25-65 ORDINANCE NO. 25-65. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, PLORIDA, AMENDING CHAPTER 29 OF THE CODE OF ORDII~NCES OF THE CITY OF DELRAY BEACH BY ADDING SUB- SECTION (d) (5) TO SECTION 29,?.7 PERTAIN- ING TO PETITIONS FOR REZONIN~ OR CONDITIONAL USES o NOW, BE IT ORDAINED BY THE CITY COUNCIL OF TItE CITY OF DEI~AY BRACH, FLORIDA~ AS FOLLOWS: That Chapter 29 of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended by adding Sub-section (d) (5) to Section 29-7.7 to read as follows: "(5) In the event the petitioner is the owner of all of the property in the afore- said area to be notified, or in the event the consent of all other property owners is attached to said petition then the planning board may dispense with the public hearing requirement in making its recommendation to the Co~tncil." D£LRAY BE[ACH, FLORIDA July 12, 1965 Honorable Mayor & City Council City Hall Delray Beach, Florida Gentlemen: The Beach Taxpayers League, Inc. since its first original meeting in March 1948 has firmly stood for strict planning and zoning. It has also been our policy to be sure that any contemplated changes in planning or zoning should and must be made only after proper notification of the property owners of the effected area, and last but not least, a public hearing be held. We wish, therefore, to strenuously oppose Ordinance #25-65 on its second and final reading. This Ordinance may under certain circumstances allow the Planning Board to dispense with the public hearing require- ments and do away with the right of all property owners to be heard.
