Mr. Tefft presented the item to the Board and entered a copy of the project file into the record. The property contains a two story Masonry Vernacular commercial building constructed in 1950. The first floor contains 2,580 square feet of restaurant floor area, while the second floor consists of a 346 square foot efficiency apartment. The applicant is before the Board for consideration of a Class III site plan modification for the conversion of the 346 square foot second floor efficiency apartment to office/storage space for the first floor restaurant. Historic Preservation Board Meeting September 1, 2004 ;< The previous conversion in August 2003 the unit was assessed with one and one- half parking spaces. The proposed conversion would only require one additional parking space. The Parking Management Advisory Board recommended approval on August 12, 2004, and it will go to City Commission next week. The Community Redevelopment Agency recommended approval on August 12, 2004. The Downtown Development Authority also recommended approval on August 12, 2004. The development proposal is consistent with the FLUM and zoning designations of the subject property and positive findings can be made with regard to Concurrency and Comprehensive Plan consistency. The specific findings required by LDR Section 2.4.5(G) (5) can also be made; however, it is noted that compliance with the LDR can only be achieved subject to the in-lieu parking fee being approved by the City Commission and the attached conditions of approval being addressed. Mr. Tefft stated that condition number 2., as listed in the staff report, should be eliminated as the information has been provided. Vice Chairman Silberstein asked if there was anyone from the public who wished to address the Board. There were none. Mr. Perez, Architect, for the project advised that when it was an apartment the parking situation was fine. We went through the permitting and building process, however, the Fire Department did not let us do abandonment due to the different fire ratings between an apartment and restaurant. The frame coloring will be distressed antique blue, the posts and sign body will be a distressed antique white; and the copy will be blue and burnt orange. The sign will be located at the northwest corner of the building and oriented so it is visible to both eastbound and westbound traffic on Atlantic Avenue. The sign will project approximately 36: from the building façade and will be approximately 62 feet in total height. The sign will not interfere with any landscaping or sight visibility. Staff is recommending approval of the COA request for the sign. Mr. Claudio Camilucci was present to answer any questions. Staff Mr. Tefft advised the City is looking to establish two new Historic Districts, the Northwest Swinton Historic District and the Dell Park Historic District. The Historic Preservation Board will be conducting a public hearing on that on October 6t. This meeting was originally scheduled for September 15, however, the Board elected to change it to October 6. We wanted to get the Designation Report to you now so that you could familiarize yourself with them prior to the public hearing. 3 Historic Preservation Board Meeting September 1, 2004 Chairman Perez advised it is very important to familiarize yourself with the data. One is the survey that shows what properties are contributing, and that was basically the driving force to create this Historic District. Individuals in the Historic District have to go through a process in order to put on an addition, change the exterior color of the home, change windows, doors, etc. The intent of the process is to maintain the scale and character of the neighborhoods. This protects the integrity of the neighborhood. Mr. Tefft advised the Dell Park meeting was scheduled for September 13, 2004 at 7:30 p.m. in the Ocean Breeze Room at Old School Square and invited all to attend. V. ITEM BEFORE THE.BOARD The action before the Board is approval of a Certificate of Appropriateness (COA), which incorporates a Class Ill site plan modification for 8 East Atlantic Avenue (Mano-A-Mano), pursuant to Land Development Regulations (LDR) Section 2.4.5(G) (1) (c). BACKGROUND'/ PROJECT DESCRIPTION. The 0.22 acre subject property is described as the west 26' of Lot 4 (Less the south 14') and Lot 5, Block 69. The property, which is located on the south side of East Atlantic Avenue, between South Swinton Avenue and SE 1st Avenue, is considered a contributing property within the Old School Square Historic District. The property contains a two-story Masonry Vernacular commercial building