Dear Sir:
The proposed use of the property as reflected in part by floor plans which the City has
reviewed, reflecting a total of 404 distinct dwelling units with individual kitchens in each
and having unit sizes consisting of minimum square footages of 400 for Type A and 600
for Type B units, is permitted as a legally nonconforming use. There are no additional
land use regulation hearings or approvals to obtain the zoning classifications or density
described herein. There are no known zoning conditions which would preclude
construction or rehabilitation of the referenced development containing 404 units.
As Planning and Zoning Director for the City of Delray Beach, I am charged with
administering the zoning and use provisions of the Land Development Regulations, and
the application of those regulations to this property. Based upon the information
provided, I find that the intended use is permitted as a "legally non-conforming use."

Dear Marie,
Last week City Manager David Harden and I met with the contractor and architects
involved in the renovations of the Lake Delray Apartments. The proposed plans
indicate that the units in question are to be reconfigured so that the one bedroom
apartments will be 605 sq. ft. in size, and the efficiencies will be 467 sq. ft. The units
will therefore exceed our minimum square footage requirements of 600 and 400 sq. ft.
respectively.
As Mr. Harden wrote in his letter to you of December 1, 1998, we have already agreed
that the number of units can be grandfathered in. With the resolution of the unit sizes
as described above, we can approve the proposed renovations to the buildings,
including the installation of kitchen facilities in the units that currently have none.
If you need additional information or further clarification of this matter, please let me
know.

Dear Mrs.Horenburger:
Thank you for the detailed floor plans showing the existing and proposed layouts for
the units at Lake Delray Apartments which are proposed to be divided into two units.
After reviewing our code requirements and discussing them with both the City
Attorney and our Planning and Zoning Director, we have agreed that the increased
number of units could be grandfathered in. Although these units are technically one
unit, in reality they are functioning as two separate units. However, we find no basis
for grandfathering in the type B unit with less than 600 square feet. The type A unit
would qualify as an efficiency with a minimum floor space requirement of 400 square
feet. The proposed construction, however, would eliminate access from the type B
unit to the existing kitchen facilities, thereby decreasing the floor space available to
the unit to less than 600 square feet.
It appears to me that there are three alternatives available:
1. The floor plan could be reconfigured so that the type A unit would be
smaller but exceed 400 square feet in area, while the type B unit would
be at least 600 square feet in area.
2. Your clients could request a variance from the Board of Adjustment for
the type B unit they are proposing with less than 600 feet of floor space.

3. Your clients could request that the City amend our Land Development
Regulations in some manner to allow for the minimum unit size to be
reduced for this project.

The attached are the original , and proposed future, floor plans
for the project known as Lake Delray Apartments . Delray Elderly
Corporation ' s proposal to rehabilitate this project hinges on
being able to continue the use of under 100 of the 300 units
as two units making approximately 400 units . As you know the
400 units have been in existence for nearly 20 years with under
200 of them having a shared kitchen (each unit has it' s own
refrigerator. In order to make this project work there need to
be kitchen facilities in each unit. This is due to a change in
the federal regulations governing Section 8. The project as it
exists cannot continue to operate as it has under these new
regulations , and will only deteriorate without the infusion of
public funds .
The Palm Beach County Housing Finance Authority (HFA) ranked the
project #1 in a very competitive process . Since the project is
an existing, quality project in family neighborhood, and has been
home for iit ' s senior residents for some time, it was given a
priority status. Well aware of the federal regulations, others
in competition for the HFA approval could challenge the HFA on
the matter of the approvals for the kitchen facilities , and if
successful , Delray Beach could loose the opportunity to have
this project rehabilitated so that it would continue to be a
quality senior project. As you know, elevators must be replaced ,
and other improvements with considerable price tags must be made
to keep this a viable project.
The HFA held a required Tefra Hearing in late October. The Board
of County Commissioners now must approve the results of that
hearing . The HFA' s Attorney has the issue scheduled for the
December 1st board meeting, one week from today. On November 30,
next Monday, the HFA will receive Status Reports from the ranked
projects . It is possible that Delray Elderly Corporation/Lake

Delray Apartments will be challenged at that hearing by
representatives of other projects , possibly putting this
project at risk .
The issue of "Grandfathering" this project was raised at the
meeting you and your staff held some weeks ago. I share your
concern that this project and the direction we are petitioning
for be brought to the attention of the City Commissioners .
Having explored the possibilities of solving the problems of
this project relating to the addition of kitchen facilities ,
it would appear that "Grandfathering" would be the optimum
way to resolve the issue. Having met with the Mayor and one
Commissioner as• of this writing, they are interested in having
the information contained herein and the attachments.
As time is of the essence, I would appreciate any assistance
you can be to aid us in keeping this project moving forward .
If this needs to be agendaed, we would appreciate that being
done as soon as possible. If it does not require Commission
approval , I will make myself available to you for meetings with
Commissioners on an individual basis .
