29-70 ORDINANCE NO. 29-70. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING SECTION 29-7.5½, CHAPTER 29 OF THE CITY'S CODE OF ORDINANCES PERTAINING TO SITE PLAN APPROVAL REGULAT IONS, WHEREAS, the City Council of the City of Delray Beach, Florida, has determined that definite time limitations shall apply to all site plan approvals, and WHEREAS, site plan approval has been granted and building permits not taken out to which time limitations shall also apply. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, PLORIDA, AS FOLLOWS: Section 1. That paragraph (G) of Sec. 29-7.5½, Chapter 29 of the Code of Ordinances of the City be amended to read as follows: "(G) In granting any special exception, the city council may prescribe appropriate conditions and safeguards in conformity with the standards herein set out in conformity with the zoning ordinance. Violation of such conditions and safeguards when made a part of the terms under which the special exception is granted, shall be deemed a viola- tion of the zoning ordinance and punishable under section 29-7.10 of the zoning ordinance. In making a grant of special exception, the city council may prescribe a time limit within the action for which the special exception is granted shall be begun or completed, or both. Failure to begin or complete, or both, such action within the time limit shall void the special exception. Unless other provisions are approved under the first part of this subsection~ all site plan approvals will ex- pire one year from the date of approval unless a building permit has been issued and construction commenced as de- fined in the Southern Standard Building Code." Section 2. Section 29-7.5½ (G), Chapter 29, as amended above shall apply to all outstanding site plan approvals in the same manner as if the site plans were approved on effective date of this ordinance unless prior to the effective date of this ordinance, the holder of the site plan applies for additional time and council grants the ad- ditional time or a definite time limit has already been established by council. The Building Official shall notify, by certified mail, all parties having site plan approvals within one week of the passage on first reading of this ordinance of the proposed change and the date of the public hearing to be held in connection with passage of this ordinance.
