AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, ~4ENDING CHAPTER 13 "ELECTRI-
CITY'' BY AMENDING SUBSECTION 13-4(g) "ADOPTION OF
NATIONAL ELECTRICAL CODE"; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING
A SAVING CLAUSE; PROVIDING A PENALTY CLAUSE.
WHEREAS, the City Administration has recommended the correcting and
updating of the National Electric Code for the City of Delray Beach; and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
concurs in said recommendation,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the Code of Ordinances of Delray Beach, Florida,
as amended, be further amended by amending Subsection 13-4(g) of Chapter
13 "ElectricitY" to read as follows:
Sec. ~3-4 (g) Adoption of National Electrical Code
Except as in this chapter otherwise provided, all electrical
construction and all material and appliances used in connection
with electrical work and the operation of all electrical apparatus
within the City shall conform to the rules and regulations of the
National Electrical Code ~ 1975 Edition, as recommended and
published by the National Fire'~r~tection Association for the
installation of wiring and electrical apparatus for electrical
purposes, of which copies are on file in the office of the city
clerk, which rules and regulations are h~reby adopted and approved
and made a part of this chapter as fully as if set out in length
here~n; provided that the rules and regulations of the National
Electrical Code are not in any respect in conflict with the pro-
visions of this chapter, this code, the laws of the State or
subsequent ordinances and resolutions of the citY.
Section 2. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
Section 3. That should any section or provision of this ordinance
or any portion thereof, any paragrapk, sentence or word be declared by a
court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 4. That any person who violates the provisions of Section
1 above shall upon conviction be punished as provided in Section 1-6 of
the Code of Ordinances of the City of Delray Beach.
