13-73 ORDINANCE NO. 13-73. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REPEALING CHAPTER 3A "AIR CONDITIONING & REFRIGERATION" AND ADOPTING BY REFERENCE THE SOUTHERN STANDARD MECHANICAL CODE (1973 EDITION), AS AMENDED, ESTABLISHING FEES TO BE CODIFIED IN CHAPTER 9 "BUILDING CODE" OF THE CODE OF ORDINANCES OF THECITY OF DELRAY BEACH, FLORIDA, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVING CLAUSE, PROVIDING A PENALTY CLAUSE. WHEREAS, the Informal Air Conditioning Board has recommended the adoption of the Southern Standard Mechanical Code, 1973 Edition, with a different fee schedule and the repeal of Chapter 3A "Air Conditioning & Refrigeration", and WHEREAS, the City Administration has approved such recommendation and has on file in the office of the City Clerk three copies of the Southern Standard Mechanical Code, 1973 ~ Edition, and WHEREAS, the City Council of Delray Beach, Florida has determined that such changes be made, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 3A "Air Conditioning & Refrigeration", as amended, of the Code of Ordinances of the City of Delray Beach, Florida is hereby repealed. Section 2. That Chapter 9 "Building Code", as amended, of the Code of Ordinances of the City of Delray Beach, Florida, is hereby further amended by adding the following section: Southern Standard Mechanical Code adopted by reference (a) The 1973 edition of the Southern Standard Mechanical Code is hereby adopted as the Mechanical Code for the City of Delray Beach except for Section 106.3 - Schedule of Permit Fees. (b) The schedule of fees to be changed under the Southern Standard Mechanical Code is as follows: (1) Issuing each permit $5.00. (2) Fees shall be $5.00 for each $1,000 of valuation or portion thereof of the work to be done new, repairs or alterations. (3) Fees for all inspections and reinspections shall be $8.00. Sec%ion 3. Thai any person who violates the provisions of Section 2 above shall upon conviclion be punished as provided in Sec. 1-6 of the Code of Ordinances of Delray Beach. Section 4. Thai all ordinances or parts of ordinances in conflicl herewith be and the same are hereby repealed. Section 5. Thai should any section or provision of this ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 6. Specific authority is hereby granted to codify this ordinance. PASSED AND ADOPTED in regular session on the second and final reading on the 25th day of June , 1973.
