RESOLUTION NO. 53-00: Approve a resolution vacating and

based upon positive findings.
FINAL PLAT APPROVAL/SWINTON PLACE: Approve the final
subdivision plat for Swinton Place, a proposed 19 unit
townhouse development. The subject property is located on the
east side of South Swinton Avenue at the S.W. 7th Street
intersection, and is zoned RM (Multiple Family
Residential-Medium Density).
FINAL PLAT APPROVAL/THE COURTYARDS OF DELRAY: Approve the
final subdivision plat for The Courtyards of Delray, a
proposed 32 unit townhouse development. The subject property
is located on the north side of S.E. 1st Street between S.E.
5th Avenue (southbound Federal Highway) and S.E. 6th Avenue
(northbound Federal Highway). It is zoned CBD (Central
Business District).
ACCEPTANCE OF EASEMENT DEEDS (S.W. 2ND COURT): Accept two
easement deeds which grant to the City a six (6) foot sidewalk
and utility easement along S.W. 2nd Court (Lot 6 & Lot 8,
Carver Square). The easements are necessary to accommodate

sidewalk in conjunction with the S.W. 8th Avenue/S.W. 4th

ACCEPTANCE OF EASEMENT DEEDS (N.W. 4TH STREET): Accept four
easement deeds which grant to the City a ten (10) foot utility
easement along the south side of four properties on N.W. 4th
Street. The easements are needed for future maintenance of the
improvements constructed in conjunction with the NW Area
Infrastructure Improvements project.
ACCEPTANCE OF GRANT AWARD FOR POMPEY PARK PLAYGROUND: Approve
and accept a grant award in the amount of

RESOLUTION NO. 52-00 (HIGHWAY LIGHTING AND GENERAL MAINTENANCE
AGREEMENT): Approve a resolution authorizing an agreement
between the City and the Florida Department of Transportation
for the installation, construction and maintenance of lighting
along the approaches to the Atlantic Avenue bridge as well as
the construction and maintenance of a pedestrian walkway
underneath the west side of the bridge.
J. FUNDING SUBSIDY UNDER THE DELRAY BEACH RENAISSANCE PROGRAM:
Approve a funding subsidy in the amount of $20,250.00 for an
income eligible applicant under the Delray Beach Renaissance
Program, with funding from 118-1924-554-83.01 (SHIP Program),
representing the 108th homeownership assistance grant provided
through the program to-date.
RESOLUTION NO. 50-00: Approve a resolution assessing costs
for action necessary to abate nuisances on twenty {20)
properties throughout the City.
REVIEW OF APPEALABLE LAND DEVELOPMENT BOARD ACTIONS: Accept
the actions and decisions made by the Land Development Boards
for the period June 19th through July 7, 2000.
AWARD OF BIDS AND CONTRACTS:

WHEREAS, in the year 2000, the month of September is declared National Prostate
Cancer Awareness Month; and
WHEREAS, in the year 2000, approximately 180,000 men in the United States will learn
that they have prostate cancer and, across the nation, prostate cancer is the most commonly
diagnosed nonskin cancer in men; and
WHEREAS, epproxin~ately 32,000 men will lose their lives to this disease this year, and
one in six men in the nation are at risk of developing prostate cancer during their lifetimes; and
WHEREAS, in the year 2000, in Florida, approfunately 13,700 men will be diagnosed
with prostate cancer, and it is estimated that 2,400 will die fi.om it; and
WHEREAS, about 25 percent of prostate cancer occurs in men under the age of 65,
during their prime years at work; and
WHEREAS, at any age, prostate cancer devastates families, through loss of income,
partnership and support; and
WHEREAS, prostate cancer leaves too many parents, women, children and other family
members without a man they love; and
WHEREAS, African American families are disproportionately affected, and Afi'ican
American men have the highest prostate cancer incidence and mortality rotes in the world; and
WHEREAS, prostate cancer has accounted, on average, for 15 percent of the nation's
cancer burden and 15 percent of male cancer deaths, it has received, on average, only about 5
percent of the funds this nation commits annually to cancer research; and
WHEREAS, research suggests that men could reduce their risk of prostate cancer
mortality if they followed recommended prostate cancer screening guidelines, including
examination by a health care provider; and
WHEREAS, increased awareness and use of easly detection practices by men is essential
to controlling prostate cancer.
NOW, THEREFORE, 1, DAVID W. SCHMIDT, Mayor of the City of Delmy Beach,
Florida, on behalf of the City Commission, do hereby proclaim September 2000 as
PROSTATE CANCER AWARENESS MONTH
in Delray Beach, Florida and urge all men to become aware of their own risks of prostate cancer,

The request involves abandoning the 50' x 230' portion of SE 7t~ Street right-of-way, located between S.
Swinton Avenue and the Florida East Coast (FEC) Railroad. The subject abandonment area contains
11,751 square feet (0.27 acres), and was dedicated by the Replat of Part of Lots 2 and 3, Block 1, Model
Land Company's Subdivision of the West Half of Sec. 21, Twp., 46 S., RGE, 43 E. (Plat Book 26, Page
113, of the Public Records of Palm Beach County, Florida).
The abandonment request was submitted by the owner of adjacent Lots 11, 12, 14, and 15 of the
aforementioned plat, who plans to aggregate the four lots, in addition to Lot 10 (not directly adjacent to
abandonment area), and construct 19 fee-simple townhouses on the site, to be known as Swinton Place.
The Swinton Place development received site plan approval on December 1, 2000. Final plat approval is
also scheduled for the City Commission Meeting of July 11, 2000.
Currently, the proposed abandonment area is unimproved, with the remnants of an east-west shell rock
drive located approximately in the middle of the parcel. The Environmental Services Department (ESD)
identified a municipal water main in the proposed abandonment area. ESD also identified the need for an
access easement to the City well site, located adjacent to the northeast corner of the abandonment area.
Florida Power & Light and BellSouth have also identified facilities in the subject area. The utilities will
remain in their present location, and the necessary utility easements have been satisfactorily addressed
through the concurrent plat submission.
PLANNING AND ZONING BOARD CONSIDERATION
At its meeting of October 18, 1999, the Planning and Zoning Board considered the request at a public
headng. There was no public comment concerning the proposed abandonment. After reviewing the staff
report and discussion, the Board voted 7 to 0 to recommend approval, with the conditions that: 1. The
disposition of all utilities is satisfactorily addressed through the provision of replacement utility easements;
2. That a 24' wide access easement is provided from Swinton Avenue to the City well site; and, 3.
Recordation of a plat that clearly identifies the required easements. All of these conditions have been
satisfactorily addressed.
By motion, approve the abandonment of right-of-way based upon positive findings with respect to LDR
Section 2.4.6(0)(5).

