41-74 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REZONING AND PLACING APPROXIMATELY TWO AND ONE-HALF ACRES OF LAND LOCATED IN THE NORTHWEST QUARTER (NW%) OF SECTION 29, TOWNSHIP 46 SOUTH, RANGE 43 EAST, BEING AN IRREGULAR PARCEL OF LAND LYING ON THE SOUTH SIDE OF S.W. 12TH STREET BETWEEN VEERY CIRCLE AND LINDELL BOULEVARD IN "RM-15 MULTIPLE FAMILY DWELLING DISTRICT", AND AMENDING "ZONING MAP OF DELRAY BEACH, FLORIDA, 1972". WHEREAS, the Planning and Zoning Board at a meeting held July 23, 1974, recommended denial of a proposed plan submitted by the applicants, Boca Raton Yacht & Tennis Club, Inc., because of density, too much commercially zoned land, a burden on city utilities and violation of the future land use plan; and, WHEREAS, City Council at a workshop meeting held on August 5, 1974, at which the applicants and members of the Planning and Zoning Board were present, reviewed the plan; and, WHEREAS, the applicants consented to revision of their plan to have the 59 acres remain zoned R-1AA and to have 10 acres annexed in R-1AA zone; and, WHEREAS, as a result, City Council found that density was not a problem, that the city's utilities would not be overburdened and that the plan as amended was consistent with the future land use plan; and, WHEREAS, the applicant as~part of the plan has requested a rezoning of 2.6289 acres from SC Specialized Commercial District to RM-15 Multiple Family Dwelling District, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: SECTION 1. That the following described property in the City of Delray Beach, Florida, is hereby rezoned and placed in the "RM-15 Multiple Family Dwelling District" as defined by Chapter 29 of the Code of Ordinances of the City of Delray Beach, Florida, to-wit: A certain parcel of land lying in the Northwest Quarter of Section 29, Township 46 South, Range 43 East, Palm Beach County, Florida, being more particularly described by the following numbered courses: BEGIN at a point in the centerline of Lindell Boulevard and 400.78 feet Southeasterly from the intersection of Germantown Road as measured along said centerline and as shown on the Plat of Tropic Palms, Plat Number 4, as recorded in Plat Book 25, pages 140 and 141, Public Records of Palm Beach County, Florida, thence ... 1. South 43014'25'' East 339.63 feet along said centerline; thence ... 2. South 43o10'45'' East 407.49 feet along said centerline to the intersection of the center- line of Veery Circle as shown on same said Plat Number 4 of Tropic Palms, thence ... 3. North 46o49'15'' East 263.27 feet along the centerline of Veery Circle to the beginning of a curve concave to the Northwest, having a central angle of 46°49'10'', a radius of 164.00 feet and whose local radial line bears North 43o10'45" 'West, thence ... 4. Northerly, along the arc of said curve, just described, 134.01 feet to the end of said curve, thence ... 5. North 00000'05'' East, 38.12 feet, thence ... 6. South 87°37'05'' West, 225.66 feet to the be- ginning of a curve concave to the Northeast, having a central angle of 49°08'30", and a radius of 688.00 feet, thence ... 7. Westerly along the arc of said curve just des- cribed 590.09 feet to the end of said curve and the POINT OF BEGINNING. Subject to existing rights-of-way and/or easements of Public Record, if any. That the Planning'Director of said City shall upon the effective date of this Ordinance change the Zoning Map of Delray Beach, Florida, to conform with the provisions of Section 1 hereof.
