PURPOSE
The purpose of this directive is to establish procedures for the implementation and administration of the FLSA
Exempt Employee Leave Days.These FLSA Days are in addition to days provided for through the City's
Personnel Policies and are granted to City personnel who are,as indicated on the City's Pay Plan,exempt
from receiving overtime pay for hours worked in excess of forty (40)hours per week.These positions meet
the exempt criteria of the guidelines for the implementation of the Fair Labor Standards Act (FLSA),as of the
Department of Labor Regulations dated May 11,2011.
POLICY
A.Guidelines for Utilization
Employees should take their designated FLSA Days within each fiscal year (October 1 through September 30).
Employees who,due to extenuating circumstances,are unable to use all of their FLSA Days may request to
rollover unused days to the next fiscal year.The request must come from the Department Head and be
approved by the Human Resources Director by September 30 of each year.
No more than one year's accrual may be carried forward each year.For example,an employee who receives
four FLSA days and is unable to use them and is approved to carry forward four days will have eight days in
their bank for that fiscal year.Should all the days not be used again,only four days may be carried over to the
next fiscal year.
Cash payout will not be permitted under any circumstances,including termination,resignation or retirement
from City employment.
The designated FLSA Days for each exempt position are contained within the annual Salary Plan.These FLSA
Days are not required to be used consecutively but may be used throughout the fiscal year as scheduling
permits,and upon the approval of the Department Head.Department Heads'use of FLSA days are approved
by the City Manager or his/her designee.
Any employee eligible for these FLSA Days must be in their current position for six (6)months,prior to usage
of these days.
Any promoted employee,who,due to their promotion,is eligible for additional FLSA Days must be in their
promoted position for six (6)months prior to using the additional days.

PROCEDURE
1.These additional FLSA Days are not to be confused with and are in addition to the annual vacation
and sick leave accruals provided in the City's Personnel Policies.
2.The utilization of vacation and/or sick leave accruals shall be consistent with the established
policies of the City.
3.The utilization of FLSA Days may be used in units of less than a full day and shall be reported
separately from normal usage of accrued sick leave and/or vacation.
4.At no time should any employee be allowed more than the amount of time allocated in the Exempt
FLSA designation contained within the annual Salary Plan.
5.FLSA Days may be used for sick leave only when an employee has a zero (0)balance in their
accumulated sick leave bank.
6.Each Department Head shall be responsible for the appropriate administration of this policy.
7.All Department Heads shall review this policy with all exempt employees within their department
and any question as to the utilization of this policy should be directed to the Human Resources
Department for assistance.