The item before the Board is that of making a recommendation to the City
Commission on the proposed abandonment of a portion of the S.E. 7th Street
right-of-way (ROW), lying between South Swinton Avenue and the Florida East
Coast Railroad (FEC RR).
This right-of-way abandonment is being processed pursuant to LDR Section
2.4.6(0), Abandonment of Rights-of-Way.
The subject portion of S.E. 7th Street is located between South Swinton Avenue
and the FEC RR, approximately 1500 feet north of S.W. 10th Street. This portion
of S.E. 7t~ Street was dedicated with the recordation of the Replat of Part of Lots
2 and 3, Block 1, Model Land Company's Subdivision of the West Half of Sec.
21, Twp., 46 S., RGE, 43 E. (Plat Book 26, Page 113, of the Public Records of
Palm Beach County, Florida), in August of 1959.
Currently the subject parcel is unimproved, with the remnants of an east-west
shell rock drive located approximately in the middle of the pamel.
The portion of S.E. 7th Street to be abandoned measures 50 feet in width and
230 feet in length, containing 11,751 square feet (0.27 acres). The parcel is
irregularly shaped because the eastern boundary (FEC RR ROW) intemects at a
slight angle, creating a longer north line than the south line. In addition, the north
and south lines of the S.E. 7th Street ROW are not perpendicular to the west
right-of-way line of Swinton Avenue, but instead meet by rounded comers.
A City well is located on a small pamel (15'x15') above the northeast comer of
the subject right-of-way (adjacent to the FEC RR ROW). The only access to this
parcel is the unimproved S.E. 7th Street right-of-way.

The abandonment request was submitted by the owner of adjacent Lots 11, 12,
14, and 15 of the aforementioned plat, who plans to aggregate the four lots, in
addition to Lot 10 (not directly adjacent to abandonment area), and construct 19
fee-simple townhouses on the site. The total site area for the proposed
development is 2.08 acres, and is to be known as Swinton Place. The applicant
has concurrently submitted for site plan and plat approval for the intended
project.
Pursuant to LDR Section 2.4.6(O)(1), public right-of-way may be abandoned
(returned) to the adjacent property to the same degree in which it was originally
obtained, £e. property dedicated exclusively from a single parcel shall be
returned to that parcel; property dedicated through subdivision shall be divided at
the center line and returned equally to abutting parcels.
The applicant is entitled to the entirety of the subject abandonment, as he is the
fee simple owner of all adjacent parcels (Lots 11,12, 14, and 15) from the plat
that created the ROW. Although the City well parcel is directly adjacent to the
abandonment area, it is not part of the plat which dedicated the subject right-of-
way, therefore none of the ROW will revert back to this parcel.
Utility Services
The Environmental Services Department has identified a raw water main, which
runs from the adjacent City well site to Swinton Avenue, through the
abandonment area. The Department has requested a 12-foot replacement
easement over the existing water main, and a 24-foot access easement from
Swinton Avenue to the City well site. In addition, no trees or structures would be
allowed in the above-described easements. The applicant has agreed to make
both easement areas functions in concert with the proposed development as
either parking areas or ingress/egress lanes. The granting of said easements
through the concurrent site plan and plat applications will be conditions of
approval for this abandonment.
Flodda Power & Light (FPL) has identified distribution facilities located along the
south and east sides of the abandonment area. FPL has requested 10'
replacement easements over their existing improvements, or relocation at the
applicants' expense. Satisfactory disposition of these utilities will be a condition
of approval of this abandonment
BellSouth has identified underground utilities that run in a north-south direction,
approximately through the middle of the site. The subject utilities extend from a
10' utility easement located along the west side of Lot 14, south through the S.E.
7th Street right-of-way, and continue through an additional 10' easement along
Lots 11 and 15 (8 feet on the east side of Lot 11, and 2 feet on the west side of
Lot 15). BellSouth is requesting a 10' replacement easement that will connect

the two existing easements. The establishment of the requested easement is
reflected in the current site plan submission, and will also be addressed in the
subsequent plat application. Satisfactory disposition of these utilities, via the
aforementioned approvals, will be a condition of approval of this abandonment.
The City's Fire Department has reviewed the request and has no objection to the
abandonment. Adelphia Cable and the Florida Public Utilities Company have
also reviewed the requested abandonment, and have no objections.
Pursuant to LDR Section 2.4.6(O)(5), prior to any right-of-way abandonment
being approved, the following findings must be made:
A) That there is not, nor will there be a need for the use of the right, of. way
for any public purpose.
Currently, the right-of-way is unimproved, and there are no plans to improve it
in the future. Florida Power & Light, BellSouth, and the City's Environmental
Services Department have all identified existing utilities in the subject right-of-
way. The continuation of the identified utility services can be accommodated
through the dedication of replacement easements and/or relocation of
facilities.
B) That the abandonment does not, nor will not, prevent access to a lot of
record.
The abandonment area will prevent access to Lots 14, 15, and the City well
site. Lots 14 & 15 are owned by the applicant and are to be aggregated into
the proposed development of Swinton Place. Continued access to the City
well site will be accommodated through the granting of a 24' access
easement. The recordation of the concurrent plat, which will address all
access issues, will be a condition of approval for this abandonment.
C) That the abandonment will not result in detriment to the provision of
access and/or utility services to adjacent properties or the general area.
All utility services currently located in the subject right-of-way will be
addressed through the granting of replacement easements, or relocated so
that they will provide the same or better services to the adjacent lots. This
will be a condition of approval for this abandonment.

The development proposal is within the geographical area requiring review by the
CRA (Community Redevelopment Agency). The CRA considered this
abandonment at its September 2nd meeting, and recommended approval.
The development proposal is not within a geographical area requiring review by
the HPB (Historic Preservation Board), or the DDA (Downtown Development
Authority). '

This is before the Comn'nssion to approve the final subdivision plat for Swinton Place, a proposed 19
unit townhouse development to be located on the east side of South Swinton Avenue at the S.W. 7e~
Street intersection. The property is zoned RM (]Multiple Family Residential-Medium Density) and
contains 2.07 acres.
The development proposal involves construction of 19 three-bedroom, fee simple townhouse units in
four separate buildings, provision of recreational facilities including playground/picnic area, and
associated parking lot areas. It incorporates the area of S.E. 7~h Street abandoned by Resolution No.
53-00. The Site Plan Review and Appearance Board approved the development plans in December,
1999. A plat was required as a condition of approval.
On April 17, 2000, the Planning and Zoning Board approved the prelim/nary plat and certified the
final plat based upon positive findings with respect to LDR Sections 3.1.1, 3.2.3 and Objectives and
Policies of the Comprehensive Plan, and subject to technical conditions. All technical and staff
comments have been addressed and the plat is ready for approval.

