~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
· ~ OF DELRAY BEACH, FLORIDA, PERTAINING TO THE
~ / LICENSING OF CATS WITHIN THIS CITY; PROVIDING
a reserve for birds on the 14th day of April, 1958; and
WHEREAS, the City Council has received increasing com-
plaints from residents of the City regarding cats running at
large; of public and private nuisances committed by such animals;
and of cats found killing fledglings and adult birds; and
WHEREAS, the situation has reached that point where
remedial legislation is required; and
WHEREAS, the City Council is charged with the protec-
tion of the health, safety and welfare of the general public, as
well as with implementing ordinances already enacted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DELRAY BEACH AS FOLLOWS:
Section 1. No cat over the age of twelve weeks shall
be permitted to be at large outside of any residence or other
building in the city, unless 16 has been licensed by the city
and has an unexpired city cat license tag (inc~ding bell) a~
fixed to its collar.
Section 2. It shall be the duty of the person or per-
sons owning or in possession or control of any cat in the city
to cause such cat to be equipped with and to wear an unexpired
"official" license tag at all times when same is outside of any
residence or other building.
Section 3. The license tax for cats shall be one dol-
lar per year for each cat, and each such license shall expire on
the 30th day of September following its issuance.
Section 4. No license shall be issued for any cat
kept within the city, unless the applicant shall exhibit to the
city treasurer a certificate of a veterinarian certifying that
such cat has been innoculated against rabies within the past
year.
Section 5. U~on the payment of one dollar to the city
treasurer, it shall then be the duty of said officer, or some
other person designated by the City Manager, to furnish a num-
bered tag for each cat so innoculated, and such officer shall
record in a permanent record book, a complete description of any
cat for which a tag has been issued under the provisions of this
article, such description to include the name of the cat, the
name of the owner, and the date of innoculation.
Section 6. It is the intent of this article that each
"official" tag mentioned herein shall include a bell attached
thereto which shall be furnished with said tag and shall be an
instrumental part thereof.
Section 7. Any cat found at large without an unex-
pired license may be captured by any person and impounded by the
police department for a period of five days. After such cat is
impounded, the police department shall, without unnecessary de-
lay, notify the owner of same, if known.
Section 8. The place where cats are impounded shall
be provided by and under the supervision of the chief of police,
at the expense and cost of the city. In order to redeem any dog
or cat that may have been impounded under the provisions of this
article, the person desiring to redeem same, in addition to having
same innoculated (unless proof is given that same has already been
innoculated), and paying one dollar for tag, shall also pay, as a
redemption fee and for impounding, the sum of one dollar, and a
further fee of twenty-five cents per day for each and every day
such cat shall have been impounded, before such cat shall be re-
leased. The chief of police shall keep a registry or record of
all animals so redeemed and the amount paid to him, and shall
turn over such money to the city treasurer.
Section 9. If any cat remains in the custody of the
city for more than five days, the owner thereof shall lose all
right to the animal; and the city shall proceed to dispose of
same, either by sale to pay the charges against the animal or by
turning same over to the Animal Rescue League.
Section 10. Any person violating the provisions of
this article, shall, upon conviction, be punished as provided in
Section 1-6 of the Code of Ordinances of this City.
