43-70 ORDINANCE NO. 43-70. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH CERTAIN LAND LOCATED IN SECTION 20, TOWNSHIP 46 SOUTH, RANGE 43 EAST, T~HICH LAND IS CONTIGUOUS TO EXISTING 5rdNICIPAL LIMITS OF SAID CITY, AND REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND. WHEREAS, the City of Delray Beach, A Municipal Corporation of the State of Florida, is the fee simple owner of the property here- inafter described, and WHEREAS, the City of Delray Beach has heretofore been author- ized to annex lands in accordance with Section 185.1 of the City Charter of said City granted to it by the State of Florida; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: SECTION 1. That the City Council of the City of Delray Beach, Palm Beach County, Florida, hereby annexes to said City the follow- ing described tract of land located in Palm Beach County, Florida, which lies contiguous to said City, to-wit: The East 150 feet of the West 499 feet of the South Half of Lot 8, except the South 53 feet right-of-way for S. W. 12th Street, according to the plat of Section 20, Township 46 South, Range 43 East, recorded in Plat Book 1, Page 4, Palm Beach County, Florida's Public Records. SECTION 2. That the boundaries of the City of Delray Beach, Florida, are hereby redefined so as to include therein the above described tract of land, and said land is hereby declared to be within the corporate limits of the City of Delray Beach, Florida. SECTION 3. That the land herein above described is hereby declared to be in Zoning District R-1AA as defined by existing ordinances of the City of Delray Beach, Florida. SECTION 4. That if any word, phrase, clause, sentence or part of this Ordinance shall be declared illegal by a court of competent jurisdiction, such record of illegality shall in no way affect the remaining portion. Please read my draft copy of the ordinance closely and critically, especially the City Attorney. If improvements can be thought of or omissions can be caught, then by all means we should make-those changes before the ordinance is adopted. If you like, please contact me after you have read the proposed ordinance if you think changes should be made in it. I am also making copies available to the taxicab companies for their suggestions and/or comments. ~he propos~ retains essentially the basic provisions contained in the City's present ordinance and provides, in addition, for a: 1. More exacting taxicab inspection procedure; 2. Maximum taxicab age of 4 years unless approved by Council; 3. Taxicab driver's permit based on qualifications and other requirements; 4. Daily records of calls made by each taxicab driver (to be made available to the City upon request); ~' 5.