proposed 32 unit townhouse development to be located on the north side of S.E. Ist Street between
S.E. 5th Avenue (southbound Federal Highway) and S.E. 6th Avenue (northbound Federal Highway).
The property is zoned CBD (Central Business District) and contains 1.06 acres. A north/south alley
divides the site.
The development proposal involves construction of 32 three-story, two bedroom townhouse units.
Twelve (12) townhomes are to be built on the east side of the alley, with twenty (20) units being built
on the west side of the alley. The townhouses will be fee simple units. Three common areas will
accommodate parking courts including guest parking, open space courtyards, and a recreation tract
with a pool and deck.
On June 19, 2000, the Planning and Zoning Board approved the preliminary plat and certified the
final plat based upon positive findings with respect to LDR Sections 3.1.1, 3.2.3 and Objec6ves and
Policies of the Comprehensive Plan, and subject to techmcal conditions. All technical and staff
comments have been addressed and the plat is ready for approval.

This item is before the Commission to accept four (4) easement deeds from properties on N.W. 4t~
Street associated with the recent infrastructure improvements. The deeds convey a ten foot utility

The Northwest Area Infrastructure Improvements project consisted of water service upgrades,
construction of drainage facilities and roadway improvements. Construction of the project is
complete. The easement is needed for future maintenance of the improvements.

The Parks and Recreation Department has received notification that we were successful in our
application for grant funding to assist with the replacement of playground equipment at Pompey Park.
A grant in the amount of $50,000.00 has been approved for the City through the 2000/01 Florida
Recreation Development Assistance Program (FRDAP).
This will be a reimbursement-type grant in that the City funded the project up front through our
capital improvement program so that the upgrades to the playground xvould not be delayed. The total
cost of the project was $58,955.00. The playground is complete.
Recommend acceptance of the FRDAP grant in the amount of $50,000.00 for the Pompey Park
playground.

Per attached 6/14/00 letter from Magellan's Account Executive, a renewal insurance rate equal to the
expidng rate is proposed.
At last year's renewal, we received only a 2% rate increase, from $3.55 to $3.62 per employee per
month. Utilization reports provided by the Magellan indicate that the City is using the counseling
services twice as much, or more, as their overall norm.
I recommend that the City renew with Magellan for the 10/1/00-01 policy year at no increase in cost.

Magellan Behavioral Health is committed to providing the highest
quality of mental health and substance abuse care and service to
plan participants, while achieving effective control of care costs.
We are pleased to offer Magellan Behavioral Health's Employee
Assistance Program (EAP) to the City of Delray Beach at the
following renewal rate:

The monthly renewal rate for the EAP includes access 24 hours a
day every day of the year, up to eight assessment and problem
resolution sessions, referral, crisis intervention, supervisory
consulting services, legal services, standard customer reports, and
Magellan Behavioral Health's standard comprehensive
communications package.
Other Fees
Occasionally, a client requests services not included in the standard
Magellan Behavioral Health Package· Special reports and requests
for information which would require extra computer programming
time, special documentation, or additional administrative input are
addressed at the time the request is made.
Financial
Assumptions
· The renewal rate quoted for the voluntary EAP is valid for 90
days from the date presented, for the proposed 12-month
contract period of October 1, 2000 through September 30,
2001.
· The renewal rate quoted assumes a covered employee
population of 692 employees, with a standard enrollment
variation range of 10%.
Employee/supervisor orientations or training events are
available at $125 per hour (plus nonlocal travel expenses and
special instmctional material, if any).
· Critical incident debriefing (CID) services provided at the work
place are charged at $190 per hour (plus nonlocal travel
expenses). If services are ordered and then subsequently

canceled without a minimum of a 24-hour notice, The City of
Delray Beach will be billed for the ordered services as if they
had been delivered.
· The rate quoted includes Magellan Behavioral Health's
comprehensive EAP communications package. Additional
communications materials or required text changes to Magellan
Behavioral Health's standard communications materials may
be available on a fee-for-service basis.
· The renewal rate quoted includes Magellan Behavioral Health's
standard semi-annual EAP utilization reports on an aggregate
basis. If more frequent reports, or reports for additional
locations/divisions are desired, they will be charged on a fee-
for-service basis depending on requested services. A minimum
of 250 employees is required to provide location-specific
reports due to confidentiality concerns.
· The renewal rate quoted assumes that the medical plan
coverage for behavioral health benefits does not require access
to the EAP in order to obtain an enhanced behavioral health
benefit.
· The EAP rate assumes that the City of Delray Beach will not
make significant changes to its mandatory/random drug testing
program. Furthermore, the renewal rate quoted does not
assume the costs associated with DOT or other regulatory drug
testing requiring aftercare monitoring. Magellan Behavioral
Health reserves the right to adjust the rate accordingly if such a
program exists or if significant changes are made to the
existing program.

Enclosed is a copy of an agreement and resolution for the installation and construction of
lighting along the approaches to the Atlantic Avenue bascule bridge as well as the
construction of a pedestrian walkway underneath the west side of the bridge. The
Agreement provides that the City shall provide 4 decorative light poles and fixtures. The
Agreement further provides that the City shall have the obligation to maintain these light
poles and fixtures as well as underdeck lighting, pedestrian sidewalks or walkways and
sod that will all be installed by FDOT's contractor. The City will assume the
maintenance responsibilities once the construction is completed.

WHEREAS, the State of Florida Deparunent of Transportation (Deparunent), is constructing or
reconstructing a portion of the lighting system from the east approach to the west approach of the bascule
bridge on Atlantic Avenue, which shall call for the relocation or installation of Highway lighting
facilities along Atlantic Avenue; and,
WHEREAS, the City shall furnish certain decorative light poles and fixtures for this project and
shall maintain the light poles and fixtures as well as certain other underdeck lighting .and pedestrian
walkways in accordance the terms of the Highway Lighting and General Maintenance Agreement; and,
WHEREAS, the City Commission of the City of Delray Beach, Florida desires to enter into the
Agreement, hereby approves the Agreement, and authorizes the execution thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:

