AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29
"ZONING" OF THE CITY'S CODE OF ORDINANCES BY
AMENDING SUBSECTION 29-6.3 BY ADDING LIBRARIES
AS USES PERMITTED; PROVIDING FOR THE USE OF
WALLS AND FENCES AND PARKING SPACES FOR LIBRARIES.
WHEREAS, the Planning and Zoning Board has recommended adding
libraries as uses permitted and providing for the use of walls and
fences and parking spaces for libraries; and,
WHEREAS, the City Administration concurs in said recommenda-
tion; and,
WHEREAS, the City Council of the City of Delray Beach,
Florida, has determined that such changes should be made,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Sec. 29-6.3 (B) of the Code of Ordinances,
as amended, of the City be further amended by adding the following
subparagraph under (B) Uses Permitted:
(23) Libraries
Section 2. That Sec. 29-6.3 (G)(3) of the Code of Ordinances
of the City be amended by adding the following subparagraph under (G)
Minimum Off-Street Parking Requirements:
(d) Libraries shall provide one (1) space for every
six (6) seats plus one (1) space for every three
(3) employees.
Section 3. That Sec. 29-6.3 of the Code of Ordinances of the
City be amended by adding the following subsection:
(K) Walls and Fences
(1) No wall, fence or similar structure shall be
maintained at any corner street intersection,
at elevations the City Engineer determines
will obstruct visibility.
(2) Walls, fences or similar structures shall not
contain any substance such as broken glass,
spikes, or nails. No electrically charged
fence shall be erected on any lot or parcel
of land in this zoning district.
(3) All areas devoted to the storage of equipment
or supplies shall be adequately screened with
landscaping pursuant to the criteria stated in
Chapter !5C of this Code, and shall further be
enclosed by a fence or wall at least six (6)
feet in height, but not to exceed twelve (12)
feet in height. No outdoor storage of equip-
ment or supplies shall exceed the height of
the enclosing wall, fence, or building, which-
ever provides the best visual obstruction from
a public right-of-way.
Section 4. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 5. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence or word be
eclared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole or part thereof other than the part declared to be invalid.
