AN ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA, LEVYING THE ASSESSMENTS AS SHOWN BY THE ASSESSMENT ROLL SUBMITTED BY THE CITY MANAGER OF SAID CITY, FOR CONSTRUCTION OF SIDEWALKS FIVE (5) FEET IN WIDTH WITHIN THE STREET RIGHTS-OF-WAY OF VARIOUS STREETS IN THE WESTERN SECTOR OF THE CITY AS IDENTIFIED HEREINAFTER. ~6EREAS, the City Manager of the City of Delray Beach, Florida, has, in pursuance to the Charter of said City, submitted to the City Council for approval, a report of the cost, and the assessment roll for the construction of sidewalks five (5) feet in width within the street rights-of-way of various streets in the Western sector of the City as identified hereinafter~ 1. On the East side of N. W. 8th Avenue from Atlantic Avenue to N. W. 2nd Street~ 2. On the East side of N. W. lOth Avenue from Atlantic Avenue to the South line of Lot 6, Block C, West Side Heights~ 3. On the East side of N. W. 10th Avenue from 2nd to 3rd Streets~ 4. On the South side of N. W. 2nd Street from 10th to 14th Avenues~ 5. On the East side of N. W. 14th Avenue from Atlantic Avenue to 2nd Street less Lot 23, Block 1, Odmanns S/D~ 6. On the East side of S. W. 14th Avenue from Atlantic Avenue to 3rd Street~ 7. On the East side of S. W. llth Avenue from 2nd to 3rd Streetsl 8. On the East side of S. W. 10th Avenue from Atlantic Avenue to 2nd Street~ 9. On the East side of S. W. 8th Avenue from Atlantic Avenue to 3rd Street~ 10. On the South side of S. w. 3rd Street from 8th to 13th Avenues, and WHEREAS, said report and 'assessment roll were approved by the City Council in regular session on the 28th day of December, 1966, and WHEREAS, due notice concerning said assessment roll was given by advertisement by the City Clerk, in accordance with the City Charter of said City, for the purpose of hearing objections, if any, to said assessment roll, and ~H~EREAS, no sufficient objections were received to the confirmation of the assessment roll, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: SECTION 1. The assessments, as shown by said assessment roll, which is attached hereto and made a part hereof, are hereby levied against the property shown and in amounts shown on said assessment ro11, said assessments to be paid in three (3) equal annual installments, together with interest at the rate of eight (8) per cent per annum, the first installment becoming due and payable on February 22, 1967 and on the 22nd of February Page 2. Ordinance No. 65-66. for the next ensuing two (2) years~ and said special assessment so levied shall be a lien from the date the assessment becomes effective, upon the respective lots and parcels of land described in said assessment ro11, of the same nature and to the same extent as the lien for general taxes, and shall be collectible in the same manner and with the same penalties and under the same provisions as to sale and forfeiture as City Taxes are collectible. SECTION 2. The assessment roll, attached hereto, contains assessments against the Board of Public Instruction of Palm Beach County, Florida, representing 1,044.4 feet of Sidewalk construction adjacent to School properties. Section 192.8 of the Florida Statutes exempts such public bodies from improvement liens without prior con- sent and agreed upon participation. The City Council deems it in the best interest of the citizens of this community for the City to pay the portion attributed to said School Board, which amount totals $1,279.97.
