AN ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA,
AMENDING CHAPTER 14A, GARBAGE, TRASH AND WEEDS, OF
THE C~)E OF ORDINANCES, SECTION 14A-1 DEFINITIONS,
BY ADDING SUBPARAGRAPH (i) DEFINING LITTER; AND BY
ADDING SECTION 14A-9 PROHIBITING THE THROWING OR
DEPOSITING OF LITTER; AND PROVIDING A PENALTY THERE-
FOR.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH,
FLORIDA, that Section 14A-1 of the Code of Ordinances of the City
of Delray Beach, Florida, is hereby amended by adding a subsection,
to be numbered (i), which said subsection reads as follows:
14A-1. Definitions.
(i) Litter. For the purpose of this Chapter, the
word "litter" shall mean garbage and trash as herein
defined and shall also mean all rubbish and wastes
such as paper, wrappings, cigarettes, cardboard, tin
cans, wood, glass, and similar materials.

of Delray Beach, Florida, is hereby amended by adding a section, to
be numbered 14A-9, which said section reads as follows:
14A-9. Litter:
(a) Litter in public places. No person shall throw
or deposit litter in or upon any street, sidewalk or
other public place within the City except in public
receptacles, in authorized private receptacles for
collection, or in the official City sanitary land
fill areas.
(b) Sweeping litter into gutters prohibited. No.
person shall sweep into or deposit in any gutter,
street, or other public place within the City the
accumulation of litter from any building or lot or
from any public or private sidewalk or driveway.
(c) Litter thrown by persons in vehicles. No
person, while a driver or passenger in a vehicle,
shall throw or deposit litter upon any street or
other public place within the City, or upon private
property.
(d) Litter in lakes and fountains. No person shall
throw or deposit litter in any fountain, pond, lake
bay or any other body of water in a park or elsewhere
within the City.
(e) Litter on occupied private property. No person
shall throw or deposit litter on any occupied private
property within the City, whether owned by such per-
son or not. except that the owner or person in con-
trol of private property may deposit such houeehold
trash or litter in designated areas of said private
property for collection as provided elsewhere in this
Code.

(f) Litter on vacant lots. No person shall throw or
deposit litter on any open or vacant private proper-
ty within the City whether owned by such person or
not.
(g) Truck loads causing litter. No person shall
drive or move any truck or other vehicle within the
City unless such vehicle is so constructed or loaded
as to prevent any load, contents or litter from being
blown or deposited upon any street, alley or other
public place.
(h) For the purpose of this section "person" is any
person, firm, partnership, association, corporation,
company or organization of any kind.
(i) Any person who violates the provisions of this
section, shall, upon conviction thereof, be punished
as provided in Section 1-6 of the Code of Ordinances
of the City of Delray Beach, Florida.