AND WHEREAS, the DEPARTMENT is constructing, reconstructing or otherwise changing a portion of the lighting
system designated by the DEPARTMENT as Job No. 93030-6512 , Road No. 806 from Atlantic Avenue cas'
approach of Bascule Bridge to west approach of Baseule Bridge , which shall call for the adjustment, relocation and/or
installation of Highway Lighting facilities along said highway,
AND WHEREAS, the DEPARTMENT and the CITY have determined that it would be to the best interest of the
general public and to the economic advantage of both parties to enter into a JOINT PROJECT providing for such work,
NOW, THEREFORE, the premises considered, and in consideration of the sum of One Dollar each to the other in
hand paid, the receipt whereof is hereby acknowledged, and in further consideration of the mutual covenants hereinafter
contained, it is agreed by the parties as follows:
1. The DEPARTMENT agrees to prepare plans and specifications for the work involved, and advertise for bids
for the equipment and materials. The decision as to the type and make of equipment purchased will be the DEPARTMENT's
sole responsibility. The CITY will proxtide 4 decorative light poles and fixtures to be installed by the FDOT contractor.
2. All of the work on the lighting system is to be done according to the plans and specifications of the
DEPARTMENT which plans and specifications are, by reference hereto, made a part hereof. The DEPARTMENT will be
responsible for performing the completed installation. The FDOT is responsible for constructing the underdeck lighting, the
sidewalk/pedestrian facility and installing sod on the embankment.

3. The DEPARTMENT will provide the necessary engineering supervision to assure construction is in
compliance with the plans and specifications hereinabove referred to, and will perform the final inspection of the completed
project.
4. The CITY agrees that the equipment of the lighting system shall remain the property of the DEPARTMENT,
and it is hereby understood and agreed that the CITY shall not, under any condition, remove the equipment which is the
subject matter of this Agreement for any reason without permission and written consent of the DEPARTMENT.
5. The CITY further agrees upon completion of the installation, to assume sole responsibility for the
maintenance of said lighting system in accordance with the DEPARTMENT's policies and "Standard Specifications for
Highway Lighting", newly installed turf (sod), and underdeck lighting as well as maintaining the walkway under the west
side of the bridge.
6. The CITY further agrees to be responsible for the payment of all cost for electrical power and/or other
electrical charges incurred in connection with the operation of the completed lighting system.
7. To the extent permitted by law, the CITY shall indemnify, defend, save harmless and exonerate the FDOT,
its officers, agents and employees from all liability, claim, loss, damage, cost charge, expense and demand~ arising our of
~he Utility Work due in whole or in part to conditions, actions, or omissions done or committed by the CITY, or its

Delray Beach Renaissance Program Subsidy Request
ITEM BEFORE THE COMMISSION
City Commission authorization and approval to issue a subsidy to one eligible applicant under
the Delray Beach Renaissance Program. The subsidy represents the 108th homeowuership
assistance grant provided under the City Renaissance Program to date.
BACKGROUND
The Delray Beach Renaissance Program Memorandum of Understanding was approved by the
City Commission on January 23, 1996. In parmership with the Delray Beach Community
Development Corporation, the TED Center, the Community Redevelopment Agency, the
Community Financing Consortium, the Federal Home Loan Bank of Atlanta and the Delray
Beach Housing Authority, we are committed to providing homeownership opportunities to 80
homebuyers through new construction and acquisition rehab beginning October 1, 1995 through
September 30, 1998. An agreement to extend the program for one additional year was approved
by all partners and the City Commission. On June 15, 1999, the City Commission approved a
new Memorandum of Understanding operating the Renaissance Program from March 1999 to
February 2001.
Each potential homebuyer is required to attend a homebuyer's seminar sponsored by the
Community Financing Consortium, Inc., the Renaissance Program's partner and first mortgage
lender. The seminar includes training and information on financial planning, credit and
borrowing, budgeting, fair housing issues, mortgage and closing costs and a comprehensive
glossary of real estate terms.
The Grant is secured by a Promissory Note/Second Mortgage approved by the City Attorney and
requires the applicant to maintain ownership/residence for a specified period according to the
amount of the Grant. Grant amounts less than $15,000 per unit are forgiven at a rate of 20% per
year for a period of five (5) years and Grant amounts equal to or greater than $15,000 but less
than $25,000 per unit are forgiven at a rate of 10% per year for ten (10) years.

against the parcel(s) of land described in said report and in the amount(s) indicated
thereon. Said assessments el levied shall, if not paid within thirty (30) days after
mailing of the notice described in Sec. 3, become a lien upon the respective lots and
parcel(s) of land described in said report, of the same nature and to the same extent
as the lien for general city taxes and shall he collectible in the same manner as
mortgages and foreclosures are under state law.
Section 2. That such assessments shall be legal, valid and binding
obligations upon the property against which said assessments are levied.
Section 3. That the City Clerk of the City of Delr&y Beach is hereby
directed to immediately mail by first class mail to the owner(s) of the property, as
such ownership appears upon the records of the County Tax Assessor, notice(s) that the
City Commission of the City of Delr&y Beach on the has
levied an assessment against said property for the cost of abatement of said nuisance
by the City, and that enid assessment is due and payable within thirty (30) days after
the mailing date of laid notice of assessment, after which e lien shall be placed on
laid property, and interest will accrue at the rate of 8% per s--um, plus reasonable

The action requested of the City Commission is that of review of appealable actions

This is the method of informing the City Commission of the land use actions, taken by
designated Boards, which may be appealed by the City Commission. After this meeting,
the appeal period shall expire (unless the 10 day minimum has not occurred).
Section 2.4.7(E) of the LDRs applies. In summary, it provides that the City Commission
hears appeals of actions taken by an approving Board. It also provides that the City
Commission may file an appeal. To do so:
1. The item must be raised by a Commission member.
2. By motion, an action must be taken to place the item on the next meeting of
the Commission as an appealed item.
A. Approved on a 6 to 0 vote (Carter absent), a conditional use modification request to
add 4,700 square feet to the approved floor area forStorage America, a proposed

Contract award in the amount of $218,366.00 to Insituform Technologies, Inc., via existing
Broward County contract, for trenchless rehabilitation of several segments of gravity sewer
systems associated with the 2000 Roadway Bond projects, with funding from 442-5178-536-
63.51 (Water & Sewer R&R --Sewer Mains).
Ratification of an emergency purchase award in the amount of $16,690 to H.T.E., sole source
vendor, for the purchase of Special Assessments software, with funding from 334-3162-541-
62.54 (General Capital/Seacrest-Del-Ida Improvements).
Purchase award in the amount of $13,275.08 to ESI International, Inc., via State Negotiated
Agreement Price Schedule (SNAPS), for the purchase of a three-phase Uninterrupted Power
Supply (UPS) to replace the current one-phase UPS system (purchased in 1992) in the MIS
main computer room. The price reflects the City's acceptance of vendor's offer to drop
installation charge of $680 in trade for the current one-phase UPS system. Funding will be
from 334-6112-519-64.12 (General Capital R&R Office Equipment).
Renewal of annual maintenance contract with U.S. Filter/Davis Process Products, sole source
provider, for wet scrubber units located at sewage lift stations 1 and 11 in the total amount of
$21,480.00, with funding from 441-5144-536-52.21 (W&S Lift Station Maintenance -
Chemicals).
Recommend approval of the bid and contract awards listed above.

