02-67 ORDINANCE NO. 2-67. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING SUBSECTION (c) OF SECTION 15-25 AND SEC- TION 15-26, BOTH OF CHAPTER 15, PERTAIN- ING TO ABANDONED, WRECKED OR 0/]NKED VE- HICLES. NOW, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Subsection (c) Section 15-25, Chapter 15, Code of Ordinances of the City of Delray Beach, Florida, be and the same is hereby amended to read as follows: "(c) It shall be the duty of the city manager, or his designee, to give written notice to the registered owner of any motor vehicle which is in violation of this section as described above or to give such notice to the owner or lessee or other person in possession of private land upon which said motor vehicle is situated, giving notice that said vehicle violates this section, and demanding that said motor vehicle be removed from the city limits within seventy- two (72) hours, or that within seventy-two (72) hours, same may be housed in a building where it will not be visible from the street. Said notice may be given by personal service, or by registered or certified mail, with a return receipt request- ed." Section 2. That Section 15-26, Chapter 15, of the Code of Ordi- nances of the City of Delray Beach, Florida, be, and the same is here- by amended to read as follows: "Sec. 15-26 Penalty. Any person, firm or corporation who shall violate the pro- visions of Sec. 15-25 of this article shall, upon convic- tion thereof, be punished as provided in Section 1-6 of the Code of Ordinances of the City of Delray Beach. Provided, however, if the person, firm or corporation receiving the notice provided for in subsection (c) above executes an agreement in a form similar to that attached to this ordi- nance, the city will arrange for the removal of the vehicle for the party or parties receiving said notice, and no war- rant for arrest will be issued. The cost for such removal shall be the minimum cost available to the city for such re- moval at the time and shall be paid to the city by the party or parties at the time of executing such agreement." Section 3. Should any section or provision of this ordinance or any portion thereof, or any paragraph, sentence or word be declared by a court of Competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
