right-of-way. As can be seen on the sketch, there exists a strip
of City owned right-of-way varying in width from approximately
10. 4 feet to 11. 2 feet between the existing back of sidewalk and
the west line of Lot 8 .

SUBJECT: MICHAEL LISTICK PROPERTY
DATE : October 14 , 1991
Mr. Listick was cited to mow a parcel of land including
right-of-way areas that he owns between Andrews and A-1-A.
After receiving our Violation Notice, Mr. Listick wrote a
letter to me, accompanied by a right-of-way deed dated April
19, 1948, in which he claimed he was not responsible for the
right-of-way area. I have attached both the aforementioned
letter and deed.
Would you please review this matter and let me have your
opinion in order that I can respond to Mr. Listick.
I have also attached a copy of the plat book page showing
Mr. Listick' s property (shaded in blue) .

Dear Mr. Bauer:
I received your notice dated 7/11/91. It is my understanding that
the 25-foot strip west 'of Andrews Avenue was deeded to Palm Beach
County and is now owned by the City. Thus, the foliage which you
want trimmed is not on my land. The sidewalk is not on my land.
I do not believe it is legal for the City to require me to enter
upon other people ' s property to mow and trim their foliage which
creeps onto the City ' s sidewalk. I enclose a copy of the deed for
the 25-foot strip as recorded in Deed Book 844 , page 272 .
I do not believe that the ordinance which the City passed five
years ago is valid as to my property. I believe mine is an
exception to the genera'ltrule. I do not want to make a mountain
out of a molehill , but Bob' s Mowing wants $200. 00 per year to trim,
the area twice a year, and I have better things to do with my money
than to trim the City ' s sidewalks. I wish to cooperate with the
City; thus, please do not think that I am angry, upset or hostile.
I would appreciate your considering these matters before you
attempt to charge me for the mo%-ding of that area.

Gentlemen:
I am writing this letter as a 'petition of objection in the above
matter. If you want a hearing you may set one up; however, I
really do not believe this is an issue that requires a hearing.
Rather it is a question of whether the City can force me to trim
City property. In the past I called your department and stated
that, since the previous property owner had deeded the right-of-
way to the government and since I have not planted sod or
landscaping on the right-of-way and do not use it at this point
(since my land is vacant) , I do not believe I have to trim the
right-of-way.
Several months ago I called to discuss it and was told to write a
letter. I wrote a letter dated July 15, 1991 (copy enclosed) and
I never received the courtesy of a reply. Without replying to my
phone call or to my letter, you now sent me the Notice.
I suggest that you contact the City Attorney or the State Attorney
General and get their opinion. I believe they will tell you that
you shouldn ' t make me do it since we constitutionally outlawed
slavery.
You can be assured that if I ever construct a house on the property
and sod the right-of-way, then I will trim it; however, just
because the City recently built a sidewalk on the right-of-way does
not create an obligation upon me to trim the City right-of-way or
sidewalk. If you wish to trim the landscaping yourself on the
right-of-way, I will be happy to mow it when I mow the rest of the
property.