Rehabilitation of Gravity Sewer Systems
2000 Roadway Bond Projects
Attached is an Agenda Request and supporting documentation for award of a contract to
Insituform Technologies, Inc. for trenchless sanitary sewer rehabilitation utilizing an existing
Bmward County Contract. The gravity sewer systems highlighted on the attached sheets are
within the overlay areas of the bond projects. These systems have been reviewed by our
surveillance crew and found to have significant inflow and infiltration into the pipes. There are also
several areas with major root intrusion and service lateral damage. By using trenchless
technology to rehabilitate the 4,257 L.F. of sewer mains, there will be minimal disruption to the
neighborhood and minor restoration required. The total amount of this contract is $218,366.00
and funding is available from R&R Account # 442-5178-536.63.51 Sewer Mains.
Please place this item on the July 11, 2000 Agenda for consideration by City Commission.

trenchless sanitary sewer rehabilitation utilizing an existing Broward
County Contract. Several segments of the gravity sewer systems
associated with the 2000 Roadway Bond Projects, have been reviewed by
our surveillance crew and found to have significant inflow and
infiltration into the pipes. There are also several areas with major
root intrusion and service lateral damage. By using trenchless
technology to rehabilitate the 4,257 L.F. of sewer mains, there will be
minimal disruption to the neighborhood and minor restoration required.
The total amount of this contract is $218,366.00 and funding is
available from R&R Account # 442-5178-536.63.51 Sewer Mains.

Ratification of Emergency Pumhase of Special Assessments Software

The City is currently involved in a rather large special assessment project in the SeacrestJDel Ida
Neighborhood project. This special assessment project could involve over 800 individual parcels
or owners to be assessed. Each of these owners would have a right to prepay their assessment
or pay their assessment over a period of time. In essence, the special assessment software
would do the following:
· Prepares the individual and total assessment costs based upon user defined units of
calculation.
· Prepares the "Assessment Master Report" which provides location information and
assessment information on the entire project,
· Prepares/prints loans and amortization schedules for all selected locations attached to an
approved assessment.
· Prepares amortization schedules that are sent to customers.
· Prepares automatic invoicing when payments are due.
This software should be of assistance not only to the Finance Department in the calculation of
individual loan amortization schedules and reports, but to the Engineering Division and City
Clerk's Office in the initial preparation of the assessment rolls. The alternative to this software is
that Finance would have to manually prepare individual amortization schedules and reports which
would be extremely difficult and time consuming for such a large project,
We attended a demo on this package and see this package as our only alternative to a labor-
intensive manual effort especially if the City plans on continuing special assessment projects in
the future.
This H.T.E. package interfaces with the City's existing H.T.E. software packages. HT.E would
only hold the current cost of this software package ($16,960) until June 30th, at which time the
pdce would increase. We, therefore, requested and received your approval to purchase this
software as an "emergency purchase" (reference P.O. #587459).
We would request that Commission ratification of this emergency purchase of the H.T.E. Special
Assessments software in the amount of $16,960 be placed on the City Commission Agenda of
July 11, 2000. Funding is available in 334-3162-541-62.54, SeacrestJDel Ida Improvement
Project Number 99-006.

Replacement of MIS UPS

Last year, we requested adding the air conditioner in the MIS Main Computer Room to the City's
back-up generator. This request was made so that we can maintain computer operations during
long-term power outages (as may be caused during emergency or hurricane conditions). The
computer equipment (i.e., AS/400, network servers, etc.) in the MIS Main Computer Room is
currently on the City's back-up generator. However, without air conditioning during long-term
power outages, the systems would have to be shut down to avoid over-heating and damage
(crashing).
Public Works requested Thompson Engineering Consultants review our electrical system to
determine whether or not this would be possible and/or what would be required in order to get our
Main Computer Room air conditioner on the City's back-up generator. Thompson Engineering's
review revealed that there is an electrical imbalance in our Main Computer Room which must be
corrected before the air conditioner could be added to the generator. The electrical imbalance is
being caused by our current one-phase Uninterruptible Power Supply (UPS) being wired to a
three-phase power supply. They added that the existing UPS and associated wiring does not
comply with electrical code. In order to correct this imbalance, we need to replace our current
one-phase UPS with a three-phase UPS.
ESI International, Inc., can replace our current one-phase UPS with a three-phase UPS for a total
cost of $13,275.08. This pumhase is being made from SNAPS Agreement #2851798-1. This
price reflects our acceptance of the vendor's offer to drop the installation fee of $680 in trade for
our current one-phase UPS system.
We would request this item be placed on the City Commission Agenda of July 11, 2000 for
approval. Funding is available in 334-6112-519-64.12.

The City Commission is requested to renew the annual maintenance contract with U.S.
Filter/Davis Process Products for wet scrubbers located at Lift Stations 1 and 11 for a
total amount of $21,480.
BACKGROUND:
U.S. Filter/Davis Process Products is the current vendor for the annual maintenance
contract for the wet scrubber units located at sewage Lift Stations 1 and 11. The current
contract, at the rate $850 per month, expires on September 30, 2000. The proposed
renewal contract includes a cost increase of $45 per month per unit to cover the
increased cost of chemicals provided under the contract for a revised unit price of $895
per month per unit. See the attached proposal from U.S. Filter/Davis Process Products
dated June 26, 2000.
This scrubber equipment was supplied and installed by Davis Water & Waste as part of
the Master Booster Pump Station project, therefore, it is beneficial to the City to renew
this maintenance contract on a sole source basis.
The Deputy Director of Public Utilities recommends the one-year renewal with U.S.
Filter/Davis Process products for a total annual cost of $21,480. This is based on $895
per unit per month for Lift Stations 1 and 11. See the attached memo from the Deputy
Director of Public Utilities dated June 28, 2000.
RECOMMENDATIONS:
The Purchasing staff recommends the one-year renewal for the maintenance contract
for wet scrubbers located at sewage lift stations I and 11 for a total amount of $21,480.