constructed in 1950. The first floor contains 2,580 square feet of restaurant floor area, while the second floor consists of a 346 square foot efficiency apartment. At its meeting of August 6, 2003, the Historic Preservation Board (HPB) reviewed and approved a Class Ill site plan modification to convert the aforementioned first floor from retail to restaurant (while retaining the second floor efficiency apartment). On January 7, 2004, the HPB reviewed and approved a COA and associated Class I site plan modification for architectural elevation changes that included the installation of bi-fold doors and new entrance doors on the front facade and the removal of proposed / approved windows on the west elevation. On February 4, 2004, the HPB reviewed a COA and Class I site plan modification for the installation of a hand-painted tile facade on the front of the building. The Board tabled the item until the applicant could provide a true color sample of the tile. The applicant returned to the Board on March 3, 2004 and presented a tile sample and colored elevations. The Board approved the proposal as proposed in addition to an exterior color change and change of awning color from black to blue to match the new exterior color. The aforementioned conversion and architectural elevation changes have been completed and the restaurant is currently operating. The applicant is now before the Board for consideration of a Class Ill site plan modification for the conversion of the 346 square foot second floor efficiency apartment to office I storage space for the first floor restaurant. SITE PLAN MODIFICATION ANALYSIS COMPLIANCE WITH THE LAND DEVELOPMENT REGULATIONS: Items identified in the Land Development Regulations shall specifically be addressed by the body taking final action on the site and development application/request. Off-Street Parking: Pursuant to LDR Section 4.4.24(F) (1) (c), the subject property, although located within the OSSHAD zoning district, is subject to the standards of the CBD zoning district; therefore pursuant to LDR Section 4.4.13(G) (1) (d), the parking requirement for restaurants is six (6) spaces per 1,000 square feet of gross floor area. With the conversion of the first floor from retail to restaurant on August 6, 2003, the 346 square foot second floor efficiency apartment was assessed its required parking (1.5 spaces). Historic Preservation Board Staff Report 3 East Atlantic Avenue (Mano-A-Mano)—Class Ill Site Plan Modification ' Page 2 of 4 Therefore, the proposed conversion of the 346 square foot efficiency apartment to restaurant requires one (1) additional parking space [346/ 1,000 = 0.346 x 6 = 2.076— 1.5 = 0.576]. Pursuant to LDR Section 4.4.24(G) (5), if it is impossible or inappropriate to provide required parking on-site or off-site, the parking requirement may be met by providing an in-lieu of parking fee of $6,000 per space [Ref: LDR Section 4.6.9(E) (3) (b) (3) — Area 3: Parcels located within the OSSHAD zoning district and parcels located within the Pineapple Grove Main Street area which are zoned CBD or Central Business District-Railroad Corridor (CBD-RC)]. Due to site constraints the in-lieu of parking fee option has been proposed for the one (1) required parking space ($6,000). The Parking Management Advisory Board (PMAB) reviewed the in-lieu of parking fee request at their meeting of August 24, 2004. The Board recommended the approval of the in-lieu of parking fee request. The approval of the in-lieu of parking fee by the City Commission is attached as a condition of approval. REQUIRED,FINDINGS ;` Pursuant to LDR Section 2.4.5(G) (1) (c), a modification to a site plan which represents either a change in intensity of use, or which affects the spatial relationship among improvements on the land, requires partial review of Performance Standards found in LDR Sections 3.1.1, and 3.2.3, as well as required findings of LDR Section 2.4.5(G) (5). LDR Section 2.4.5(G) (5): Pursuant to LDR Section 2.4.5(G) (5), a finding that the proposed changes do not significantly affect the originally approved plan must be made concurrent with approval of a Class Ill modification. Positive findings with respect to Future Land Use Map and Comprehensive Plan Consistency, Concurrency, and Compliance with the Land Development Regulations were made with the site plan approval on August 6, 2003. The current development proposal involves the conversion of a 346 square foot efficiency apartment to office / storage associated with the existing first floor restaurant. Pursuant to LDR Section 2.4.5(G) (5), this minor modification does not significantly