AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REZONING AND PLACING LOTS B, C and D, ~ROPIC PALMS, PLAT ONE, DELRAY BEACH, FLORIDA, IN "R-lA SINGLE FAMILY DWELLING DISTRICT'~.'~' AND AMENDING "ZONING MAP OF DELRAY BEACH, FLORIDA, 1960". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA: SECTION 1. That the following described property in the City of Delray Beach, Florida, is hereby rezoned, and placed in the "R-lA Single Family Dwelling District" as defined by Chapter 29 of the Code of Ordinances of the City of Delray Beach, ~:lorida, to-wit: LOTS B, C and D, TROPIC PALMS PLAT ONE, DELRAY BEACH, FLORIDA, ACCORDING TO PLAT BOOK 25 AT PAGE 100 ON FILE IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT IN AND FOR PALM BEACH COUNTY, FLORIDA. SECTION 2. That the Building Inspector of said City shall upon the effective date of this Ordinance change the Zoning Map of Delray Beach, Florida to conform with the pro- visions of Section i hereof. MAYOR ATTEST: / City C k~~-~' First Reading _ Decsmbem 9L 1963 Second Reading Js~nua~ 13. 196k December 2, 1963 951 Allamanda Drive Delray Beach, Florida Delray Beach City Council Delray Beach, Florida Gentlemen : This is my third protest against the proposed rezoning of Lots B, C and D, Tropic Palms Plat No. l, from C - I and C -2 (commercial district) to R - lA (single family dwelling district). Since Lots B, C and D are surrounded on the North, South, East and Wes$ by many lots zoned C - i or C - 2, this rezoning would be a flagrant example of "Spot Zoning". Rezoning up from C - I or C - 2 to R - lA, decreases the market value of a lot by 50% or more. Consequently, this rezoning of Lots B~ C and D would create a financial hardship to the present owners and would decrease the tax base of the City of Delray Beach, thereby placing an added tax burden on our other taxpayers. Lindell Boulevard is a main traffic artery, feeding the "~egalopoliS" now developing along V. S. No. i tlighway and Old Dixie Highway, between the geographical centers of Delray Beach and Boca Raton. Already Lindell Boulevard directly links Tropic Isle, Tropic Palms, Hidden Valley and the Germanto~n Road area ~estward out to ~litary Trail. Since Lindell Boulevard intersects Old Dixie Highway, Dixie Boulevard, Del Raton Boulevard and U. S. No. i Highway, Lots B, C and D of Tropic Palms Plat No. l, together with the neighboring lots and parcels, could easily develop into the "Times Square" or "Picadilly Circus" of Delray Beach before the turn of the century. The rezoning to R - lA of such strategically vital property, directly in the orbit of enormous commercial growth, can be stagnating to the City of Delray Beach. At a public hearing on October 25, 1963, the five members of the Planning and Zoning Board present, by a majority vote, recommended that the request for this rezoning be granted. I, as one adjacent property owner, was not notified by mail of this public hearing. In the further consideration of this vital rezoning, the following steps could yet be profitably taken by the Planning and Zoning Board : 1. All adjacent property owners could be notified of a public hearing by certified mail. 2. Plat maps, highway maps and aerial photographs, of the entire affected area within a minimum radius of one mile, could be studied thoroughly by all voting members. 3..~ traffic count could be taken on Lindell Boulevard between U. S. No. i Highv~y and Old Dixie Highway. ~. Groz~h and population projections of the south half of Delray Beach by City Planner George Simons could be re-examined by all voting members. 5. An On-site inspection of the affected area could be made by all voting members. 6. A minimum of seven VOTING members could be present at a public hearing. A first alternate member and a second alternate member could be available, if needed. If a regular member prefers to abstain from voting, a thoroughly qualified alternate member could cast the seventh vote. Unless preceeded by thorough planning, property zoning and rezoning occasionally builds an insurmountable barrier to most desirable use s. nd logical development. As a society of free men, who ~.ish to remain free into eternity, we can never afford to be complacent and lackadaisical about our property rights. To many of us, this specific rezoning oversight may seem to be only a trifling matter, but mere trifles have a way of changing the course of history. The City of Delray Beach has been good to me, so the least I can do, as a self-appointed trustee for her generations yet unborn, is to stand up for the third time to protest against this proposed rezoning. In all fairness to our citizens of the future, the Delray Beach City Council could refer this proposed rezoning back to the Planning and Zoning Board for a new study by all seven VOTING members. Woodward Jr. In session as members of the Delray Beach City Council Gentlemen : On October 18, 1963 I protested against the proposed rezoning of Lots B, C and D, Tropic Palms Plat No. l, from C - i and C - 2 (commercial district) to R - lA (single family dwelling District) to the City of Delray Beach Planning And Zoning Board. I am again protesting this same proposed rezoning~ since it would constitute a flagrant example of "Spot Zoning". Lots A, E~ F, G, H, J, K, L, Nand N are all zoned C - i or C - 2. In addition, all of the property between U. S. No. I Highway and the Old Dixie Highway, from Canal 15 northward for a minimum distance of one mile is zoned C - i by Palm Beach County, in those cases where the property is still outside the city limits of Delray Beach. I am the present owner of Lots ~l through 36 inclusive (16 lots), in Block 32 of Delraton Park, which have almost 300 feet of frontage on Lindell Boulevard and 125 feet of frontage on U. S. No. i Highway. This parcel is contiguous to the Delray Beach City Limits, along both of these frontages and is zoned C - i by Palm Beach County. Lindell Boulevard directly connects with Avenue L as it crosses U. S. No. I Highway. This creates a direct link between Tropic Isle and Tropic Palms. Del Raton Boulevard also connects the Old Dixie Highway, Lindell Boulevard and U. S. No. i Highway at this point. Lindell Boulevard is a main traffic artery for the southwest section of Delray Beach and also the northwest section of Boca Raton. In the next few decades, Lindell Boulevard could possibly carry the flow of 5,000 automobiles per day. The immediate area adjacent to this proposed rezoning could become the "Times Square" of Delray Beach before the turn of the century. "Times Square" was probably zoned R - lA when the Indians sold Manhattan Island for a handful of silver coins and a gallon of whiskey. If the City of Delray Beach is to fulfill its destiny, "our old men must dream dreams and our young men must see visions". Respectfully yours, ohn D.
