AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY THE FOLLOWING DESCRIBED TRACTS OR PARCL1~S 0F LAND LOCATED IN PAI~I BEACH COUNTY, FLORIDA, AND LYING CONTIGUOUS TO THE EXISTING MUNICIPAL LIMITS OF SAID CITY OF DEI~RAY BEACH~ SAID LANDS BEING LOCATED IN SECTION 19 AkrD SECTION 20, OF TOWNSHIP 46 SOUTH, RANGE 43 EAST, PALM BEACH COUNTY, FLORIDA; AND PROVIDING FOR THE ZONING AND TAXATION OF SAID LANDS. WHEREAS, the City Council of the City of Delray Beach, Florida, has determined that the hereinafter described land is contiguous to the existing municipal boundary lines of the City of Delray Beach, Palm Beach County, Florida; and WHEREAS, JOHN N. KABLER, JR., Joined by his wife· JOAN W. KABLER· are the sole fee simple title holders of the property herein described as PARCEL l; and MOORE-~ERTZ, INC., a Florida corporation, is the owner of PARCEL 2 hereinafter described, and said persons and corporation have heretofore by their Petitions for Annexation, consented and given permis- sion for the annexation of said property by the City of Delray Beach; and ~, the City of Delray Beach, Florida, has heretofore been authorized to annex lands in accordance with its charter grsnted it by the State of Florida: NOW, TH3EREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS POLLO%~S: SECTION 1. That the City Council of the City of Delre~y Beach, Palm Beach County, Florida, does hereby annex to said City the following described tracts or parcels of land loce. ted in Palm Beach County, Florida, which lie contiguous to the existing boundaries of said City, to-wit: PARCEL 1. The Easterly portion of the East 1/~2 of Northeast 1/.4 of Northeast 1/4 of Southeast 1/4, bein.~ 166.99 feet wide on South, and 166.27 feet wide on North, in Section 19, Town- ship 46 South, Range 43 East, Palm Beach County, Florida. PA~RCE14 2: Lot 21, SUBDIVISION OF SECTION 20, Township 46 South, Range 43 East· according to the plat thereof on file in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, recorded in Plat Book l, page 4; and Lots I and 2 of ESQUIRE SUBDIVISION · according to the plat thereof on file in the office of the Clerk of the Cir- cuit Court in and for ralm Beach County, Florida· recorded in Plat Book 23, page -1- and The West 1/4 of Lot 29, SUBDIVISION OF SECTION 20, Township 46 South, Range 43 East, accordimg to the plat thereof on file in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida~ recorded in Plat Book l, page 4; ~XCEPTING a lot described as follows: Beginning at the Southeast corner of the above described tract; thence run West 70 feet; thence run North 155 feet to a~ iron stake; thence run East 70 feet to the West line of ESQUIRE SUBDIVIS- ION; thence run South along the said west line of Esquire Subdivision to the point of beginning. SECTION 2. That the boundaries of the City of Delray Beach are hereby redefined so as to include therein the above described parcels of land, and said lands a~e hereby declared to be in the corporate limits of the City of Delray Beach, Florida. SECTION 3. The property hereinabove described is herein annexed to the City of Delray Beach, Florida, under the follo~rIng conditionse That said properties shall be taxed as acreage so long as they remain unplatted and unimproved, but in the event said lands are platted, but un- improved, they shall not be taxed for advalorem taxes in excess of an annual tax of $10.O0 per lot, as shown on such plat as may be approved for a period of ten years from the date of annexation; ex- ceo~t provided, further, that in the event any parcel or lot is sold, transferred or otherwise disposed of by the owners, or in the event buildings are constructed on any parcel or lot, then such lot shall be subject to normal taxation, including the bonded indebtedness of the City of Delray Beach. SECTION 4. The property hereinabove described and herein annexed to the City of Delray Beach, Florida, is taken into the City under the following zoning regulations and con- ditions. (a) That said property hereinbefore described shall be annexed and zoned as "C-2" General Commercial District. (b) That a right-of-way not exceeding 55 feet from the center line of the proposed westward extension of S. i~. 10th Street through said annexed property shall be dedicated by the ow~ers thereof.
