WHERF~S, it has been found and determined by the
City Council of the City of Delray Beach, Florida, to be
detrimental to the safety, health and welfare of the citizens
of this cormuunity to permit the parking of trucks in excess
of 3/4 ton rated capacity upon the public streets and upon
private property in certain residential areas of the City of
Delray Beach, unless such trucks are parked in a garage,
porte-cochere, carport or other covered structure, and that
parking el~ such trucks overnight in certain residential areas
greatly reduces the value of surrounding properties and general-
ly injures and jeopardizes the health and general welfare of
the City of Delray Beach.

SECTION 1. That Chapter 2~ of the "Code of 0rdinsmces of the
City of Del,'ay Beach" e~titled "Traffic" be amended
by c~eat~.g a new Section to be numbered Sec.2~-37(d),
making it an offense to park a truck in excess of
3/4 ton rated capacity upon the streets or upon
private property in certain residential districts
zoned as R-l-A, or R-l-~A or R-l-AAA for overn
parkLng, unless such trucks are parked in covered
garages, port-cocheres, carports or other covered
buildLugs; said section to mead as follows:
"Sec. 2~-~7(d). No person shall park for over-
night parking a truck in excess of 3/[~ ton
rated capacity upon the public streets or upon
private property in residential districts
R-lA or R-l-AA or R-1-.~%A unless such truck
be parked in a covered garage, covered porte-
cochere, covered carport or ot~or covered
building. The person so parking said truck
shall be guilty of the offense regardless of
the ownership of the truck, it shall be prima
£acie evidence of intent to violate this
section if a person so parks a truck between
the hours of 9:00 o'clock P.M. ond 6:00 o'clock
A.~I. of the following day."
SECTION 2, All ordinances and parts of ordinances in conflict
herewith be and the ss~e are hereby repealed.
