No. 69-24 (Recorded)CFN 20240101291 OR BK 34909 PG 994 RECORDED 3/25/2024 4:26 PM Palm Beach County, Florida RESOLUTION NO. 69-24 Joseph Abruzzo, Clerk Pgs: 994 - 1001; (8pgs) A RESOLUiTION OF THE: CITY COMMISSION OF THE CITE` OF DELRAY BEACH, FLORIDA, APPROVING THE VACATION OF "FRAC'I""P" FROM THE ATLANTIC GROVE PLAT NO. 2, RECORDED 1N PLAT BOOK 133, PAGES 44 THROUGH 46, OF THE PUBLIC RECORDS OF PALM BEACH COUNTY FLORIDA, AS MORE PARTICULARLY DESCRIBED HEREIN: PROVIDING FOR AN EFFECTIVE DA'1'}:; AND FOR OTHER PURPOSES. WHEREAS, Atlantic Grove; Partners, L.L.C., a Florida limited liability company; Atlantic Grove Townhomc Association, Inc„ a Florida not -for -profit corporation; and Atlantic Grove Condominium Association, Inc., a Florida not -for -profit corporation: are the owners ("Owners") of the real prof}erty described in the plat of Atlantic Grove Plat No. 2 ("Plat"), as recorded in Plat Book 133, Pages 44 through 46, of the public records of Palm Beach County, Florida, as shown in Exhibit "A"; and WHEREAS, Tract "P" is dedicated to the Atlantic Grave Condominium association for emergency response, ingress, egress, parking utility and drainage purposes; and WHEREAS, the Palm Beach County Property Appraiser's Office has indicated that Tract "P" should not have been included in the Plat because it was already added to the Atlantic Grave Condolniniuni by the A,I-eecl Oi-deir Amending Dccicai-ation of Conclojsrenhun to C'onlbrin to l-inal Judg-171ent and Settlemela1 l greement dated August 19, 2019, and entered in Case No. 502003CA013282XXOCAI3 of the Circuit Court in and for Palrn Beach County, Florida:. and WHEREAS, the Owners have designated Tirnothy I-lernandez, of New Urban Communities, to file a request (File No. 2024-083) to vacate Tract "P", as depicted in Exhibit "B" and more particularly described in Exhibit "C", from the plat; and WHEREAS, pursuant to Florida. Statutes 177.101, a resolution from the governing body of the municipality is required when request has been made to vacate a pia.t, in whole or in part, of lands located within the corporate limits of a municipality; and WHEREAS, Section 2.4.8(E)(5) of the Land Developinent Regulations of the City of Delray Beach ("LDR") requires that prior to approving a vacation of a recorded plat, the City Commission must find that: the abandonment of any affected public interest or public improvement that was or would have been created by the plat, but which Would not now be provided shall not have a significantly adverse impact upon the City's ability to obtain, retain, of maintain public facilitie's or tests of concurrency. WHEREAS, to (late, there has been no construction or irnprovemcnts to the land within Tract "P": and WHEREAS, the Planning and Zoning Board considered this request at its meeting on February 16, 2024, and voted 4 to 0 to recommend approval to the City Commission, and CFN 20240101291 OR BK 34909 PG 995 Pg: 2 of 8 WHEREAS, on March 5, 2024, the City Commission considered the request and the respective findings as set forth in the LDR. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. The foregoing recitals are hereby incorporated herein by this reference and are approved and adopted. Section 2. The City Commission makes positive bindings that the abandonment of any affected public interest or public improvement that was or would have been created by the plat, but which would not now be provided shall not have a significantly adverse impact upon the City's ability to obtain, retain, or maintain public facilities or tests of concuiTency. Section 3. The City Commission approves the request to vacate Tract "P" of the Atlantic Grove Plat No. 2, finding the request and approval thereof meets the criteria set forth in the Land Development Regulations. The underlying real property, formerly described as Tract. "P", is vacated from the plat of Atlantic Grove Plat No. 2 and shall henceforth be legally described according to its legal description as described in Exhibit "C". With the exception of the vacating, annulment, and removal of Tract "P", the plat of Atlantic Grove Plat No. 2 remains in full force and effect in all respects. Section 4. The City Clerk, or designee, is directed to send a certified copy of this Resolution to Timothy L. Hernandez, AICP, Principal, New Urban Communities, PO Box. 8319. Delray Beach, FL 33482. Section 5. All resolutions or parts of resolutions in conflict herewith shall be and hereby are repealed. Section 6. This Resolution shall be effective immediately upon adoption.
