01-69 ORDINANCE NO. 1-69. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING ARTICLE I, CHAP- TER 19, CODE OF ORDINANCES OF THE CITY PERTAIN- TO EXCISE TAX ON PROPERTY INSURANCE PREMIUMS, AND APPROPRIATING THE MONIES DERIVED FROM SUCH TAX TO THE PENSION FUND OF THE FIRE DEPARTMENT OF THE CITY OF DELRAY BEACH, FLORIDA. NOW, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLL~S: Article I, Chapter 19, Code of Ordinances of this City, be, and the same is hereby amended to read as follows: "Article I. FIREMEN'S RELIEF AND PENSION FUND° Sec. 19-1. Tax levied against fire and tornado insurers. There is hereby assessed and imposed on every insurance company, corporation or other insurer now engaged in or car- rying on, or who shall hereafter engage in or carry on, the business of insuring property against loss or damage by fire or tornado, an excise or license tax amounting to two per- cent of the gross amount of receipts of premiums from policy holders on all premiums collected on fire and tornado insur- ance policies covering property within the corporate limits of the city. Sec. 19-2. Tax allotted to firemen's pension fund. All money derived from the taxes imposed by section 19-1 is hereby appropriated to the firemen's relief and pension fund of the city which shall be administered in accordance with the provisions of chapter 175.101, Florida Statutes, Acts of 1967 Session of the Florida Legislature providing for the administration of a firemen's relief and pension fund, in certain cities and to%~s. Sec. 19-3. Imposition of tax in addition to required licenses. The license tax herein assessed and imposed shall be in addition to all other license taxes now levied by the city. Sec. 19-~. Collection of tax. The excise or license tax herein provided for shall be payable and collected in the manner provided for by Chapter 175.101, Florida Statutes, Acts of 1967, providing for the administration of a firemen's relief and pension fund in certain cities and towns." This Ordinance amending Ordinance No. 325, dated September 25, 1939, shall become effective July 1, 1969, in conformance with Chap- ter 175.101, Laws of Florida, Acts of 1967. Saunders, Mayor City of Delray Beach Delray Beach, Florida Dear Mayor Saunders: The 1967 Session of the Florida Legislature amended Chap- ter 175o101, Florida Statutes, whereby the 1% excise tax on property insurance premiums levied by participating municipalities was increased to 2% with an effective date as of July l, 1969. Your city will need to amend Ordinance No. 325 , dated September 25, 1959by changing the tax from 1% t'$ 2% with an ef~ect'ive date of July l, 1969. As soon as you have made this change in the aforementioned ordinance, it will be necessary to forward a copy of the amending ordinance to this office, so that your city will be eligible for the additional tax monies beginning July l, 1969. We are, of course, happy that additional State monies will be made available to your city through the passage of this ordinance and want to assure you of our continued coopera- tion in all matters rela~ing to this Act.
