AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING SECTION 29-15 OF T~E CITY CODE OF ORDI- NANCES PERTAINING TO T~E PARKING OF TRAILERS. W~EREAS, the City Council of the City of Delray Beach, Florida, deems it in the best interests of the residents of the City that Section 29-15 of the City Code of Ordinances pertaining to the parking of trailers be ~mended, NOW,'THEREFOREt BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS= SECTION 1. That Section 29-15 of the Code of Ordinances of the City of Delray Beach, Florida, be ~mended to read as fol- lows: Sec. 29-15. Parking of motor trailers7 use of same as living quarters. (a) Definitions Within the meaning of this Section the words "motor trailer" shall be and the same are hereby defined as follows: Any of the various types of vehicles with or without motor power or designed to be towed with an automobile, and adapted to human habitation either for the purpose of sleeping or eating or pre- paration of meals, or both, or adapted to the use of an office or for the purpose of carrying on business. (b) Parking prohibited; exceptions No motor trailer equipped to travel upon the public high- ways, as defined in paragraph (a), shall be kept within the city for more than two hours unless such vehicle is kept in an enclosed garage, or unless such vehicle is detained because of circumstances beyond the control of the operator; and further provided that no automobile trailer, vehicle or conveyance, as described above, equipped to travel on the public highways shall be kept or parked on Ocean Boulevard of the city from the south city limits to the north city limits (including any city parking lots adjacent there- to) for more than thirty minutes unless such vehicle is parked there due to circumstances beyond the control of the operator. During such time in which such vehicle shall be parked, it shall be unlawful to serve any meals involving the cooking of foods. (c) Use as living quarters prohibited; exceptions (1) No motor trailer or conveyance designed or equipped to be used as a temporary or permanent residence shall be used as living quarters in a residential, business or similarly built-up area within the city limits. Such trailers may be used to house employees on golf courses located in outlying areas of the city, and on similarly located property, providing the fol- lowing requirements are met: (a) Mobility of the vehicle used shall be maintained at all times. (b) Such mobile homes or trailers shall be placed in secluded areas which would not disturb adjacent property owners in the use of their lando (c) Sanitary facilities, water supply, and electric power supply shall meet all existing standards. (2) Any person desiring to locate and use mobile homes or trailers as outlined above shall make application to the City Council for approval. A public hearing will then be held as under conditional use procedures° (d) Permitted use by general contractors A motor trailer, as defined in paragraph (a) herein, may be used by a General Contractor in connection with a project when said trailer is equipped and used as a field office, providing the General Contractor obtains a permit from the City Clerk for such use, the period of time covered by the permit beginning five days before actual construction is begun and ending five days after the construction is convicted, it being understood that the con- struction will be completed in a reasonable length of time. (e) Use as mobile office; exceptions Any person desiring to use a motor trailer which is designed as a mobile office as distinguished from one designed for human habitation may make application to the City Council for approval.
