62-74 ORDINANCE NO. 62-74 AN ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING SECTION 9-1 AND 9-1.2 OF CHAPTER 9 "BUILDING CODE" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY ADOPTING THE 1973 EDITION AND 1974 REVISION THERETO OF THE 'SOUTHERN STANDARD BUILDING CODE; ESTABLISHING FEES; READOPTING AMENDMENTS THERETO; PROVIDING AN EFFECTIVE DATE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVING CLAUSE; PROVIDING A PENALTY CLAUSE. WHEREAS, the Contractors Board of Examiners, a committee of local architects and the Chief Building Official have reviewed the Southern Standard Building Code and recommended that the 1974 revision and 1973 edition be adopted with amendments thereto; and, WHEREAS, the City Administration concurs with the recom- mendations of the Contractors Board of Examiners, a committee of local architects and the Chief Building Official; and, WHEREAS, the City Council of the City of Delray Beach deems it to be in the best interests of the citizens of Delray Beach to make the changes recommended; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 9-1, Chapter 9 "Building Code" of the Code of Ordinances, as amended, be further amended to read as follows (complete rewording of Section 9-1): Section 9-1. Southern Standard Building Code adopted by reference as amended by the Delray Beach Supplement. The 1974 Revision to the 1973 Edition and the 1973 Edition of the Southern Standard Building Code as compiled by the Southern Building Code Congress, of which not less than three (3) copies have been and are now filed in the office of the City Clerk of the City of Delray Beach, Florida, is hereby adopted and incorporated as fully as if set forth at length herein, except as amended in Section 9-1.2 ofthis chapter, and from the date from which this ordinance shall take effect, the provisions therein, as amended, shall be controlling in the con- struction, alteration, repair, equipment, use and occupancy, location, maintenance, removal and demolition, of every building or structure or any appurtenances connected or attached to such buildings and structures within the area of jurisdiction of the City of Delray Beach, Florida. Section 2. That Section 9-1.2 of Chapter 9 "Building Code" of the Code of Ordinances, as amended, be further amended to read as follows: Section 9-1.2. (a) Amendments and Additions to ~6~ 1973 Edition of the Southern Standard Building Code including the ~$~ 19.74 revisions. (b) That the following amendments and additions in Section 9-1.2 shall remain in full' force and effect as to the 1973 Edition and 1974 Revision thereto of the Southern Standard Building Code: SECTION 105.3. SECTION 1203.2. ROOF LIVE LOAD. SECTION 1302.3. FOOTING DESIGN. SECTION 1405.0. HOLLOW UNITS. SECTION 1406.1. ROOF OUTLETS. SECTION 1409.2. CHASES AND SLEEVES. SECTION 1702.0. GENERAL. SECTION 1707.0. ROOF FRAMING AND SHEATHING. SECTION 1707.7. ACCESS TO ATTIC SPACE. SECTION 2201.3. MOVEABLE AWNINGS (METAL OR CANVAS) (c) That Appendix "M", "RECOMMENDED SiCHEDULE OF PERMIT FEES" of the 1974 Revision to the 1973 Edition of the Southern Standard Building Code be amended as follows, and become a part of Section 9-1.2 of the Code of Ordinances and is hereby adopted as the fees for the City of Delray Beach, Florida: - 2 - Ord. No. 62-74 APPENDIX "M" ~ECOMME~ED SC~R~ OF PERMIT FEES (1973 Meeting) (a) Permit Fees Schedule Total Valuation Fee $100.00 and less No fee, unless inspection required, in which case a $5.00 fee for each inspection shall be charged. $101.00 to $2,000.00 $5.00 per thousand or fraction thereof $2,001.00 to $15,000.00 $10.00 for the first $2,000.00 plus $3.00 for each additional thousand or fraction thereof, to and including $15,000.00. $15,001.00 to $50,000.00 $49.00 for the first $15,000.00 plus $2.50 for each additional thousand or fraction thereof, to and including $50,000.00. $50,001.00 to $100,000.00 $136.50 for the first $50,000.00 plus $2.00 for each additional thousand or fraction thereof, to and including $100,000.00. $100,001.00 to $500,000.00 $236.50 for the first $100,000.00 plus $1.25 for each additional thousand or fraction thereof, to and including $500,000.00. $500,001.00 and up $736.50 for the first $500,000.00 plus $.75 for each additional thousand or fraction thereof. (b) Moving of Building or Structures For the moving of any building or structure, the fee shall be ~07~0 ~125.00. (c) Demolition of Building or Structures For the demolition of any building or structure, the fee shall be $25.00. (d) Where work for which a permit is required by this Code is started or proceeded with prior to obtaining said permit, the fees herein specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this Code in the execution of the work nor from any other penalties prescribed herein. - 3 - Ord. No. 62-74 (e) Plan-Checking Fees When the valuation of the proposed construction exceeds $1,000.00 and a plan is required to be submitted by Section 105.3, a plan-checking fee shall be paid to the Building Official at the time of submitting plans and specifications for checking. Said plan- checking fee shall be equal to one-half of the building permit fee as set forth in Section 107.4. The first plan-checkinq fee shall be credited to the cost of the permit at time of issue. (f) Certificate of Occupancy (1) For the issuance of a certificate of occupancy, the fee shall be $10.00. (2) For the issuance of a temporary certificate of occupancy, the fee shall be $5.00.. Section 3. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 4. That any person, firm or corporation violating any of the provisions of Section 1 above, shall upon conviction, be punished as provided in Section 1-6 of the Code of Ordinances of the City of Delray Beach. Section 5. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence or word be de- clared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 6. This ordinance shall take effect immediatley upon passage. PASSED AND ADOPTED in regular session on second and final reading on this the 25th day of November , 1974.
