01-65 1-65. ORDINANCE NO. AN EMERGENCY ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING SECTION 6A-24, CHAPTER 6A OF THE CODE OF ORDINANCES OF THIS CITY PERTAINING TO TYPES OF CERTI- FICATES OF REGISTRATION FOR BARBERS. WHEREAS, the City Council of the City of Delray Beach deems it necessary, in order to insure a continuity of sound and effective barber examinations to provide an emergency measure concerning the examination of master barbers; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 6A-24, Chapter 6A of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended to read as follows: "Sec. 6A-24. Same - Types; renewals; fees. The board shall be authorized to issue three types of certificates of registration for barbers, as follows: 1. Master barber, as defined in section 6A-1. 2. Journeyman barber, as defined in section 6A-1. 3. Barber apprentice, as defined in section 6A-12. Such certificates shall be issued for the fiscal year for which issued unless renewed. Any certificate which is not renewed for two successive years shall become void, and can only be re-issued after re-application and successful re-examination. No certificate of registration shall be issued by the board unless the applicant holds a certificate of registration from the State of Florida Barbers Sanitary Commission, and unless such applicant shall have successfully passed a reasonable written examination prescribed by the board as to his fitness and quali- fications to practice the occupation of barbering within the city. In the case of an application for a master barber certificate, the applicant must have, prior to the date of such application, worked two years continuous as a journeyman barber in an area or community having requirements similar to the provisions of this chapter. In the event an applicant is otherwise qualified, but has not worked two years in a community having provisions similar to the provisions of this chapter, the board shall give said applicant an oral examination within ten days of such request. Following said examination, the board shall conduct any investi- gation it deems necessary and shall then submit its recommendations to the city council within 30 days either to waive or not waive said two year requirement. If the city council waives the re- quirement, the applicant shall then be eligible to take the prescribed written test to determine his fitness to manage, operate or act as proprietor for a barber shop in this city. All appli- cations shall be accompanied by an examination fee of fifteen dollars. The board shall be entitled to charge a fee of four dollars for the first certificate of registration issued as a result of any application and examination hereunder, and a yearly renewal fee of one dollar." Section 2. That each of the provisions of this ordi- nance are separable including, word, clause, phrase, or sentence and if any portion hereof shall be declared invalid, the remain- ing portion shall not be affected but shall remain in full force and effect. Section 3. This ordinance is deemed to be an emergency ordinance and shall become effective immediately. First reading and final passage this 8th day of February , 1965.
