39-66 ORDINANCE NO. 39-66. AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMBNDING CHAPTER 17, CODE OF ORDINANCES OF SAID CITY, MAKING IT UNLA~'~UL FOR ANY PERSON TO COMMIT WITHIN THE CORPORATE LIMITS OF THE CITY, ANY ACT WHICH IS OR SHALL BE RECOGNIZED BY THE LAWS OF THE STATE AS A FELONY. WHEREAS, the City Council of the City of Delray Beach, Florida, deems it in the best interests of the Citizens of this community to amend sections of the Code of ordinances; and WHEREAS, an emergency ordinance is authorized under Section 30 of the City Charter of this City when for the pur- pose of facilitating the daily operation of a municipal depart- ment; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 17, Code of Ordinances of the City of Delray Beach, Florida, be and the same is hereby amend- ed by adding Section 17-28.1 which shall read as follows: "Sec. 17-28.1. State felonies. It shall be unlawful for any person to commit, within the corporate limits of the city, any act which is or shall be recognized by the laws of the state as a felony, and the commission of such acts is hereby forbidden. Whosoever shall violate the provisions of this section, upon conviction thereof, shall be pun- ished by the same penalty as is therefor pro- vided by the laws of the state, but in no case shall such penalty exceed a fine of five hundred dollars, or an imprisonment for more than ninety days, or both such fine and imprisonment in the discretion of the municipal judge."