The conditional use request is to establish a car wash facility that contains an automatic/mechanical
system and hand detailing operation for Victory Car Wash. The development proposal includes the
demolition of the existing improvements on the site; construction of a 2,050 sq.ft, mechanical wash
facility, 750 sq.ft, office/store, 900 sq.ft, covered detailing area and 375 sq.ft, covered waiting area. In
addition, the development proposal includes improvement of the alley located along the west property
line, installation of 6 back-out parking spaces, and a dumpster enclosure. Additional background and an
analysis of the request are found in the attached Planning and Zoning Board Staff Report.
At its meeting of June 19, 2000, the Planning and Zoning Board held a public hearing in conjunction with
the request. Several members from the public spoke in favor of the development proposal and the
property owner to the south voiced concerns over the potential noise and requested that appropriate
buffering be provided. After reviewing the staff report and discussing the proposal, the Board voted 6-0
(Carter absent) to recommend approval of the Conditional Use request, based upon positive findings with
respect to Chapter 3 (Performance Standards) and Section 2.4.5(E)(5) of the Land Development
Regulations, and policies of the Comprehensive Plan subject to the following revised conditions of
approval:
1. That a Class V site plan be processed that is in general conformance with the sketch plan and
addresses the items of concerns listed in the staff report;
2. That the hours of operation be limited to 8:00 am to 6:00 p.m., Monday through Saturday;
3. That a hedge 36" in height at the time of planting be installed along the south property line, as well
as, shade trees 14' to 16' in height;
4. That a 5' right-of-way dedication be provided along the north property line for SE 7th Street;
5. That the parking spaces on the west side of the property be shifted to the north and the dumpster
moved to the south end of the property; and,
8. That a 6' high painted solid fence be installed along the south property line from a point
approximately 30' west of Federal Highway to a point approximately 30' east of the alley, so that il
buffers the residential property but does not block visibility to the alleyway or Federal Highway.
By motion, approve the Conditional Use request to establish a car wash facility for Victory Car Wash,
based upon positive findings with respect to Chapter 3 (Performance Standards), Section 2.4.5(E)(5) of
the Land Development Regulations, and the policies of the Comprehensive Plan, and subject to the
conditions recommended by the Planning and Zoning Board.

The action before the Board is making a recommendation to the City
Commission on a Conditional Use request to establish a car wash facility
for Victory Car Wash, pursuant to Section 2.4.5(E).
The subject property is located at 710 SE 5th Avenue, which is at the
southwest corner of SE 5th Avenue (Federal Highway) and SE 7th Street.
The subject property is zoned GC (General Commercial) and involves lots 16 through
19, Block 13, Osceola Park containing approximately 0.59 acres.
According to the Palm Beach County Property Appraiser records, the property was
developed in 1964 as a gas station. There have been few changes to the subject
property since then. In 1993, the site was subject to the citywide landscape code
compliance efforts. The previous use of the property was a retail automobile parts
business (ie lights, stereo and security products) known as Finish Line Custom Car.
The occupational license for this use expired in September 1998.
At its meeting of November 16, 1999, the City Commission approved a Conditional Use
request to establish a sales and service facility for personal watercraft (waverunners, jet
skis) for a project to the known as Jet Ski Station. However, that project never
materialized. Victory Car Wash wishes to establish a car wash facility on the subject
property, which is the request before the Board.
The conditional use request is to establish a car wash facility that contains an
automatic/mechanical system and hand detailing operation for Victory Car Wash. The
development proposal includes the following:

pass lane from the vacuum area, 6 parking spaces that back-out onto the alley, and
access to the dumpster enclosure; and

facility.
The hours of operation will be 8:00 a.m. to 6:00 p.m., Monday through Saturday. There
will be ten employees for interior and exterior detailing and one cashier.
CHAPTER 3 (REQUIRED FINDINGS): (Performance Standards - L.O.S.)
Pursuant to Section 3.1.1 (Required Findings) of the Land Development
Regulations, prior to approval of development applications, certain findings must
be made in a form which is part of the official record. This may be achieved
through information on the application, the staff report, or minutes. Findings
shall be made by the body that has the authority to approve or deny the
development application. These findings relate to consistency with the Future
Land Use Map, Concurrency, Comprehensive Plan Consistency, and Compliance
with the Land Development Regulations.
FUTURE LAND USE MAP: The use or structures must be allowed in the zone
district and the zoning district must be consistent with the land use designation.
The subject property has a General Commercial Future Land Use Map and Zoning
District Map designation. The proposal is for a car wash establishment with an
automatic/mechanical system, which is permitted as a conditional use in the GC zone
district [ref. LDR Section 4.4.9(D)(14)]. Based upon the above, a positive finding can be
made with respect to consistency with the Future Land Use Map.
CONCURRENCY: Facilities which are provided by, or through, the City shall be
provided to new development concurrent with issuance of a Certificate of
Occupancy. These facilities shall be provided pursuant to levels of service
established within the Comprehensive Plan.
Water and Sewer:
To date no water and sewer plans have been submitted, however, the following is
noted:
Water and sewer service exists to the site via a service lateral connection to
existing 8" mains located within SE 7th Street right-of-way. No water or sewer
main extensions or upgrades will be required of this development.
Drainage:
Paving and drainage plans are not required for the conditional use analysis. Drainage
can be accommodated with sheet flow into sodded swale areas and/or an ex'filtration

must be provided with submittal of the site plan, and positive findings with respect to this
level of service standard must be made at that time.
Streets and Traffic:
A traffic statement was submitted indicating that the proposed use as a car wash facility
will generate 166 average daily trips onto the surrounding roadway network and
complies with the Palm Beach County Traffic Pen~ormance Standards Ordinance. Based
upon the above, a positive finding with respect to traffic concurrency can be made.
Parks and Open Space:
Park dedication requirements do not apply for nonresidential uses. Thus, there will be
no impact on this level of service standard.
Solid Waste:
The proposal calls for a 2,770 sq.ft, car wash facility, which will generate 12.7 tons
[2,700 sq.ft, x 9.2 pounds/sq.ft/year = 25,484/2000 = 12.7 tons] of solid waste per year.
The trash generated by this proposal can be accommodated by existing facilities,
therefore, a positive finding with respect to this level of service standard can be made.
CONSISTENCY: Compliance with performance standards set forth in Chapter 3
and required findings in Section 2.4.5(E)($) for the Conditional Use request shall
be the basis upon which a finding of overall consistency is to be made. Other
objectives and policies found in the adopted Comprehensive Plan may be used in
making a finding of overall consistency.
A review of the objectives and policies of the adopted Comprehensive Plan was
conducted and the following applicable Objective and Policy were found.
Future Land Use Element Objective A-1 - Property shall be developed or
redeveloped in a manner so that the future use and intensity is appropriate and
complies in terms of soil, topographic, and other applicable physical
considerations, is complimentary to adjacent land uses, and fulfills remaining
land use needs.
The property is developed as a gas station (currently vacant) and few changes to the
site have been made over the years. The proposal calls for the demolition of the site for
redevelopment it as a car wash. There are no special physical or environmental
characteristics of the land that would be negatively impacted by the proposed car wash.
The development will be complimentary with the surrounding commercial
developments. There is a concern regarding the improvement of the alley and the
potential increase in traffic and noise generation that could affect the neighborhood
located to the west. This item is further discussed below. While the use as a car wash is
not identified as a remaining land use need, it does provide a service to motorists and
no other car wash facilities are located in this section of town.

