AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29 "ZONING"
OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY
BEACH BY AMENDING SECTION 29-5 TO INCLUDE A NEW
ZONING DISTRICT TO BE KNOWN AS R-lAB SINGLE FAMILY
DWELLING DISTRICT, THAT WILL HAVE TPIE SAME REQUIRE-
MEAv£S AS THE R-lA ZONING DISTRICT WITH THE EXCEPTION
OF THE MINIMUM AGGREGATE FLOOR AREA WHICH WILL BE
1,500 SQUARE FEET; BY AMENDING SECTION 29-5 (D)(E)
AND (F)(1) TO INCLUDE R-lAB; D~LSO BY AMENDING SEC-
TION 29-2 (C) TO INCLUDE R-lAB AS ONE OF THE ZONING
DISTRICTS WITHIN THE CITY OF DELRA¥ BEACH; REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING A PENALTY CLAUSE; PROVIDING A
SAVING CLAUSE; pROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Board has recommended that a
new R-lAB Single Family Dwelling District be established that will have
the same requirements as the R-lA Single Family Dwelling Dis trict with
the exception of the minimum aggregate floor area which will be 1,500
square feet; and,
WHEREAS, the City Administration concurs in such recommendation;
and,
WHEREAS, the City Council of Delray Beach, Florida, has determined
that such change should be made,
NOW, TPIEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS: .-
Section 1. That there is hereby established a new zoning district
in the City of Delray Beach to be known as R-lAB Single~ Family Dwelling
· District which shall have the same requirements as is currently set forth
in the City of Delray Beach Zoning Code, Section 29-5, for R-lA Single
Family Dwelling District, except that the minimum aggregate floor area shal~
be 1,500 s~uare feet.

Section 3. That Section 29-5(E) be amended by adding the following:

Section 4. That Section 29-5(F)(1) be amended by adding the
following:

Section 5. That Section 29-2(C) be amended by adding the follow-
ing:
(C) ESTABLISHMENT OF ZONING DISTRICTS
R-~.AB Si.ngle Family Dwellinq District
Section 6. That all ordinances or parts of ordinances in conflic~
herewith be and the same are hereby repealed.
Section 7. That any person, firm or corporation violating any of
the provisions of the Section above shall, upon conviction, be punished
as provided in Section 1-6 of the Code of Ordinances of the City of Del-
ray Beach.
Section 8, That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence or word be declared
by a court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part there-
of other than the part declared to be invalid.
Section 9., That this ordinance shall become effective ten days
after passage on second and final reading.
