35-69 ORDINANCE NO. 35-69. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ESTABLISHING THE QUALIFICATIONS OF THE MUNICIPAL JUDGE AND CITY ATTORNEY; AMENDING SECTION 2- 20 CITY PROSECUTOR - QUALIFICATIONS FOR OFFICE AND A- MENDING SECTION 2-22 CITY PROSECUTOR - COMPENSATION OF PROSECUTOR, ASSISTANTS; SOURCE OF FUNDS IN THE CODE OF ORDINANCES AND PERTAINING TO THE QUALIFICATIONS FOR SAID OFFICES AND THE DETERMINATION OF COMPENSATION FOR THE CITY PROSECUTOR. WHEREAS, the City Council of the City of Delray Beach, Florida, has determined, as a result of the 1969 amendments to the Charter of the City of Delray Beach, to establish uniform qualifications for the offices of Municipal Judge, City Attorney and City Prosecutor, and WHEREAS, it is further determined that the compensation of the City Prosecutor and his assistants should be established in the same manner as the Municipal Judge, City Attorney and their assistants. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the following section be added to the Code of Ordinances. "Municipal Judge, Qualifications for Office. The Municipal Judge, in addition to his qualifications established by the charter, shall be a legal resident or have his principal office in Delray Beach at the time of his appointment and during his tenure of office." Section 2. That the following section be added to the Code of Ordinances. "City Attorney, Qualifications for Office. The City Attorney, in addition to his qualifications established by the charter, shall be a legal resident or have his principal office in Delray Beach at the time of his appointment and during his tenure of office." Section 3. That Section 2-20 of the Code of Ordinances of the City of Delray Beach is hereby amended to read as follows. "Sec. 2-20 Same - Qualifications for office. The City Prosecutor shall be a lawyer who is a member in good standing of the Florida Bar with at least two years' experience as a practicing attorney and shall be a legal resident or have his principal office in Delray Beach at the time of his appointment and during his ten- ure of office." Section 4. That Section 2-22 of the Code of Ordinances of the City of Delray Beach is hereby amended to read as follows. "Sec. 2-22 Same - Compensation of Prosecutor, assistants. Compensation to be paid the City Prosecutor and assist- ant prosecutors shall be fixed by resolution." PASSED and ADOPTED on second and final reading on this the 8th day of September , 1969. .