impact the previous findings. However, the applicable Concurrency items as they relate to this development proposal are discussed below. LDR Section 3.1.1(B) -Concurrency: Pursuant to LDR Section 3.1.1(B), Concurrency as defined pursuant to Objective B-2 of the Land Use Element of the Comprehensive Plan must be met and a determination made that the public facility needs of the requested land use and/or development application will not exceed the ability of the City to fund and provide, or to require the provision of, needed capital improvements. The proposed improvements will not have an impact on Water and Sewer demands, Drainage, Parks and Recreation, or Schools. However, concurrency findings as they relate to Streets and Traffic and Solid Waste are discussed below. Streets and Traffic: The subject property is located within the City's Transportation Concurrency Exception Area (TCEA) designation area, which encompasses the CBD, CBD-RC, OSSHAD, and West Atlantic Avenue Business Corridor. The TCEA exempts the above described areas from complying with the Palm Beach County Traffic Performance Standards Ordinance. The conversion of the 346 Historic Preservation Board Staff Report 8 East Atlantic Avenue (Mano-A-Mano)—Class Ill Site Plan Modification , Page 3 of 4 square foot efficiency apartment to restaurant floor area will generate 0.24 A.M. Peak Hour Trips and 2.2 P.M. Peak Hour Trips. Solid Waste: The proposed conversion of the 346 square foot efficiency apartment to restaurant will generate an additional 3.5 tons of solid waste per year above the existing efficiency apartment [346 square feet x 24.9 = 8,615.4 lbs / 2,000 = 4.3 tons — 0.8 tons (single apartment) = 3.5 tons]. The Solid Waste Authority indicates in its annual report that the established level of service standards for solid waste will be met for all developments until 2021. REVIEW BY OTHERS Community Redevelopment Agency (CRA): At its meeting of August 12, 2004, the CRA reviewed and recommended approval of the development proposal. Downtown Development Authority(DDA): At its meeting of August 13, 2004, the DDA reviewed and recommended approval of the development proposal. Parking Management Advisory Board (PMAB): The Parking Management Advisory Board (PMAB) reviewed the in-lieu of parking fee request at their meeting of August 24, 2004. The Board recommended the approval of the in-lieu of parking fee request. BACKGROUND The 0.22 acre subject property is described as the west 26' of Lot 4 (Less the south 14') and Lot 5, Block 69, Town of Delray. The property, which is located on the south side of East Atlantic Avenue, between South Swinton Avenue and SE 1st Avenue, is considered a contributing property within the Old School Square Historic District. The contributing building presently contains a restaurant (converted from retail floor area) which received site plan modification approval on August 6, 2003 from the Historic Preservation Board (HPB). Minor modifications to the architectural elevations and color scheme were approved by the HPB at its meeting of January 7, 2004 and March 3, 2004. At its meeting of June 7, 2004, the HPB approved a decorative flat wall sign that is incorporated into the tile design over the entrance. The sign area is 19" high and 13' long (20.54 square feet). The copy reads, "Mano A Mano" in blue and "Tapas-Bar-Restaurant" in gold. The aforementioned conversion and architectural elevation changes have been completed and the restaurant is currently operating. The applicant has submitted to convert the second floor efficiency apartment to office / storage area associated with the restaurant (to be reviewed at HPB meeting of September 1, 2004). In association with this conversion, the applicant is requesting to install a projecting sign on the second floor elevation of the building and is now before the Board for action. PROJECT DESCRIPTION The applicant proposes the installation of a projecting sign on the second floor elevation of the subject building. The projecting sign will be 56" high and 32" long (12.39 square feet). The sign will be two- sided, non-illuminated, and oval shaped with foam letters affixed to the face. The frame coloring will be distressed antique blue; the posts and sign body will be a distressed antique white; and the copy will be blue and burnt orange. The copy will read, "Mano A Mano Tapas Bar and Restaurant." The sign will be located at the northwest corner of the building and oriented so as to visible to both eastbound and westbound traffic on Atlantic Avenue. Including the mounting post, the sign will project approximately 36" from the building