Housing Policy A-12.3: In evaluating proposals for new development or
redevelopment, the City shall consider the effect that the proposal will have on
the stability of nearby neighborhoods. Factors such as noise, odors, dust, traffic
volumes and circulation patterns shall be reviewed in terms of their potential to
negatively impact the safety, habitability and stability of residential areas. If it is
determined that a proposed development will result in a degradation of any
neighborhood, the project shall be modified accordingly or denied.
The development proposal includes improving the alley from SE 7th Street to the
property's southern boundary that will be utilized for a by-pass Pane from the vacuum
area and back-out parking spaces. There is a concern noted with this newly created
traffic pattern as well as the potential noise from the vacuums and detailing area with
the residential uses located to the west and south. Wood shadow box fences and
landscaping exist along the rear property lines of the single family residential uses that
buffer them from the commercial site. While landscaping will be required to be installed
along the west property line of the commercial site, it may be appropriate to also require
a fence or wall. Compatibility with respect to buffering will be addressed in more detail
with the submittal of the site plan. It is also noted that a redevelopment plan is being
prepared for the Osceola Park neighborhood, and the issues of separating residential
and commercial uses will be addressed within that plan.
SECTION 2.4.5(E) REQUIRED FINDINGS: (Conditional Use)
Pursuant to Section 2.4.5(E)(5) (Findings), in addition to provisions of Chapter 3,
the City Commission must make findings that establishing the conditional use
will not:
A. Have a significantly detrimental effect upon the stability of the
neighborhood within which it will be located;
B. Nor that it will hinder development or redevelopment of nearby properties.
The Federal Highway corridor is comprised predominately of commercial uses. The
immediately adjacent uses are Dixie Motor Sales to the north, a duplex to the south,
the Nation's Bank/office building to the east, and single family to the west. The
proposed car wash establishment will not have an adverse effect on the commercial
properties to the north or east. Potential conflict with the adjacent residential uses to
the south and west is a concern as there will be some noise associated with the
outdoor component of the detailing and vacuum aspects of the business. The site
has been designed to orient the rear of the building along the west property line with
the parking and vehicular use areas to the east side of the site, which should help to
reduce the noise levels. Further, trees are required to be installed 25' on center to
form a solid tree line with a hedge 4 %' at the time of planting. It should also be
noted that a wood shadow box fence currently exists along the rear property lines of
the single family homes located to the west of the alley, which helps to buffer these
lots from the commercial use. The existing duplex to the south is located in the GC

zone district and is considered a nonconforming use. When this property is
redeveloped, it is reasonable to assume that a conversion to a commercial operation
will occur. However, in order to provide adequate buffering at this time in addition to
the trees being placed 25' on center, a hedge 4 ~' at the time of planting should also
be installed. This item has been attached as a condition of approval. Given the
above, the abutting single residential uses should be adequately buffered.
The previous businesses that occupied the site are similar in intensity as to the
proposed use. The impact on the surrounding neighborhood will therefore be similar
to the previous use and should not hinder new development of adjacent properties.
COMPLIANCE WITH LAND DEVELOPMENT REGULATIONS:
If the Conditional Use is approved, pursuant to LDR Section 2.4.5(E)(4) a site plan
submittal complying with the Land Development Regulations will be required
which addresses the concerns noted below.
Alley Improvements:
The alley is currently unimproved. The proposal will require that the alley be paved
from SE 7th Street to the property's southern boundary. Two utility poles and a
transformer box exist within the alley right-of-way that will need to be relocated with
these improvements. It is further noted that overhead power lines service the existing
building which will need to be undergrounded with this development proposal [REF:
Section 6.1.8].
Right-of-Way Dedication:
Per LDR Section 5.3.1 right-of-way dedications to meet minimum standards must be
made with all developments, unless a waiver is granted. Pursuant to LDR Section
5.3.1(D)(2), the required right-of-way width for SE 7th Street is 60' and 40' currently
exists. For existing streets where the right-of-way does not meet the minimums,
reductions may be granted by the City Engineer upon a favorable recommendation from
the Development Management Services Group (DSMG). The City Engineer and DSMG
have reviewed the request for a reduction in right-of-way width and have determined
that a 50' right-of-way width is sufficient for SE 7th Street, therefore a 5' dedication will
be required from this development and has been attached as a condition of approval.
The subject property is not in a geographical area requiring review by the DDA
(Downtown Development Authority) and HPB (Historic Preservation Board).

The CRA reviewed the Conditional Use request at its meeting of June 8th and
unanimously recommended approval of the use with a concern noted that the
residential uses located to the west are adequately buffered from the commercial site.

Dear Delray Beach City Management:
I am writing to propose an idea for development of a parcel of land located within city
limits. The undeveloped parcel is located just south of Atlantic BIvd and west of Military
Trail, behind the SouthTrust Bank Building and is approximately 9 acres in size (please
see map). It is currently referred to as the Assisted Living facility project (ALF) south of
Atlantic Blvd, West of Military Trail. I am writing to purpose the development of the tract
into a community park owned and operated by the city of Delray Beach. I understand
that the current development of the ALF project is stalled.
Recently there has been an increase in the amount of high-density multi-family land use
in the surrounding area. For example, the Enclave at Delray and The Fountains at
Delray have just completed construction and are now renting. In addition to these
developments, Country Club Acres and Sherwood Park provide increased population in
the area. The population of these developments does not currently have any community
park in the immediate vicinity. There is also a large amount of vacant office space in the
area which could see increase consumer interest if a community park was developed
thereby attracting the near-by population.
The tract of land is also an environmental beauty. There exists many native specimen
Slash Pine, Sable Palm and Palmetto. In addition, I have personally viewed numerous
Red Tailed Hawks, Red Bellied woodpeckers and Pileated woodpeckers. At night, I have
personally listened to native Owls in these woods.
I feel that development of this land into a community park would be a much better use of
the land then to allow more high-density living facilities to be developed in this beautiful
pine uplands area. I would like to find out how I can help further the cause and am
offering any help that I may provide. My neighbors in Breeze Acres are also willing to
provide any assistance they can.

