32-72 ORDINANCE NO. 32- 72. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH A PORTION OF LOT 20, BLOCK 1, DELRA¥ SHORES SUBDIVISION, WHICH LAND IS CONTIGUOUS TO EXISTING MUNICIPAL LIMITS OF SAID CITY; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID LAND; AND PROVIDING FOR THE ZONING THEREOF. WHEREAS, the City of Delray Beach, a Municipal corpora- tion of the State of Florida, is the fee simple owner of the property hereinafter described; and, WHEREAS, the City of Delray Beach has heretofore been authorized to annex lands, in accordance with Section 185.1 of the City Charter of said City granted to it by the State of Florida; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: SECTION 1. That the City Council of the City of Delray Beach, Palm Beach County, Florida, hereby annexes to said City the following described tract of land located in Palm Beach County, Florida, which lies contiguous to said City, to-wit: A portion of the Southeast Ten Acres of Lot 20, Block 1, of Delray Shores, according to the plat recorded Plat Book 24, Page 232, of the Public Records of Palm Beach County, Florida, said portion being more particularly described as follows: From the Northeast corner of said Lot 20, Block 1, which point is the intersection of the Northwesterly right-of-way line of the S.A.L. Railroad, with the Southwesterly right-of-way line of Lake Ida Road; run thence Southwesterly along the said right-of-way line of the S.A.L. Railroad a distance of 861.01 feet to the Southeast corner of said Lot 20, which point is on the North right-of-way line of L.W.D.D. Lateral Canal No. 32; thence run Westerly on said North right-of-way line a distance of 240.49 feet; thence run Northerly, parallel to the said North- westerly right-of-way line of the S.A.L. Railroad, a distance of 972.99 feet, to a point in said South- westerly right-of-way line of Lake Ida Road; thence run Southeasterly along said right-of-way line of Lake Ida Road a distance of 234.10 feet to the point of beginning. SECTION 2. That the boundaries of the City of Delray Beach, Florida, are hereby redefined so as to include therein the ~bove described tract of land, and said land is hereby declared to be within the corporate limits of the City of Delray Beach, Florida. SECTION 3. That the tract of land hereinbefore described is hereby declared to be in Zoning District C-3, as defined by existing ordinances of the City of Delray Beach, Florida, with the stipulation that it be rezoned LI upon establishment of this new zoning district. SECTION 4. That the land hereinbefore described shall immediately become subject to all of the franchises, privileges, immunities, debts, obligations, liabilities, ordinances and laws to which lands in the City of Delray Beach are now or may be, and persons residing thereon shall be deemed citizens of the City of the City of Delray Beach. SECTION 5. That if any word, phrase, clause, sentence or part of this Ordinance shall be declared illegal by a Court of competent jurisdiction, such record of illegality shall in no way affect the remaining portion.
