24-76 ORDINANCE 24-76 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29 "ZONING" OF THE CITY'S CODE OF ORDINANCES BY AMENDING SUBSECTION 29-1 "DEFINITIONS" BY ADDING LIFE CARE RETIREMENT COMMUNIZES; BY AMENDING SUBSECTION 29-7 "RM-10 MULTIPLE FAMILY DWELLING DISTRICT" BY ADDING LIFE CARE RETIREMENT COM- MUNITIES TO SUBPARAGRAPH (C) CONDITIONAL USES; BY AMENDING SUBSECTION 29-8' 'RM-15 MULTIPLE FAMILY DWELL- ING DISTRICT" BY ADDING LIFE CARE RETIREMENT COMMUNITIES TO SUBPARAGRAPH (C) CONDITIONAL USES; BY AMENDING SUB- SECTION 29-11 "GENERAL COMMERCIAL DISTRICT" BY ADDING GLASS AND GLAZING SHOPS TO SUBPARAGRAPH (B) PERMITTED USES; BY AMENDING SUBSECTION 29-12 "SPECIALIZED COMMERCIAL DISTRICTTM BY ADDING GLASS AND GLAZING SHOPS TO SUBPARAGR3~PH (B) PERM2£TTED 'USES; BY AMENDING SUBSECTION 29-13 "CENTRAL BUSINESS DISTRICT" BY ADDING GLASS AND GLAZING SHOPS TO SUBPARAGRAPH (B) PERMITTED USES;~ BY AMENDING SUBSECTION 29-18 "OFF-STREET PARKING REGULATIONS" BY ADDING LIFE CARE RETIREMENT COMMUNITIES TO SUBPARAGRAPH (F) (5); REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A PENALTY CLAUSE; PROVIDING A SAVING CLAUSE; PRO- VIDING AN EFFECTIVE DATE. ~ WHEREAS, The Planning and Zoning Board has recommended adding "Life Care Retirement Communities" as a conditional use in the RM-10 Multiple Famil? Dwelling District and the RM-15 Multiple Family Dwelling District; and WHEREAS, the Pianning. and Zoning Board has recommended adding "Life Care Retirement Communities" as a miscellaneous use in the Off-Street Parking Regulations; and WHEREAS, the Planning and Zoning Board has recommended adding "Glass and Glazing Shops" as a permitted use in the General Commercial, Special- ized Commercial and Central Business Districts; and WHEREAS, the City administration concurs in said recommendations~ and, WHEREAS, the City Council of the City of Delray Beach, Florida, has determined that such change should be made, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 29-1, Definitions, be amended by adding the following: Section 29-1 DEFINITIONS (101) Life Care Retirement Community. A planned residential development for aged persons, which includes total life-care facilities, consisting of supervision or assistance in personal and nursing care, dining, and varied recreational facilities. Section 2. That Section 29-7 (C), RM-10 Multiple Family Dwelling District, and Section 29-8 (C), RM-15 Multiple Family Dwelling District, be amended by adding the following as a conditional use' Life care retirement communities, subject to Site and Development Plan Approval (S~. 29-2.2~. Section 3. That Section 29-11 (B) General Commercial District; Section 29-12 (B) Specialized Commercial District; and, Section 29-13 (B) Central Business District be amended by adding the following as a permitted use: (B) PERMITTED USES Glass and glazing shops Section 4. That Section 29-18(F) (5), Off-Street Parking Regulations, be amended by adding the following section: Life care retirement communities 1.1 per dwelling unit, plus one (1) per staff or employee Section 5. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 6. That any person, firm or corporation violating any of the provisions of the Section above shall, upon conviction, be punished as pro- vided in Section 1-6 of the Code of Ordinances of the City of Delray Beach. Section 7. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 8. That this Ordinance shall become effective ten days after passage on second and final reading.
