AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29 "ZONING"
OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY
BEACH BY AMENDING SECTION 29-13 CBD (CENTRAL
BUSINESS DISTRICT) SUBSECTIONS (I) AND (J) BY
PROVIDING THAT THE MINIMUM NUMBER OF OFF-STREET
PARKING SPACES, ONE (1) SPACE FOR EACH 300 SQUARE
FEET OR FRACTION THEREOF, SHALL BE REQUIRED RE-
GARDLESS OF THE TYPE OF USE BEING MADE OF THE
PREMISES, WHENEVER ANY BUILDING OR STRUCTURE IS
EP~ECTED, ENLARGED OR INCREASED IN CAPACITY; FURTHER
PROVIDING T~.'~%T THE IN-LIEU. PAYMENT SET FORTH IN
SUBSECTION (J) SHALL BE FIAg~D AT $800.00 PER SPACE
FOR NEWLY CONSTRUCTED BUILDINGS AND $1,000.00 PER
SPACE FOR ADDITIONS; PROVIDING THAT THE IN-LIEU PAY-
MENTS SET FORTH IN SUBSECTION (J) SHALL BE MADE PRIOR
TO THE TIME A PER/~IT FOR CONSTRUCTION IS ISSUED;
PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. That Section 29-13(I) and (J) CBD (Central Business
District) be amended to read as follows:
(I) PARKING AND LOADING REGULATIONS
(li The regulations of Sec. 29-18 and Sec. 29-19
shall apply~., except as modified herein.
(2) The minimum number of off-street parking spaces
shall be provided whenever any building or
structure is erected, a~e~e~7 enlarged, or
increased in capacity
(3) The minimum num]~er of off-street parking spaces
required, re.gardless of use, ~8~-e~a~ge~-~
shall be as follows:

three-hundred (300) square feet, or
fraction thereof, of the total floor
area. The in-lieu payments hereinafter
mentioned for the number of parking
spaces necessitated by this ordinance
shall not apply to existing structures,
but only for new construction and
addition to existing structures. In
computing the in-lieu payments for add-
itions, only the enlarged area shall be
considered in arriving at the cost per
parking space.
(4) Parking spaces for all multiple family projects,
including hotels and motels, shall be located on
the same lot as the main building.
(5) Parking spaces for other than multiple family
projects shall be located on the same lot, or
within six hundred (600) feet of the property
line.
(6) The design and screening of all parking areas
shall be subject to other provisions of this
Code. In the case of Conditional Use approval,
the City Council can modify said requirements.
(J) ALTERNATE OFF-STREET PARKING REGULATIONS
(1) If it is impossible to provide the required
number of off-street parking spaces, the
owner if he so desires, may pay into the
Downtown Development Authority, a sum of
money to be determined herein. Such payment
shall be in lieu of the parking requirements
of Sec. 29-13(I) (3). ~is provision shall
not be applicable to dwelling unit projects.
(2) The cost per parking space shall be eemp~e~

apace for newly constructed buildings and one-

SECTION 2. That should any sectio~ or provision of this ordinance
or any portion thereof, any paragraph, sentence or word be declared by
a court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
SECTION 3. That this ordinance shall become effective ten days
after passage on second and final reading.
