AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 29 "ZONING" OF THE
CITY'S CODE OF ORDINANCES BY AMENDING SECTION 2~ 5
(N) (1) SINGLE FAMILY DWELLING DISTRICTS TO PERMIT ZERO
LOT LINE DEVELOPMENTS CONTAINING SEPARATE RESIDENTIAL
STRUCTURES; BY AMENDING SECTION 29-6 (B) (3) RM-6
MULTIPLE FAMILY DWELLING DISTRICTS; SECTION 29-7 (B)
(3) RM-10 MULTIPLE FAMILY DWELLING DISTRICTS; SECTION
29-8 (B) (3) RM-15 MULTIPLE FAMILY DWELLING DISTRICTS
RELATIVE TO WHICH SINGLE FAMILY DWELLING DISTRICT
REGULATIONS SHALL BE OBSERVED WHEN SINGLE FAMILY
DWELLINGS ARE CONSTRUCTED IN A MULTIPLE FAMILY ZONING
DISTRICT; BY AMENDING SECTION 29-12 (B) SC (SPECIALIZED
COMMERCIAL DISTRICT) TO ALLOW "AUTOMOTIVE REPAIR SHOPS
AND GARAGES" AND "MUFFLER SHOPS" AS PERMITTED USES;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CON-
FLICT HEREWITH; PROVIDING A PENALTY CLAUSE; PROVIDING A
SAVING CLAUSE; PROVIDING AN .EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 29-(N) (1), Single Family Dwelling District,
be amended to read as follows:
(N) SPECIAL REGULATIONS
(1) Zero lot ~&nes line developments, as defined below, are
allowed in the R-lA and R-1AA zoning districts, when
approved as a conditional use (Sec. 29-21). On any two
~-o~-mo~e lots which meet the minimum ~e~ lot
~ dimensions ~ the ~we~n~ and site area as stated
herein, the residential, structure may be placed con-
tiguous to the side property line, e~mmo~ to &ts
~wne~sh~p, provided the sum of the two (2) required
setbacks exists on the opposite side ~ the eommon

Section 2. That the following Sections shall each be amended to read
as set forth below:
Section 29-6(B) (3) RM-6 MULTIPLE FAMILY DWELLING DISTRICT,
(3) Single family dwellings and their'customary accessory
uses including, bird aviaries, boat docks, dog houses
and dog runs, garages, greenhouses, guest cottages,
playhouses, pool houses and covers, pump houses, slat
houses, storage sheds, swimming pools, tennis courts,
tool sheds, workshop~, and similar recreational
facilities. Single family dwellings shall comply with
the district regulations for the-R--~R-1A zoning
district.
Section 29-7 (B) (3), RM-10 Multiple Family Dwelling District,
(3) Single family dwellings and their customary accessory
uses including, bird aviaries, boat docks, dog houses~
and dog runs, garages, greenhouses, guest cottages,
playhouses, pool houses and covers, pump houses, slat
houses, storage sheds, swimming pools, tennis courts,
tool sheds, workshops, and similar recreational
facilities. Single family dwellings shall comply with
the district regulations for the ~iTk~-R-1A zoning
district.
Section 29-8(B) (3), RM-15 MULTIPLE FAMILY DWELLING DISTRICT
(3) Single family dwellings and their customary accessory
uses including, bird aviaries, boat docks, dog houses
and dog runs, garages, greenhouses, guest cottages,
playhouses, pool houses and covers, pump houses, slat
houses, storage sheds, swimming pools, tennis courts,
tool sheds, workshops, and similar recreational
facilities. Single family dwellings shall comply with
· the district regulations for the R-~AA-R-1A zoning
district.
Section 3. That Section 29-12 (B) SC Specialized Commercial District
be amended to add the following as permitted uses:
Automotive repair shops and garages
Muffler shops
Section 4. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
Section 5. That any person, firm or corporation violating any of the
provisions of the Section above shall, upon conviction, be punished as pro-
vided in Section 1-6 of the Code of Ordinances of the City of Delray Beach.
Section 6. That should any section or provision of this ordinance or
any portion thereof, any paragraph, sentence or word be declared by a court
of competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or part thereof other than the
part declared to be invalid.
Section 7. That this Ordinance shall become effective ten days after
passage on second and final reading.
PASSED AND ADOPTED in regular session on second and final reading on
this the 23rd day of Auqust , 1976.
