AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY
CERTAIN LAND LOCATED IN SECTION 18, TOWNSHIP
46 SOUTH, RANGE 43 EAST, WHICH LAND IS CONTIGU-
OUS TO EXISTING MUNICIPAL LIMITS OF SAID CITY:
RBDEFINING THE BOUNDARIES OF SAID CITY TO IN-
CLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND
OBLIGATIONS OF SAID LAND; AND PROVIDING FOR
THE ZONING THEREOF.
W~EREAS, it is deemed for the best interest, safety,
health, a~d general welfare of the citizens of the City of Delray
Beach, Florida, and the owners of the hereinafter described real
property that said land be annexed to the City of Delray Beach,
and
WHEREAS, said land is contiguous to the present boun-
dary of territorial limits of the City, and that, when annexed,
will constitute a reasonably compact addition to the incorporated
territory with which it is combined, and
WHEREAS, all of the owners of record of said land here-
inafter described have consented and given permission for the an-
nexation of said land, and
WHEREAS, the City of Delray Beach has heretofore been
authorized to annex lands in accordance with Section 185.1 of the
City Charter of said City granted to it by the State of Florida:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
~E~CT~ON...~.. That the City Council of the City of Delray
Beach, Palm Beach County, Florida, hereby annexes to said City the
following described tract of land located in Palm Beach County,
Florida, which lies contiguous to said City, to-wit:
The Northerly 1400 feet of the Northeast
Quarter lying between the E-4 Canal and
Westerly right-of-way line of the S.A.L.
RY less the following: The Easterly 300
feet, the Southerly 625 feet and the
Southerly 100 feet of the Northerly 180
feet of the westerly 259.43 feet of the
Easterly 559.43 feet, Section 18, Township
46 South, Range 43 East, as in OR Book 148,
Page 78. Said tract containing approximately
15.29 Acres.
SECTION 2. That the boundaries of the City of Delray
Beach, Florida, are hereby redefined so as to include therein the
above described tract of land, and said land is hereby declared
to be within the corporate limits of the City of Delray Beach,
Florida.
~EcT!QN 3. In consideration of Petitioner's consent for
annexation of the land hereinabove described, subject to the follow-
ing conditions it is hereby agreed that:

Said land being unimproved shall be taxed on an
acreage basis to owners of said land so long as
said land remains unimproved, however, as any
portion of said land becomes improved, which
shall include all lands being utilized in any
manner with relation to improved areas, such
lands shall be subject to normal taxation,
including the bonded indebtedness of the City
of Delray Beach, Florida, and that the tract
of land herein described and petitioned to be
annexed shall, upon such annexation, be zoned
"C-3" (Wholesale and Light Industrial District).
SECTION~.. That the land hereinabove described shall
immediately become subject to all of the franchises, privileges,
immunities, debts, obligations, liabilities, ordinances and laws
to which lands in the City of Delray Beach are now or may be,
except as otherwise provided and set forth in Section 3 above,
and persons residing thereon shall be deemed citizens of' the
City of Delray Beach.
SECTIONS. That if any word, phrase, clause, sentence
or part of this ordinance shall be declared illegal by a court of
competent jurisdiction, such record of illegality shall in no way
affect the remaining portion.
Passed in regular session on the second and final reading
on this the 9th day of March, 1964.
