AN ORDINANCE OF THE CITY OF DELRAY BE~CH,
FLORIDA~ ANNEXING CERTAIN LANDS LOCATED
EAST OF SECTION 16, TOWNSHIP 46 SOUTH,
RANGE 43 EAST, TO THE CITY OF DELRAY
BEACH, FLORIDA.
WHEREAS, it is deemed for the best interest, safety,
health, and general welfare of the citizens of the City of Delray
Beach, Florida, that certain lands be annexed to the City of
Delray Beach~ and
W~EREAS, said tract of land is contiguous to the
present boundary of territorial limits of the City and that,
when annexed, it will constitute a reasonably compact addi-
tion to the incorporated territory with which it is combined;
and
WHE~S, there are less than ten freeholders and/or
registered electors contained in the area which is to be an-
nexed~ and
WHEREAS, the Council of the City of Delray Beach has
passed an ordinance declaring its intent to annex said lands,
which ordinance was published in the Delray Beach News Journal
for four consecutive weeks, and to which no objections have
been made.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Sj~CT~ON 1~ That in accordance with Section 185, as
amended, of the Charter of the City of Delray Beach, and/or
Section 171.04, Florida Statutes (1963), the City Council does
hereby annex to said City the following described tract or
parcel of land located in Palm Beach County, Florida, which
lies contiguous to the existing boundaries of said City; to-wit:
That portion of submerged land lying be-
neath the Atlantic Ocean, bound on the
NOrth by the Easterly prolongation of the
North line of Section 16, Township 46 South,
Range 43 East, bound on the South by the
Easterly prolongation of the South line of
said Section 16-46-43 and running three
miles Easterly from the following described
property:
All of the lands designated on that certain
plat of the Fractional East half of Section
Sixteen, Township Forty-six South, Range
Forty-three East, as recorded in Plat Book
1, page 25, Palm Beach County public records
as "OCEAN ROAD" and also all lands, if any,
lying East of that portion of said plat des-
ignated as "OCEAN ROAD" down to the waters
edge of the Atlantic Ocean.

SB~ .2.: That the boundaries of the City of Delray
Beach are hereby redefined so as to include therein the above
de. scribed tract of land, and said land is hereby declared to be
in the corporate limits of the City of Delray Beach, Florida.
SECT!~N_~3~ That the land hereinabove described shall
immediately' become subject to all of the franchises, privileges,
immunities, debts, obligations, liabilities, ordinances and laws
to which lands in the City of Delray Beach are now or may be, and
persons residing thereon shall be deemed citizens of the City of
Delray Beach.
SECTION. 4. That if any word, phrase, clause, sentence
or par.t of this ordinance shall be declared il'legal by a court
of competent jurisdiction, such record of illegality shall in
no way affect the remaining portion.
PASSED in regular session on the second and final read-
ing on this the 25th day of May, 1964.
