AN ORDINANOE OF THE CITY COUNCIL OF THE CITY
OF DELRAY BEAOH, FLORIDA, ANNEXING TO THE CITY
OF DELRAY BEACH CERTAIN LANDS LOCATED IN
SECTI(I~2OVAND 21, TOWNSHIP 46 SOUTH, RANGE 43
EAST, WHICH IANDS ARE 00NTIGUOUS TO EXISTING
MUNICIPAL LIMITS OF SAID CITY! REDEFINING THE
BOUiTDARIES OF SAID CITY TO INOLUDE SAID LANDS;
PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF
SAID LANDS; AND PROVIDING FOR THE ZONING THEREOF.
~.~HEREAS, Delrae Corporation is the fee simple owner of
the property hereinafter described, and
%~tEREAS, the said Delrae Corporation, by its Petition,
has consented and given permission for the annexation of said pro-
petty by the City of Delray Beach, and
WRERF~S, the City of Del~ay Beach has heretofore been
authorized to annex lands in accordance with Section 185.1 of the
City Charter of said City granted to it by the State of Florida;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DELRAY BEACH FLORIDA AS FOLLOWS:
SECTION 1. That the City Council of the City of Delray
Beach, Palm B%~h county, Florida, hereby annexes to said City the
following described tracts of land located in Palm Beach County,
Florida, which lie contiguous to said City, to-wit:
Those tracts of land in Sections20 and 21, Township
46 South, Range 43 East, Palm Beach, County, Florida,
described as follows:
All that part of the West half of the Southwest
Quarter of the Southwest Quarter of Section 21,
Township 46 South, Range 43 East and all that
part of the East half of the Southeast Quarter
of the Southeast Quarter of Section 20, Township
[~6 South, R. ange 43 East, lying and being East of
the East R/W of 01d Dixie Hwy_., and West of the
West R/W line o£ State Road 5 (U. S. Highway # l);
That part of Lots 7 & 8 of Block I of S/D of
Section 21, Township 46 South, Range 43 East,
Palm Beach Countyl Florida, as recorded in Plat
Book l, Page 128,' Public Records of Palm Beach
County, Florida, and more particularly describ-
ed as follows: Commence at the intersection of
the West R/W line of State Road No. 5 (U.S.
Highway # l) and the North line of the South
half of said Lot ? for P. O. B. for the herein
described tract of land; thence in a Slly
direction along said West R/W line a distance
of 452.8? ft.; thence W'ly and parallel to the
said North line of the South half of Lot 7, a
distance of 226.87 ft., more or lesslto a point
in the West line of the East half of' said Lots
? & 8; thence in a N'ly direction along said
West line of the East half of Lots ? & 8 for a
distance of 382.44 ft., more or less, to a point
in said North line of the South half of Lot 7;
thence in an E'ly direction along said North
line of the South half of Lot ? a distance of
464.~0 ft., more or less, to the Point of Beginning,
Said tracts containing 25.15 acres, more or less .
SECTION 2. That the boundaries of the City of Delray
Beach, Florida, ~e~eby redefined so as to include therein the
above described tracts and parcels of land, and said lands are here-
by declared to be within the corporate limits of the City of Delray
Beach, Florida.
SECTION 3. That the tracts of land hereinabove described
are hereby dec~e---~e in Zoning District "C-2" General Commercial
District, as defined by existing ordinances of the City of Delray
Beach, Florida.
SECTION k_. In consideration of Petitionerts consent to
annexation as-~bo~e ~'~et forth, and since municipal services will not
accrue to said lands until such time as developement is undertaken,
said lands shall be liable for municipal ad-valorem taxes, as follows:
That said properties shall be taxed on an acreage
basis to petitioners so long as they remain unim-
proved, however, as any portion of said lands be-
come improved, which shall include all lands being
utilized in any manner with relation to' improved
areas, such lands shall be subject to normal
taxation, including the bonded indebtedness of
the City of Delray Beach, Florida.
SECTION 5. That the lands hereinabove described shall
immediately b~Ject to all of the franchises, ~privileges,
i~2nunities, debts (including the existing bonded indebtedness), ob-
ligations, liabilities, ordinances and laws to which lands in the
City of Delray Beach are now or may be, except as otherwise provided
and set forth in Section $ above, and persons, if any, residing there-
on shall be deemed citizens of the City of Delray Beach.
_S~E~C~T~IO~N 6_. That if any word, phrase, clause, sentence or
part of this ordinance shall be declare8 illegal by a court of com~e-
tent Jurisdiction, such record of illegality shall in. no way affect
the remaining portion.
