G-443(18-62) ORDINANCE NO, G' ~443 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH CERTAIN LANDS LOCATED IN SECTION 21, TOWNSHIP ~6 $OUTH~ RANGE 43 EAST, WHICH LANDS ARE CONTIGUOUS TO EXISTING MUNICIPAL LIMITS OF SAID C~TY; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LANDS; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID I~NDS; AND PROVIDING FOR THE ZONING THEREOF. WHEREAS, John W. Spinner is the fee simple owner of the property hereinafter describedJexcept for that oortion con- sisting of the right-of-way for State Road #AIA, and WHEREAS, the said John W. Spinner, by his Petition, has consented and given peEnission for the annexation of said pro- perty by the City of Delray Beach, and WHEREAS, the City of Delray Beach has heretofore been authorized to annex lands in accordance with Section 185.1 of the City Charter of said City granted to it by the State of Florida; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: SECTION 1. That the City Council of the City of Delray Beach, Palm Beach C--~ty, Florida, hereby annexes to said City the following described tract~ of land located in Palm Beach County, Florida, which lie contigdous to said City, to-wit: Those tracts of la~d in Section 21, Towns'hip 46 South, Range ~3 East, Palm Beach, County, Florida, described as follcws: South 180 feet of that part of the North 200 feet of the South 900 feet of the North 4,680 feet, which Dart is bounded on the West by the Easterly boundary line of the right-of-way of State Road #AIA and on the East by the waters of the Atlantic Ocean, also described as that part of the S 180 feet of the N 13~0 feet of Govt. Lot 4 lying East of State Road AIA, also; Commencing at a point on the West right-of-way line of State Road #AIA where said line inter- sects the Southerly boundary line of Section 21, Township 46 South, Range ~3 East; thence Easterly a distance of 100 feet to a point on the East right-of-way line of State Road #AIA; thence Northerly along said East right-of-way line a distance of 2,128 feet; thence Westerly a dis- tance of 100 feet to a point on the West right- of-way llne of State Road #AiA; thence Southerly a distance along said West right-of-way line a distance of 2,128 feet to the Point of Beginning. SECTION 2. That the boundaries of the City of Delray Beach, Florida, are hereby redefined so as to include therein the above described tracts and parcels of land, and said land~ ~re here- by declared to be within the corporate limits of the City of Delray Beach, Florida. SEC.TION .t. That the tract of land hereinabove first described is hereby declared to be in Zoning District "R-3", as defined by existing ordinances of the City of Delray Beach, Florida. S~CTION ~ In consideration of Petitioner's consent to annexation as above set forth, and since municipal services will not accrue to said land until such time as development is undertaken and Completed~ said land shall be liable for municipal ad-valorem taXes, as follows: (a) It is contemolated that improvements will be com- menced on said land in the i~mnediate future; how- ever, should some unforeseen circumstance oause a delay in the coEmencement of constru~tion, the afore- said will be taxed in the amount of $250~00 per year for a period not to exceed the next two taxable years. (b) It is contemplated that the improvements to be placed on the aforesaid land will be completed during the early months of 1963, but since municipal benefits will not accrue until such time as the development is cor.~pleted~ assuming that construction is co~tmenced during the year 1962, the 1963 ad-valorem taxes on the aforesaid land shall be ~l,O00..00, and thence- after the prooerty shall become subject to normal taxation comnencing January l, 1964. SECTION %. That the lands here±nabove described shall immediately become subject to all of the franchises, orivileges, immunittes~ debts (except the existing bonded indebtedness), ob- ligations, liabilities, ordinances and laws to which lands in the City of Del~ay Bec. ch are now or may be, except as otherwise provided and set forth in Section 4 above, and persons residing thereon shall be deemed citizens of the City of Delray Beach. SECTION 6. That if any word, phrase~ clause, sentence or part of this ordinance shall be declared illegal by a court of competent Jurisdiction~ such record of illegality shall in no way affect the remaining portion. This Ordinance was placed on first reading by the City Council at a Regular meeting held on April 2~ 1982~ and said Council will sit in the Co~u~cil Chambers at the City Hall in Reg- ular session on M~y 14th~ 1962, at which ti~o the abo~'e Ordinance will be considered and all persons interested sh~ll be given an opportunity to be heard.