façade and will be approximately 62" in total height. The base of the sign will be approximately eleven feet-nine inches (11'-9") above the sidewalk. The sign face measures 24" wide and 36" high. The sign will not interfere with any landscaping or sight visibility. No lighting exists or is proposed at this time. Meeting Date: September 1,2004 Agenda Item: III. B. Historic Preservation Board Memorandum Staff Report t 8 East Atlantic Avenue(Mano-A-Mano)—COA Associated with the Installation of a Projecting Sign Page 2 of 2 ANALYSIS The Board shall consider: SIGN REGULATIONS AND DESIGN GUIDELINES LDR Section 4.6.7(F) (1) (a) addresses "Sign Design Standards" for "Projecting Signs" and states: A sign affixed to a structure and which extends at a right angle from the building. A projecting sign shall not have more than two (2) sign faces. LDR Section 4.6.7(F) (4) (b) (2) addresses "Traffic Safety"and states: No sign shall be located in such a manner that it will become a hazard to automotive or pedestrian traffic, nor shall any sign or lighting be placed as to obstruct the vision of the driver or any motor vehicle where vision is necessary for safety. LDR Section 4.6.7(D) (2) (a)-(c) addresses "Aesthetic Qualifications"and states: The aesthetic quality of a building, or of an entire neighborhood, is materially affected by achieving visual harmony of the sign on or about a structure as it relates to the architecture or the building or the adjacent surroundings. In addition to the mechanical limitations on signs imposed in Subsections (G) and(K), the following aesthetic conditions must be met: (a) Garishness: The overall effect of the lettering, configuration or color of a sign shall not be garish. "Garish"signs are those that are too bright gaudy, showy, glaring, and/or cheaply brilliant or involving excessive ornamentation. Garish signs are not in harmony with and not compatible with the building or adjacent surroundings. (b) Scale and Conformity with Surroundings: The scale of the sign in terms of area, shall be consistent with the scale of the building on which it is to be placed or painted and the neighborhood or streetscape where it is to be located. Scale shall also be considered in terms of Subsection (F) (2) with respect to height and area. (c) Quality:All signs shall have a professional appearance that enhances the visual aesthetics of the area. Delray Beach Design Guidelines The Delray Beach Design Guidelines state the following pertaining to signage: Sign design and placement in an historic district or a historic site is an important element. While preservationists believe the building façade is the best sign an owner may have, the need for design guidelines refines the existing regulations adapting them to the particular character of the specific location and site. The district's character is maintained when signage does not cause visual disruption. The sign should not obscure any architectural feature or detail, or interface with the views and appreciation of the building. Signage should compliment and not overwhelm or compete with the architecture. The Secretary of the Interior's Standards for Rehabilitation No direct reference is made to signage affecting historic structures, sites, or districts; however, there is specific intent to project the importance of preserving "character-defining"and distinctive features, Historic Preservation Board Memorandum Staff Report 8 East Atlantic Avenue(Mano-A-Mano)—COA Associated with the Installation of a Projecting Sign Page 3 of 3 and discussing scale and compatibility with respect to new construction for historic structures and districts. One such standard states: New additions, exterior alterations, or related new construction shall not destroy historic materials that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity of the property and its environment. The proposed sign is appropriate in relation to style, dimensions, and design of the two-story contributing Masonry Vernacular commercial building and the surrounding neighborhood. Further, as the sign measures 56" in total height and measures 12.39 square feet in area, the sign meets the requirements of LDR Section 4.6.7(F) (7). Based upon the above, positive findings with respect to Sections 2.4.6(J), 4.6.7(F) (1) (a), (F) (4) (b) (2), (F) (7), and (D) (2) (a)-(c) of the Land Development Regulations, the Delray Beach Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. REVIEW BY OTHERS. At its meeting of May 21, 2004, the Delray Beach Sign Review Committee reviewed and recommended approval of the projecting sign (location, design and dimensions).
