A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, PROVIDING FOR THE ABANDONMENT
OF INTEREST IN A PORTION OF A UTILITY EASEMENT LOCATED AT
4645 WI- rrE CEDAR LANE, TOTALING APPROXIMATELY FIVE
THOUSAND NINE HUNDRED AND THIRTY-THREE SQUARE FEET, AS
MORE PARTICULARLY DESCRIBED HEREIN, PROVIDING FOR AN
EFFECTIVE DATE, AND FOR OTHER. PURPOSES.
WHEREAS, Delaire Country Club, Inc., f/k/a Del -Aire Golf Club, Inc. (the "Owner"), is the owner
of a. parcel of land located at 4645 White Cedar Lane; and
WHEREAS, the Owner designated 'Tara -Lynn Patton, AICP-Planning and Entitlements (the
"Applicant") to act as its agent; and
WHEREAS, the City of Delray Beach, Florida (the "City") received an application (2024-140-ABE-
CCA) from the Applicant for the abandonment of interest in a portion of a utility easement (the "Easement")
totaling approximately five thousand nine hundred and thirty-three square feet (5,933 sq. ft.), located at 4645
White Cedar Lane, as more particularly described in Exhibit "A"; and
WHEREAS, the Easement was dedicated in perpetuity for the construction and maintenance of
utilities in the Del. Aire Golf Club Plat recorded in Plat Book 35, Page 1, Public Records of Palm Beach
County, Florida; and
WHEREAS, there are no existing or proposed public utilities located within the easement area, and
WHEREAS, pursuant to Land Development Regulations ("LDR") Section 2.4.9(C)(4)(c), the
application was forwarded to the City Commission with a recommendation by the City Engineer that the
abandonment be approved; and
WHEREAS, Section 2.4.9(C)(6) of the 1,DR requires the City Commission to find the abandonment
will not result in the detriment for the provision of utility services to adjacent properties or the general area;
and
WHEREAS, the City Commission has reviewed the application (2024-140-ABE-CCA) to abandon a.
portion of a utility easement totaling approximately five thousand nine hundred and thirty-three square feet
(5,933 sq. ft.), located at 4645 White Cedar Lane and has considered the respective findings in the Land
Development Regulations and Comprehensive Plan.

NOW, THEREFORE, BE IT RESOLVED BY 'THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. The foregoing recitals are hereby incorporated herein by this reference.
Section 2, The City Commission makes positive findings that the requested abandonment will
not result in the detriment for the provision of" utility services to adjacent properties or the general area.
Section 3. "I"he City Commission hereby vacates and abandons all rights and interest the City
holds in the Easement, as more particularly described in Exhibit "A",
Section 4. The City Clerk, or designee, is directed to send a certified copy of this Resolution to
Tara -Lynn Patton, AICP-Planning and Entitlements, at 10805 Gleneagles Road, Boynton Beach, Florida
33436.
Section a. This Resolutionn shall become effective immediately upon adoption.