The following information is being provided in response to the suggestion that the City purchase
the above referenced property for park purposes.
The property contains approximately 8.68 acres and was annexed on October 20, 1998 with the
RM-8 (Medium Density Residential - 8 units per acre) zoning designation. The property
currently has conditional use approval for an Assisted Living Facility (ALF) consisting of 316
units and 344 beds along with an adult day care facility limited to 20 patients. That proposal has
not been implemented, and the approval expires on December 20, 2000.
With the conditional use submittal in 1998, a biological assessment was submitted which is
attached for your information. The study stated that there was only one native habitat on the
site which varied from 20'-35' in width along the south property line, and consisted of a slash
pine canopy with palmetto ground cover. The assessment stated that there were no threatened
or endangered species observed on the site at the time of the survey. The study did identify
specimen trees, consisting primarily of Slash Pines, that exist on the site. A tree survey also
was submitted which indicated that there were a significant number of Slash Pines on the site.
The survey is available in the Planning Department.
According to the owner of the property there is currently a contract pending for purchase at
$1.1 million dollars.

CZR Incorporated is pleased to provide this report detailing the findings of our 20 August 1998 on site
biological assessment. This assessment was conducted to determine native vegetational habitat, the
presence of threatened or endangered species of flora and fauna, and locate and identify exotic and invasive
plant species as listed by the Florida Exotic Pest Plant Council's 1997 list. CZR also updated the provided
1990 tree survey of the site, identifying native trees which could qualify as "specimen trees" of their species,
and identifying native desirable trees for incorporation into the landscape.
It appears that nearly the entire site has undergone some sort of historical mechanical manipulation.
This is clearly evident by evenly spaced swales which run approximately east to west throughout the site.
This activity has basically eliminated native habitat consisting of a canopy, sub-canopy, and ground cover.
This property also demonstrates continuing human disturbance. The creation of trails, the dumping of trash,
building materials, and numerous automobiles frames, further degrades the potential for habitat value.
The only appropriate species of vegetation occurs in the canopy and consists of slash pine (Pinus
elliotti/}. The sub-canopy existing below the canopy is sparse with predominately exotic vegetation and few
native plant species. The ground cover is dominated primarily by species which are exotic, or out of
character, for a South Florida pine stand. Typical appropriate ground cover for a upland natural pine stand
in South Florida would exhibit a dominance of wire grass (Arisfida spp.), palmetto (Sable minor), and/or
gallberry (flex glabra). These species were largely absent here, and instead the dominant ground cover was
mad.e up of opportunistic species such as muscadine grape (Vitis rotundifolia), numerous escaped ornamental
species, and listed exotic species.
The only piece of native habitat occurring on the site was a very narrow band of pine canopy with a
dominant ground cover of palmetto (Figure 1). This area is located along the length of the southern property
boundary, and varies from 20 to 35 feet in width. In review of the developers plans, a 20-foot buffer will be
preserved along this boundary, and will be enhanced through removal of the exotic listed species which occur
within. This will preserve approximately 75 percent of the only native habitat which occurs on site.
No evidence of threatened or endangered species was observed at the time of the site survey. This
survey was accomplished through east to west visual transects which were approximately 50 feet apart. The
property was basically void of any terrestrial species except the ever present exotic armadillos, of which
several burrows were found and closely inspected to rule out gopher tortoise construction or use.

Exotic and invasive plant species were spread throughout the site. The areas where these particular
species displayed dominance are graphically demonstrated on Figure 1. Numerous exotic and invasive
species, including escaped non-native ornamental plants, were found in the sub-canopy and ground cover
throughout the entire site. Identifying their location of occurrence is beyond the scope of our task orders.
Approximately 50 to 60 percent of the entire site contained these plants. Species present in order of highest
to lowest occurrence were: melaleuca (Me/aleuca quinquenervia), Australian pine (Casuarina sp.), Brazilian
pepper (Schinus terebinthifolius), earleaf acacia (Acacia auricu/iformis), non-native sword fern (Nephrolepis
spp. ), schefflera ( Scheffiera actinophyl/a), bowstring hemp ( Sansevieria sp. ), philodendron ( Syngonium spp. ),
wandering jew (Tradescantia fluminensis), mimosa (A/biziaju/ibrissin), and non-native ornamental palms such
as areca, queen, and thorny date palm.
Specimen trees on site were identified through the 1990 tree survey, followed by on-site visual
inspection. The only specimen trees observed were pines identified according to good growth habit, non
bifurcated trunks, and apparent health. Forty-six pines measuring between 15 to 20" DBH on the survey were
found to be the best specimens, with trees larger than that nearing the end of their life cycle and exhibiting
red heart fungus. Other suitable healthy native vegetation including cabbage palms (Sable palmetto) of >9"
DBH, strangler fig (Ficus aurea) of >5" DBH, and wild olive (Osmanthus sp.) of >5" DBH were identified on
the survey per the developers wishes for incorporation into the landscape, through preservation, and
relocation.

commercial buildings and 6 rental units. Also completed renovations in

Returned to Florida :luly 2, 1991 and began new additions and remodeling
projects. After Hurricane Andrew, opened a fieM oj~fwe in Miami for
restoration work. My Miami office completed 16 residential restorations

qualifying the company, I did bring the Delray Tennis Center to
substantial completion in time for the Virginia Slims Tournament. Fallcav
Construction was at that time under contract with the City of Delray
Reach for the Tennis Center (2·5 milllon-doliar contract) and was also
engaged in 6 school projects for school districts from Palm Reach County
to Dade County. Falkav Construction went into bankruptcy and was

Bill Heller was born in Brookline, Massachusetts in 1928. He was
educated at Cambridge Academy, Cambridge, Massachusetts, attended the
University of New Hampshire and was graduated from Carnegie Institute of
Technology in Pittsburgh, Pennsylvania.
Bill entered the insurance business in 1952 in Boston. In 1958 he was
awarded the Chartered Life Underwriters designation. He and his wife moved
to Richmond, Virginia that year when Bill accepted a vice presidency at Fidelity
Bankers Life Insurance Company. In 1965, he resigned to become a consul-
tant to life insurance companies with Bowles, Andrews & Towne worldng in
their sales and marketing areas. In 1971, he opened his own general in-
surance agency in Richmond. He retired as president of Straus Financial
Services Corp. in 1995 when he married Ann and moved to Florida.
Bill and Ann have four married children between them. They have six
grandchildren. They moved to Bart Terrace in September 1995. Both have
been actively interested in the Board and our social functions since that time.
B/ll's experience and knowledge of the insurance /ndustry and his prior
management duties provide him with abilities that would be of value to all the
Unit Owners at Bmr Terrace. As a year-round resident, he has the time and
interest to serve in a meaningful capacity on the Bmr Terrace Board.
