G-;,;15 ~ · OF THE DELRAY BEACH MUNICIPAL BEACH TO "h~~ IL/ , j THEIR OVERNIGHT HOUSE GUESTS; TO REAL ~ ~ ~ AND PERSONAL PROPERTY TAXPAYERS OF THIS CITY AND THEIR II~EDIATE FAMILIES; AND ~~~~,~ TO THE REGIST~ED GUESTS OF AP~ENTS, MOTELS, HOTELS AND OTHER TYPES OF RENTAL UNITS LOCATED IN THIS CITY; ~QUIRING USERS OF S~E TO PRODUCE IDENTIFICATION; AND PROVIDING A PENALTY FOR THE VIOLATION  OF THIS ORDINANCE. ~EREAS, %he City of Delray Beach, Florida is a rapidly growing city, and due to recent hea~ use of the Municipal Beach by residents of other co~uni~ies the Municipal Beach is becoming overcrowded $o the de~rimen~ of the citizens, residents, taxpayers of this city and their gues~s~ and ~EREAS, the City Council of the City of Delray Beach, Florida, deems i~ necessary for the i~ediate preserva- tion of %he public peace and property of this city %o limit the use of %he said Municipal Beach; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DE~AY BEACH, FLORIDA, AS FOLLOWS: Section 1. The use of %he Delray Beach Municipal Beach is hereby limited to citizens and residents of ~his city and their overnight h~.us~ guests; ~o real and personal property taxpayers of this city and Sheir i~ediate families~ and %o %he registered ~es~s of aparSments, motels, hotels and other types of rental units located in this city. Section 2. For purposes of ~his ordinance ~he Delray Beach Municipal Beach is that area described as follows: All of fractional Section 16, To, ship ~6 South, Range &3 East, lying east of %he east curb of State Road A1A (Ocean Boulevard) as now laid out and in use. Section 3. All persons using the Delray Beach Municipal Beach shall produce, upon reques$ of a police officer of %his city, sufficient identification ~hat %he person is entitled to use the Delray Beach Municipal Beach under this ordinance. Section ~. Any person who shall violate this ordinance, upon conviction thereof, shall be fined not more than $500.00 or imprisoned in the city Jail not exceeding sixty (60) days, or both such fine and imprisonment. Section..5. In the event any section, paragraph, sentence, clause, phrase or' portion of this ordinance be held unconstitutional, invalid or ineffective, the same shall not repeal, nullify or in any manner affect any other section, paragraph, sentence, clause or portion of this ordinance. Passed and adopted on the 1st day of May, 1962, to be effective immediately.
