12-08-24 Regular COUNCIL CHAMBER °' December 8, 1924 ~Phe Council raet in regular session, the 7 mayor presiding. Councilmen Byrd, Malone, O'Neal and Scott were present. Councilman Sundy was absent. The minutes of the previous meeting were read and approved. It was moved by Mr, Byrd, seconded by Mr. O'Neal, that the minutea of the meeting of October 13, 1924 be amended by inserting the following: "That the audit Yo r the fiscal year, October ~lst, 1923 to September 30, 1924, as made by the Sjostrom li~udit Company be accepted by the City Council,"and that 'the minutea Qf,the special meeting of October 15, 1924, be amended by inserting the followin g: "That the report of the special committee appointed by the Mayor, October 13, 1924, at the regular session of the Council to check out the retiring City Clerk and to check in his successor be accepted" On roll call thoscYotin~ in~the affirmative were M~''3~yrd, Mr. Malone, Mr. O'Neal and 2dr. Scott. The Clerk brought before the Council the matter of adopting an order of procedure for the condudt of Council meetings. On motion of Mr. Malone, aeconded by Mr. Byrd, a definite procedure was ordered. Motion passed. Mr. Byrd, Chairman o£ the Ordinance Committee presented the following resolution: A RESOLUTION BY THE CITY COUNCIL OF THE CITY ~' J DELRAY, DLOR IDA, WH E3EBY SAID CITY RELINQUISHES ALL C~,IMS INTEREST OR RIGHTS IT MAY HAVE; OR BE ENTITLED TO IN THAT PORTION OF BLOCK 69 AS SHOuYN BY THE ORIGINAL PLAT OF THE TOWN OF LINTON AND HEREBY RATIFIES AND APPROVES THE McGINLEY-GOSMAN PLAT OF SAID BLOCK 69. L BE IT RENOLVED BY THE CITY COUNCIL OF TAE CITY OF DELRAY, FLORIDA. WHEREAS, There was formerly laid out and dedicated William S. Linton, in Block 69 of the ~l'own of Linton, a portion of said block called Spruce Park, another portion. said block called Elsie Street, and also a portion of said block designated as alleys, as is shown by the original pl. of the Town of Linton on file in Plat Book 1 at page 3, Pa'. Beach County public records, and, in the WHEREAS, AlI of said Block 69 was purchased by H.P, inlay and John W. Gorman and said purchasers did on the day of May, A.D. 1912, resubdivide said Block 69, and the platting of said subdivision, Elsie Street, Spruce k and three alleys shown to be lonated in bloffik 69 by original plat of the Town of Linton, were disregarded, WHEREAS, The City of Delray has since the filing of said Gorman-McGinley plat of said subdivision of said block 69 continuously ratified and approved said plat by collect- ing tagea and municipal assessments against the various property owners, who have in good faith, purchased lots according to the plat of the GAsman-McGinley subdivision of said block 69, and have constructed permanent improvements upon said lots from time to time. NOW THEREFORE BE IT RESOLVED, by the City Council of he City of Delray, Florida, that the City of Delray go on ecord as approving and ratifying that certain plat filed y H.P. McGinley and John W. It was moved by &Tr. Byrd, seconded by Mr. Malone that tie resolution be adopted, and a copy be sent to the Clerk of the Circuit Court at the County Seat to be placed on the records. On roll call, the vote was unanimous. WHEREAPI, It is necessary and proper for the City. of Delray to meet the necessities of the progressive age ~ and they constant demand of its citizens and tourists to ~byild and construct a municipal golf course, and to pur- chase suitable ground for the building and construction of said municipal golf course, and WI~EREAS, It is necessary for the best interests and health of the citizens of the City of Delray that a aui able filtration plant be erected in connection with our present water wanks, and that suitable equipment and engine e purchased therefore, and it 3s necessary and essential t extend and further improve the- water end light system of th City of Delray, and WHEREAS, It is deemed most expedient and essen- ~ 'tial that further improvements be made on the municipal park lin the way of building a band stand and constructing pave- ~ents around the said Park, and I ~ ~'JAEREAS, it is necessary for the beat interests o: he citizens of the City of llelray, for the City of Delray ti urehase and take ova r the Chamber of Commerce Hall and lot pon which said Hall is located. It was moved by Mr. O'Neal, Chairman of the !r Water Fc Light Committee, seconded by P~Sr. Scott, that the City erect the electric sign to be purchased by business men, and that the City put in and furnish the poles and also the necessary electric current. Motion was passed, The permit of C.S. Losh, to erect a residence in the fire zone was, on motion of nir. Byrd, {seconded by h4r. O'Neal, granted, Certain property owners who had previously requested a change in the plat of Block 54 appeared before the Council and requested that the easement for public utilities be permitted on either side of lots 3 and 11. It was moved by D.Zr. Malone, Chairman of the 1 Street Committee, and seconded by :,fir. Byrd, that the ~f the Fast Coast Construction Company be accepted. Mr. Byrd brought up the question of the ite k :1200. in the City budget for the band, and asked how they Council wished to appropriate this money. It was moved by P,4r. Byrd, and seconded by Mr. O'Neal, that A4r. Miller, conductor of the band be allowed X75.00 a week for sixteen weeks, Pur. Miller to present an itemized bill at each regular meeting of the Council.
