36-77 ORDINANCE NO. 36-77 AN ORDINANCE OF ~{E CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29 "ZONING" OF T~[E CODE OF ORDINANCES OF THE CITY OF DELRAY BEACI{ BY A~ENDING SECTION 29-7(D) RM-10 (MULTIPLE FAMILY DWELL][NG) DISTRICT AND SECTION 29-8 (D) ~-15 (MULTIPLE FAMILY DWELLING) DISTRICT BY ADDING A SUBSECT- ION (4) TO PERMIT DUPLEX ~ESIDENCES ON LOTS WITH MINIMUM SQUARE FOO~IGE OF 8,000 SQUARE FEET AND PER- MITTING THE CONVEYANCE OF EACH UNIT AND APPROXIMATELY ONE-HALF OF T~ LOT WITHOUT FURTHER PLATTING REQUIRE- MENT, PROVIDED THaT EACH ONE-HALF OF THE LOT CONTAINS NOT LESS '.[~I~N 4,000 SQUARE FEET; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, ~{EREFORE, BE IT ORDAIt{ED BY THE~CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 29-7(D) RM-10 Multiple Family Dwelling District be amended by adding a Subsection (4) to read as follows: (4) Duplexes On lots or parcels of record where duplexes are 'permitted, and where said lots or parcels are. at least 8,000 square feet, and where there is a party wall separating the two (2) duplex units, each unit together wihh approximately one-half (½)of the lot may be conveyed, providing each portion of the lot contains not less than 4,000 square feet, and the dividing line runs through the party wall. The conveyance as set forth in this paragraph shall not constitute subdivision requiring additional platting. (a) Conditions (1) The party wall separating the two .duplex units must be a fire wall, as required for residential separations in the Southern Standard Building Code, as adopted by the City. (2) Each individual duplex unit and its portion of the lot or parcel it is located on, must be adjacent to a public or private street, and have direct access thereto. Section 2. That Section 29-8(D) RM-15 Multiple Family Dwelling District be amended by adding a Subsection (4) to read as follows: (4) Duplexes On lots or parcels'bf re~ord where duplexes are permitted, and where said lots or parcels are at least 8,000 square feet, and where there is a party wall separating the two (2) duplex units, each unit together with approximately one-half (~)of the lot may be conveyed, providing each portion of the lot contains not less than 4,000 square feet, and the dividing line runs through the party wall. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity, of the remainder hereof as a whole or part thereof othe than the part declared to be invalid. Section 4. That this ordinance shall become effective ten days after passage on.second and final reading.
