, desires to maintain the high level of emergency medical services currently provided to the residents of the City of Delray Beach by the Fire Department of the City of Delray Beach; and WHEREAS, the City Commission of the City of Delray Beach has determined that in order to continue the level of emergency medical services currently enjoyed by the citizens of the City of Delray Beach that emergency transportation services should be provided for Advanced Life Support patients, and Basic Life Support patients; and WHEREAS, the City Commission of the City of Delray Beach is desirous of implementing a fee structure for emergency medical transportation for Advanced Life Support patients and Basic Life Support patients; and WHEREAS, the-City Commission of the City of Delray Beach has also expressed its intent that patient care is of primary concern and that an individual's ability to pay the fees shall not affect the quality of the care rendered; and WHEREAS, the City Commission of the City of Delray Beach, Florida, is desirous for the Fire Department to provide advanced life support and all manner of emergency medical services and transportation in and for the City of Delray Beach, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: $~tion !. That Title IX, "General Regulations", Chapter 96, "Fire Safety and Emergency Services", Subheading "Emergency Medical Services", Section 96.65, "Definitions", of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended to read as follows: Section 96.65 DEFINITIONS. For the purposes of this subchapter, the following definitions shall apply: IA) f~ "BASIC LIFE SUPPORT SERVICES". Basic life support services include the provision of treatment services]/~/~¢/~¢/~ ~¢~g~¢¢~ /~ /~¢~¢¢~ rendered to patients which do not require invasive techniques, which include, but are not limited to, simple bandaging, minor splinting and simple immobilization, and may include transportation to a hospital by the Delray Beach Fire Department. - 2 - Ord. No. 5-95 ~B~ f~ "ADVANCED LIFE SUPPORT SERVICES". Advanced life support services are those types of patient treatment services which require advanced medical therapy, including, but not limited to: electrocardiographic monitoring; use of external pacemakers; defibrillation; intravenous therapy; medication administration; cardiopulmonary resuscitation; endotracheal intubation; other advanced airway and artificial ventilator techniques~ and may include transuortation to a hospital bv the Delray Beach Fire "General Regulations" Chapter ~ That Title IX, , 96, "Fire Safety and Emergency Services", Subheading "Emergency Medical Services", Section 96.66, "Emergency Medical Services; Fees", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby repealed in its entirety, and a new Section 96.66, "Emergency Medical Transportation Fees", is hereby enacted to read as follows: Section 96.66 EMERGENCY MEDICAL TRANSPORTATION FEES. (A) The following service charges or fees are levied for the Drovision of emergency medical transportation: {1) Advanced Life SUDDOrt transportation fee ~275.00 (2) Basic Life Support transportation fee ~205.00 (3) Mileage fee $ 5.00/mile (B) The City Commission may adjust fees annually pursuant to the Inflation Index Charge [I.I.C.) which is used by Medicare to determine the appropriate fee char~es. ~ That Title IX, "General Regulations", Chapter 96, "Fire Safety and Emergency Services", Subheading "Emergency Medical Services", Section 96.67, "Billing and Collection of Emergency Medical Service Fees; Costs and Attorneys' Fees", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby repealed in its entirety, and a new Section 96.67, "Collection of Emergency Medical Service Fees", is hereby enacted to read as follows: - 3 - Ord. No. 5-95 Section 96,67 COLLECTION OF EMERGENCY MEDICAL SERVICE FEES. (Al The Fire Department shall submit bills to patients or to the patient's insurance carrier for the provision of Basic Life Support or Advanced Life Support transportation. (B] Any bill remaining unpaid for a period of ninety (90) days shall be considered delinquent. Any delin~uent bill shall incur interest at the rate of nine percent (9%) per annum. The notice of an interest charge shall be included on the initial bill mailed to the (C) The City may collect delinqUent charges through any and all available legal remedies. (D~ The City Finance Department is hereby authorized ~O accept assignment at the maximum allowable rate of Medicaid. Medicare. and the Palm Beach County Health Care District benefits. ~E) The City Finance Department is hereby authorized to negotiate payment settlements of outstandina debts owed to the City for emergency services rendered when the debtor is unable to satisfy the outstanding balance due. ~ That Title IX, "General Regulations", Chapter 96, "Fire Safety and Emergency Services", Subheading "Emergency Medical Services", of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended by enacting a new Section 96.68, "Emergency Medical Services and Advanced Life Support Provider", to read as follows: Section 96.68 EMERGENCY MEDICAL SERVICES AND ADVANCED LIFE SUPPORT (A) The Fire Department is hereby authorized to obtain and maintain any and' all necessary State of Florida licensin~, vehicl~ permits and all necessary Palm Beach County Certificates of Public Convenience and Necessity (COPCN). pursuant to Chapter 401. Florida Statutes. and Palm Beach County EMS Ordinance. Palm Beach Cou~tv Code. Chapter 13. and any subsequent applicable revised laws and ordinances. for the purpose of providing Advanced Life SUpport and all manner Of emergency medical services as it applies to emergency medical and trauma treatment and emergency transportation services, in and for the City of Delray Beach. - 4 - Ord. No. 5-95 I (B) The Fire Department shall, upon obtaining all necessary licens~ and certifications, be designated as the primary provider of Adva~¢~ Life Support and of all manner of emergency medical services as it a~lies to emergency medical and trauma treatment and emergency transportation services within the city limits of the City of Delray ~ That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. ~ That all ordinances or parts of ordinances in conflict herewith be, and the same are hereby repealed. I (4-MAN CREW FOR FIRE SERVICE) In order to determine the true cost of our EMS services, one has to extract the full cost of the fire service. The one assumption that must be made is "what level of fire service do we want to have?". The answer to this question lies in the I.C.M.A. Manual for Fire Services, 2nd Edition, page 120 which establishes fire standards and states that a four-man pumper would equate to a 65% efficiency rate (3-man equals 38%, 5-man equals 100%). Therefore, we will assume each station at four (4) personnel. SALARY COSTS Assuming a four-man crew per shift per station would mean that all additional resources above this level could be attributed to EMS. In addition, the EMS Division Chief and the EMS Supervisor positions (Paramedic Lieutenants) can be fully attributed to EMS. These calls can be further categorized as 25% BLS (Basic Life Support) and 75% ALS (Advanced Life Support). This means that there are 850 BLS transport calls and 2,550 ALS transport calls per year. We are estimating that there will be a 25% uncollectible amount. If the City wants to breakeven, it therefore must bill $835,550 (EMS cost) plus 25% or $1,114,067 ($835,550/.75) if it expects to collect a net amount of $835,550. Of this amount, approximately $51,000 (3 miles per run x 3,400 runs x $5.00) will be charged in mileage fees and the remainder will be charged from basic rates. Ordinance 95- establishes a fee schedule for Advanced Life Support and Basic Life Support transportation and eliminates the current charges for emergency medical fees. The proposed fee schedule for transportation service is as follows: Advanced Life Support $275.00 Basic Life Support $205.00 Mileage Fee $5.00/mile The oxygen charge of twenty two dollars ($22.00) has been eliminated based on current changes in the Medicare covered services. The basic transport fee has been increased to compensate for the oxygen fee. Medicare as of January 1, 1995, will not allow the oxygen charge to be itemized. The oxygen fee must be part of the basic transport fee. Medicare will adjust the basic transport allowable rate to compensate for the oxygen charges. The ordinance also designates the Fire Department as the Advanced Life Support provider within the City of Delray Beach. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH AS FOLLOWS: Section 1. That Title 9, "General Regulations," Chapter 96, "Fire Safety and Emergency Services," Section 96.65, "Definitions," of the Code of Ordinances of the City of Delray Beach, Florida be, and the same is hereby amended to read as follows: Section 96.65 DEFINITIONS. For the purposes of this subchapter, the following definitions shall apply: (A). . ,,,.,/~'~ "BASIC LIFE SUPPORT SERVICES". Advanced life support services are those types of patient treatment services which require advanced medical therapy, including but not limited to: electrocardiographic monitoring, use of external pacemakers, defibrillation, intravenous therapy, medication administration, cardioPulmonary resuscitation, endotracheal intuba on, ,.~...v...~o ............. , v ...................~ ~ ........ ~ ........ ~. . ~ n~,:~, ..... ~ other advanced airway and artificial ventilator techniques, and may include transportation to a hospital by the Delray Beach Fire Department. ~.' That Title 9, "General Regulations," Chapter 96, "Fire Safety and Emergency Services," Section 96.66, "Emergency Medical Services; Fees." of the Code of Ordinances of the City of Delray Beach, Florida is hereby repealed in its entirety, and a new Section 96.66 "Emergency Medical Transportation Fees" is enacted to read as follows: 96.66 EMERGENCY MEDICAL TRANSPORTATION FEES. (A) The following service charges or fees are levied for the provision of emergency medical transportation: (1) Advanced Life Support transportation fee $275.00 (2) Basic Life Support transportation fee $205.00 ~ $ 5.00/mile ~) The City. COmmission may adjust fees annually pursuant to the Inflation Index Charge fl.I.C.) which is used by Medicare to determine the appropriate fee charges. Section 3. That Title 9, "General Regulations," Chapter 96, "Fire Safety and Emergency Services," Section 96.67, "Billing and Collection of Emergency Medical Service Fees; costs and Attorneys' Fees" of the Code of Ordinances of the City of Delray Beach, Florida is hereby repealed in its entirety, and a new Section 96.67 "Billing and Collection of Charges, Costs, and Attorney's Fees." is enacted to read as follows: (A) The Fire Department shall submit bills to patients or to the patient's insurance carrier for the provision of Basic Life Support or Advanced Life Support transportation. (B) Any bill remaining unpaid for a period of ninety_ (90) days shall be considered delinquent. Any delinquent bill shall incur interest at the rate of 9% per annum. The notice of an interest charge shall be included on the initial bill mailed to the patient. 3 ORD. NO. 5-95 (C) The City. may collect delinquent charges through any and all available legal remedies. (D) The City. Finance Department is hereby authorized to accept assignment at the maximum allowable rate of Medicaid, Medicare. and the Palm Beach County Health Care District benefits. .CE) .The City Finance Department is hereby authorized to negotiate payment settlements of outstanding debts owed to the City for emergency services rendered when the debtor is unable to satisfy, the outstanding balance due. Section 4. That Title 9, "General Regulations," Chapter 96, "Fire Safety and Emergency Services," of the Code of Ordinances of the City of Delray Beach, Florida be, and the same is hereby amended by enacting a new Section 96.68, "Emergency Medical Services and Advanced Life Support Provider," to read as follows: 96.68 EMERGENCY MEDICAL SERVICES AND ADVANCED LIFE SUPPORT PROVIDER. (A) The Fire Department is hereby authorized to obtain and maintain any and all neeessa~. State of Florida licensing, vehicle ~tmrmits and all necessary_ Palm Beach County Certificates of public convenience and necessity (COPCN). pursuant to Chapter 401. Florida Statutes. and Palm Beach County EMS Ordinance. Palm Beach County Code. Chapter 13. and any subsequent applicable revised laws and ordinances, for the purpose of providing Advanced Life Support and all manner of emergency medial services as it 'applies to emergency medical and trauma treatment and emergency transportation services, in and for the City of Delray Beach. (B) The Fire Department shall, upon obtaining all necessary, licenses and certifications, be designated as the primary_ provider of Advanced Life Support and of all manner of emergency medical services as it applies to emergency medical and trauma treatment and emergency transportation services within the city limits of the City of Delray Beach. Section 5. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 6. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. 4 ORD. NO. 5-95 Section 7.
