A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH,FLORIDA APPROVING MODIFICATION #2 TO AN
AGREEMENT WITH THE STATE OF FLORIDA TO OBTAIN STATE
HOMELAND SECURITY GRANT PROGRAM FUNDS:AUTHORIZING
THE CITY MANAGER TO EXECUTE ANY AMENDMENTS AND TAKE
ALL ACTIONS NECESSARY TO EFFECTUATE THE INTENT OF THIS
RESOLUTION;PROVIDlNG AN EFFECTlVE DATE;AND FOR OTHER
PURPOSES.
WHEREAS,the City of Delray Beach (the "City")is authorized to enter into agreements to provide
services,programming and products in accordance with its Charter;and
WHEREAS,the State of Florida (the "State")has the statutory authority to disburse Federal
Homeland Security funds to participating municipalities of a Regional Domestic Security Task Force;and
WHEREAS,the City entered into an agreement with the State to obtain State Homeland Security
Grant Program funds to offset the expenses incurred by the City to sustain and purchase specialized
equipment for mitigating Hazardous Materials incidents (the "Agreement"):and
WHEREAS,the Agreement originally expired on March 31,2023:and
WHEREAS,on November 26,2023,the City and State executed Modification#I to the Agreement,
reinstating the Agreement and extending the term to December 31,2023:and
WHEREAS,the City and the State desire to reinstate the Agreement again and extend the term to
April 30,2024 (Modification #2):and
WHEREAS,the City Commission considers it in the best interests of its residents to enter into
Federally Funded Subaward and Grant Agreement to access federal disaster relief funds for the City.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH,FLORIDA,AS FOLLOWS:
Section I.The foregoing recitals are hereby affirmed and ratified.
Section 2.The City Commission of the City of Delray Beach has reviewed and hereby approves
Modification #2 between the City and the State,attached hereto and incorporated herein as Exhibit "A"
Section 3.The City Commission authorizes the City Manager to execute any amendments and
take any other actions necessary to effectuate the intent of this Resolution.
Section 4.This resolution shall become effective immediately upon adoption.
