I hereby request that the City of Delray Beach join with Block 77 in moving the court hearing the Petition for Certiorari in case number AP-00-1157-AY to relinquish jurisdiction for the purpose of allowing the City Commission to conduct a de hove headng of Block 77's application at the earliest possible time. The reason for this request is that redevelopment of the downtown Delray Beach is obviously a matter of great importance to the citizens of Oelray Beach, and the uncertainty of the current litigation has prevented the project from moving forward. There are three (3) issues raised in the Petition for Certiorari for which there is little clear guidance in pdor case law involving quasi iudiciaJ proceedings. Because of the prospect that those issues may not be decided without a lengthy appellate review process which could further delay downtown development for a substantial period of time, we believe that it is in the-interest of the City of Delray Beach to have a new consideration of the Block 77 project before the new Commission where for purposes of such consideration three (3) of the issues raised by the petitioner, Dharma Properties, in,'. ("Dharma"), will in effect be mooted by following the procedure the petitioner has requested to be followed. Specifically, for purposes of consideration of the Block 77 application, petitioner would be afforded the opportunity to have party status to make a full presentation to the Commission; petitioner would be afforded an opportunity to cross examine witnesses; and all commissioners would be required to fully disclose all ex-parle contacts. H~.~, City Manager Joe Weldon,~Director of Parks and Recreation ODABASHIAN PURCHASE- ITEMS FOR WORKSHOP ON 10/10 DATE: October 2, 2000 As you are aware, this past April the City leased from the Flodda Inland Navigational Distdct 4.09 acres for the development of a second Intracoastal park. This property is located on the eastside of U.S.1 just south of Knowies Park between the Delray Harbor Club and Harbourside. The lease with FIND is for 30 years with an option to review for 25 years at a cost of $1.00 per year. The City has a 24' easement off U.S.1 to the parcel leased from FIND. I am requesting City Commission authorize us to enter into a contract for sale and purchase with Eduaddo and James Odabashian for the purchase of approximately 1/3 acre (16,322 sq.ft) for $140,000.00. The Odabashian property fronts on U.S.I and is contiguous to the FIND property and our 24' access easement (see attached proposed site plan). The purchase of this property would allow the City to improve its access and provide for additional parking. The Odabashian property was appraised for $112,600 by Jenkins Appraisal Services, Inc. on January 27, 1999. We have already been approved for a $70,000 grant from FIND for the purchase of this property. We have also applied for a $70,000 grant from the Florida Boating Improvement Program under the auspices of Palm Beach County, which I think we have a pretty good chance of getting. Both of these grants are reimbursable grants which mean we have to front the $140,000 and then be reimbursed by FIND and Palm Beach County. The $140,000 has been approved in next years capital improvement budget under Capital Project Funds, account number to be assigned. Since we anticipate, per City Commission approval, on closing on the Odabashian property prior to the Palm Beach County Commission approving our grant request, we have requested our grant request to be retroactive, which the County has agreed to do. (see attached letter) Palm Beach County Commission will consider our grant application at their October 31, 2000 meeting. Please place this on the Commission Workshop Agenda for October 10, 2000. Michael Langton, President A former member of the Florida House of Representative (1985-1992), Mike Langton has had aa extensive career in Florida State and local government. Lisa King, Vice President King's 15 year career in public affairs includes stints as a Congressional Aide for a U.S. Congressman and a Legislative Assistant for a committee chair in the State House. She was appointed by two Florida House speakers to three committees including appointment as a member of the House Computer and Telecommunications Commission. King was also awarded a Davis Productivity Award by Florida Taxwatch, Inc. for a cost saving idea implemented by the Florida House. This grant funded a three year study of drug treatment for inmates including drug testing during the booking procedure. Florida Communities Trust: Land acquisitions in both rural and urban sites ranging fi:om 1,000 to 5 acres at a cost of $3 million to $100,000. U.S. Department of Commerce, Economic Development Administration: Infrastructure Improvements, $1.2 million. This grant funded road improvements, including widening, paving, curb and gutter, and new drainage. U.S. Public Health Service,: Community Health Center grants (3), $1,500,000. These grants funded the establishment and operation of Primary Care Centers in Duval and Leon Counties. U.S. Department of Housing and Urban Development: Community Development Block Grant (CDBG) Program, $12.1 million. Grants funded public improvements such as streets, drainage, parks and recreation, facility construction, etc., in blighted neighborhoods. Supportive Housing Homeless Assistant Grants, $5,600,000. Grants funded temporary and permanent housing by two non-profit groups in two Florida Counties. Hope 6 Public Housing Modernization, $400,000. Two communities received three grants for dock and boat ramp improvements totaling $219,000 through the Florida Boating Improvement program. Florida Department of State: Historic Preservation grant-in-aid for numerous communities to restore and preserve historically significant buildings, $3,000,000. University of Central Florida: Solar Conversion Grant Program, $20,000. This grand helped fund the conversion of an entire island in the Florida Keys to photovilitic energy. Florida Department of Commerce and the Governor's Office of Tourism, Trade and Economic Development: $3 million. Economic Development Grants to various communities creating new 'jobs. Florida Department of Community Affairs: $5 million. Community Development Block Grants to various communities funding neighborhood improvements, housing rehabilitation activities and economic development. Florida Department of Community Affairs: $619,965. Anti-drug Abuse Grant providing funds for pilot work release program, pre-trial intervention services, and D.A.R.E. U. S. Department of Commerce: National Oceanic and Atmospheric Administration, $62,750. This grant funded a visioning project to develop a revitalization plan for St. Andrews, a coastal historic area of Panama City, Florida. Office of the Attorney General: Florida Motor Vehicle Theft, $56,000. This grant funded education and prevention to reduce the number of motor vehicle thefts. We received and reviewed proposals from In Rem Solutions, Inc., Langt~n Associates, Berryman & Hen[gar and Rosalind He~ene Fischel. DISCUSSION We rated each proposal on the following criteria: 1. Qualifications and history of firm' 2. Success of obtaining local, state and federal grants for local governments; 3. Cost of selvices; 4. References; 5, Education; 6. Samples of grant requests: and 7. Knowledge/understanding of City and Palm Beach County. Based upon these cdteria it is our recommendation that the City Council contracts with Langton Associates. Inc. of Jacksonville, Florida for granting writing services. Langton AsSociates, Inc. specializes in grant writing and grant administration and has been serving ciiertts statewide and nationally for heady twenty year~.
