Emergency City Commission Special Meeting - COVID-19

Mayor Petrolia called the emergency special meeting to order at 4:00 p.m.
The roll call was taken by the City Clerk.
The following were in attendance:
Mayor Shelly Petrolia, Deputy Vice Mayor Shirley Ervin Johnson, Deputy Vice
Mayor William Bathurst, and Vice-Mayor Ryan Boylston

1.RESOLUTION 70-20 OF THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, DECLARING A STATE
OF EMERGENCY PURSUANT TO CHAPTER 95 OF THE
CITY CODE OF ORDINANCES AND AUTHORIZING THE
CITY MANAGER TAKE ANY AND ALL ACTIONS DEEMED
NECESSARY, IN ACCORDANCE THEREWITH, TO
PROTECT AND PRESERVE THE HEALTH, SAFETY,
WELFARE, LIVES, AND PROPERTY OF THE CITIZENS OF
THE CITY OF DELRAY BEACH AND THE PUBLIC AT
LARGE; PROVIDING AN EFFECTIVE DATE AND FOR
OTHER PURPOSES.

The Mayor turned the meeting over to the City Manager to present the
COVID-19 information from Palm Beach County Emergency Management
and approval of Resolution No. 70-20 to declare a State of Emergency in
Delray Beach due to COVID-19.
This resolution would grant the City Manager the ability to establish
curfews, implement emergency procurement procedures, declare areas of
the City off-limits, make provisions for the availability and use of temporary
housing, establish an emergency operations center, and monitor retail
price gouging on behalf of the City. In addition, he recommended that the
Commission prohibit any gatherings of 300 or more persons on any
City-owned property until further notice.

Notification will be made as other events begin to cancel.
The City was notified on March 13, 2020 by the Palm Beach County
Supervisor of Elections that pursuant to Emergency Order 20-002 issued
by Florida Division of Emergency Management that Abbey Delray, senior
assisted-living facility, has canceled its contract with the Supervisor of
Elections, Precinct #4118 located at 1717 Homewood Blvd. has been
changed to Orchard View Elementary School, 4050 Germantown Road.
The order was put in place to minimize the risk of spreading COVID-19
among an at-risk population.
Palm Beach County School District announced that effective March 13,
2020 all schools will be closed until March 27, 2020.
City Attorney Gelin read Resolution No. 70-20 into the record.
A discussion ensued between the Commission and the City Manager
regarding child care for City employees. It was determined that the City
would not establish a City led daycare, but will leave the discretion to all the
department heads on allowing children to come to work with the employee
or work from home options, if needed.
Vice-Mayor Johnson questioned the provision in Section 4 regarding the
City Manager having the authority to terminate the State of Emergency and
wanted to see a specific time frame in place and have it be renewed as
needed.
With no further business to discuss, the meeting was adjourned at 4:20
p.m.
A motion was made by Deputy Vice Mayor Bathurst, seconded by Commissioner
Boylston, that Resolution 70-20 be approved. The motion carried by the following
vote:
