ORDINANCE
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA, AMENDING
SUB-SECTION (C), SECTION 29 - ?, CHAPTER
29 OF THE CODE OF ORDINANCES OF THIS CITY
PERTAINING TO BUILDING HEIGHT REGULATIONS
IN THE R-3 MULTIPLE FAMILY DWELLING
DISTRICT.
NOW, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA, AS ~OLLOWS:
Section 1. Sub-section (c), Section 29 - 7,
Chapter 29 of the Code of Ordinances of the City be and the
same is hereby amended to read as follows:
"Sec. 29 - 7, R-3 Multiple family dwelling district.
"(C ) BUILDING HEIGHT REGULATIONS
',No buildiug shall exceed three stories or forty-
five (45) feet in height; except that buildings located on
ocean front lots may be erected to a height not exceeding one
hundred (100) feet provided the main outside walls of said
building in excess of seventy-five (?~) feet are set back
on all sides, except the front, toward the center of the
building in a ratio of one foot to each foot of height in
excess of fifty (~0) feet. For the purposes of this sub-
section, 'Building Height' is the vertical dimension measured
from the highest finished grade at the building to the highest
point of construction."
Section 2. All ordinances, or parts thereof, in
conflict herewith, be, and the same are hereby repealed.

(C) BUII~ING HEIGHT REGULATIONS
No building or structure shall exceed three (3)
stor~s or forty-five (4~) feet in height at the required
front, side and rear yard lines, but above the height per-
mitted at said yard lines, one (1) foot may be added to the
height of the building for each one (1) foot that the build-
ing is set back from the required yard lines provided, how-
ever, that in no instance shall the building exceed a height of
one hundred (100) feet.
Sec. 29-7.~, General provisions and exceptions
(ll) Hotels, apartments or other structures may be
erected to a height not exceeding one hundred (100) feet on
ocean front lots in the R-3 multiple family dwellings district,
provided, however, that the main outside walls of said building
in excess of seventy-five (7~) feet shall be set back on all
sides, except the front, toward the center of the building in a
ratia~ of one foot to each foot of height in excess of fifty
(50) feet.
Ordinance No. G-468
Buildings may be erected to a height not exceeding
one hundred (100) feet measured from the highest finished grade
at the building to the finished ceiling of the highest floor of
the building. Provided, however, that any building or other
structure in excess of three (3) stories shall be required to
increase the basic side and rear set-backs an additional five
(5) feet.

Gent lemen:
Councilman Talbot requested that I draft the enclosed, pro-
posed ordinance to regulate the building heights in the R-3
Multiple Family Dwelling Districts of this City.
I ~m also enclosing a sheet which includes the height regu-
lations as they existed prior to November, 1962 and also
Ordinance G-468 which would be our present ordinance but
for the moratorium.
Please note that the proposed ordinance is very similar to
the regulations which existed prior to November, 1962. The
only changes are: (1) Buildings located in areas other than
ocean front lots are absolutely limited to 45 feet in height,
and (2) An attempt has been made to define how the height
shall be measured.
This is only a proposed ordinance, but it will appear on
the agenda for first reading at the meeting of May 13 at
Mr. Talbot's request and it is being furnished you early
to give you more time for consideration.
Please do not hesitate to contact me if you encounter diffi-
culty in interpreting the provision as rewritten.
