30-76 ORDINANCE NO. 30 -76 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REZONING AND PLACING LAND PRESENTLY ZONED CN NEIGHBORHOOD COMMERCIAL (COUNTY ZONING) IN RM-15 MULTIPLE FAMILY DWELLING DISTRICT ~CITY ZONING) SAID LAA~ LOCATED SOUTH OF BERMUDA GARDENS ROAD BETWEEN STATE ROAD A-1-A AND TIlE INTRA- COASTAL WATERWAY, SAID LAND BEING IN SECTION 28, TOWNSHIP 46 SOUTH, RANGE 43 EAST, AND AMENDING "ZONING MAP OF DELRAY BEACH, FLORIDA, 1976". P ......... ~ Zonin9 Board has recommended rezoning and placing land presently zoned CN Neighborhood Commercial (County Zoning) in RM-15 Multiple Family Dwelling District (City zoning); and, W}~EREAS, the Board of County Commissioners of Palm Beach County, Florida, approves the increased density as proposed by the City of Delray Beach; and, WHEREAS, the City Administration concurs in said recommendation; and, WHEREAS, the City Council of the City of Delray Beach, Florida, has determined that such change should be made, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the following described property in the city of De!ray Beach, Florida, is hereby rezoned and placed in 'the RM-15 Multiple Family Dwelling District as defined by Chapter 29 of the Code of Ordinances of the City of Delray Beach, Florida, to-wit: The South 200 feet of the North 2170 feet.of Section 28, Township 46 South, Range 43 East, lying west of State Road No. A-1-A and being bounded on the west by the Intracoastal Waterway. Section 2. That the Planning Director of said City shall, upon the effective date of this ordinance, change the Zoning Map of Delray Beach, Florida, to conform with the provisions of Section 1 hereof. Section 3. This ordinance shall become effective ten days after passage on second and final reading.
